    Book SynopsisThe emancipation of the Jews of England was largely complete when George III came to the throne in 1760. Free to live how and where they wished, the Jews had been specifically exempted from the provisions of the 1753 Marriage Act which made Christian marriage the only legal option for all others. The effect of this exemption was to put the matrimonial causes of the Jews of England exclusively in the hands of their Rabbis and Dayanim (Jewish ecclesiastical judges) for the next one hundred years. No Bet Din (Jewish ecclesiastical court) anywhere in the world has left such a complete record of its transactions -- matrimonial and proselytical -- as that contained in the extant Pinkas (minute-book) of the London Bet Din from 1805 to 1855. In all other matters, including the offences punishable by transportation, Jews were subject to the jurisdiction of the civil courts. Of the estimated 150,000 convict transportees shipped to the Australian penal colonies, some seven hundred were Jews. Matrimonial and related matters involving twenty of these miscreants are recorded in the Pinkas. Jeremy Pfeffer recounts the history of the London Bet Din during these years as revealed by the Pinkas record and relates the previously untold stories of this group of Jewish convict transportees and their families.

Martin Honecker befasst sich zum einen mit der Grundsatzdiskussion im evangelischen Kirchenrecht, mit der Frage nach den theologischen Voraussetzungen von Kirchenrecht und mit notwendigen Unterscheidungen wie dem Staatskirchenrecht, dem innerkirchlichen Organisationsrecht und dem Recht des geistlichen Auftrags. Die erlassenen Ordnungen wirkten dabei oft weit über den Rahmen des kirchlichen Lebens hinaus auf das politische und rechtliche Geschehen. Zu den kirchenordnenden Texten zählen Agenden, Liturgien, Gebetsformulare, Vorschriften zur Anstellung von Pfarrern und Diakonen sowie Richtlinien zu ihrer Tätigkeit, Instruktionen für Visitationen, aber auch Armen-, Ehe- und Zuchtordnungen. Der vorliegende Band erfasst ein Territorium außerhalb des Reichs. Siebenbürgen wurde zum Sonderfall konfessionellen Miteinanders von vier rezipierten und weiteren tolerierten Konfessionen; das "ius reformandi" lag bei den Gemeinden. Den allgemeinen Rahmen schufen Landtagsbeschlüsse, die den Schwerpunkt des ersten, Siebenbürgen allgemein betreffenden Teils bilden.     Book SynopsisDie Transformation des Kirchenbegriffs in der Frühaufklärung vollzog sich in Form einer doppelten Horizontüberschreitung zum einen über die Grenzen der Theologie hinaus und zum anderen innerhalb dieser. Die Öffnung der ekklesiologischen Debatte außerhalb der Theologie führte zur Ethisierung und Universalisierung des Kirchenbegriffs verbunden mit dem Aufkommen einer Kultur der religiösen Mündigkeit des Laien. Auf der Suche nach einem allgemeineren Begründungszusammenhang als es spezielle offenbarungstheologische Rechtfertigungen boten, rückte der Kirchenbegriff in den Fokus von Naturrecht und Religionstheorie. Durch den Paradigmenwechsel vom Staats- zum Vereinsgedanken erfolgte die rechtliche Einordnung religiöser Institutionen in die Gesellschaft. Die Etablierung des Territorial- und Kollegialsystem brachte die vorläufige Klärung und Regelung des Verhältnisses von Kirche und Staat. In Reaktion auf die Transformation des Kirchenbegriffs außerhalb der Theologie kam es erst relativ spät zur Transformation innerhalb dieser. Die Folge war eine Erweiterung des dogmatischen Kirchenbegriffs und die Thematisierung der Ekklesiologie außerhalb der Dogmatik. Diese doppelte Horizontüberschreitung hat sich in der Frühaufklärung durchgesetzt, was verständlich macht, warum die Neologie keine größeren Anstrengungen mehr auf dem Gebiet eines verengten Kirchenbegriffs unternahm, sondern dazu überging, die Sozialformen der abendländischen Religion im Rahmen einer Christentumstheorie zu verhandeln.
