Book SynopsisThis newly revised and updated second edition of the Research Handbook on International Law and Terrorism provides a comprehensive overview of international counter-terrorism law and practice from the perspectives of human rights, the law of armed conflict, the law on use of force, and international criminal law. Brand new and revised chapters provide critical commentary on the law from leading scholars and practitioners in the field. Major controversies in the global legal response to terrorism are examined, including up-to-date analyses of the war on terror, drone strikes and targeted killings, torture and rendition, indefinite detention, military trials, and UN Security Council measures and sanctions. New topics for this edition are assessed, focusing on foreign terrorist fighters, the nexus between organized crime and terrorism, and the prevention of violent extremism. Exploring developments from before and after the terrorist attacks of 9/11, the Research Handbook also includes new analysis of contemporary threats such as Islamic State, and discusses the law of regional organizations and selected national practice. International law scholars and practitioners, as well as government and United Nations legal advisers, will find this an invaluable reference on a complex area of legal inquiry. It will also prove a critical read for academics and students in international relations, terrorism studies, security studies, war studies, and human rights.Trade Review'The second edition of the Research Handbook on International Law and Terrorism edited by Ben Saul belongs first on the desk and thereafter on the bookshelf of every academic or professional expert working on legal issues related to terrorism. 15 in stock

Book SynopsisThis highly topical book is an original contribution to the current literature on counter-terrorist financing, compliance and soft law. Specifically, the book focuses on Financial Action Task Force recommendations and counter-terrorism financing legislation. This thought-provoking investigation demonstrates that an understanding of the counter-terrorism financing regime can shed light on the departure from regular international law-making processes, and on the emerging forms of international governance in an era of globalisation. An understanding of the regime s multi-layered approach shows how this can be replicated as a tool in the prevention and resolution of conflict and the promotion of international justice in areas such as human trafficking, drug trafficking, and weapons of mass destruction. This book will be an invaluable resource for those studying and researching in law, terrorism studies, criminal justice and finance, in particular comparative law and compliance with hard and soft law. It will also be relevant to policymakers and practitioners working in counter-terrorism.Trade Review'An important and compelling account of the development of a global regime to counter terrorism financing. Vital material for all students of counter-terrorism and the role of soft law and national self-interest in producing compliance with international law.' --Kent Roach, University of Toronto, CanadaTable of ContentsContents: 1. • National Security and Double Government

Oxford University Press National Security and Double Government

    15 in stock

Book SynopsisWhy has U.S. security policy scarcely changed from the Bush to the Obama administrations? The theory of double government posed by the 19th century English scholar Walter Bagehot suggests a disquieting answer that is extensively discussed in National Security and Double Government. Michael J. Glennon challenges the myth that U.S. security policy is made through the visible, Madisonian institutions--the President, Congress, and the courts, proposing that their roles are largely illusory. Presidential control is nominal, congressional oversight is dysfunctional, and judicial review is negligible. He argues that security policy is really made by the managers of the military, intelligence, diplomatic, and law enforcement agencies- a concealed Trumanite network of several hundred members who are responsible for protecting the nation, and who are primarily immune from constitutional restraints. As such, this new system of double government will not correct itself, as to do so would require tTrade ReviewMichael Glennon's book is important precisely because it pulls back the curtain to reveal the realities of the largely unconstrained U.S. national security state. In doing so, Glennon's analysis shows how the national security apparatus is a threat to the very freedoms its inhabitants and supporters purport to protect. * Christopher J. Coyne, Public Choice *[An] original and thought-provoking book, with a key goal of explaining why national security policies change little across presidential administrations. * AJIL, Ashley Deeks, University of Virginia School of Law *Though it's a bedrock American principle that citizens can steer their own government by electing new officials, Glennon suggests that in practice, much of our government no longer works that way. In a new book, "National Security and Double Government," he catalogs the ways that the defense and national security apparatus is effectively self-governing, with virtually no accountability, transparency, or checks and balances of any kind. He uses the term "double government": There's the one we elect, and then there's the one behind it, steering huge swaths of policy almost unchecked. Elected officials end up serving as mere cover for the real decisions made by the bureaucracy. * Jordan Michael Smith, Books of the Year 2014, The Boston Globe *If constitutional government is to endure in the United States, Americans must confront the fundamental challenges presented by this chilling analysis of the national security state. * Bruce Ackerman, Sterling Professor of Law and Political Science Yale University *Shrewdly updating Walter Bagehot's theory of 'double government,' Michael Glennon shows how present-day Washington really works. In our faux democracy, those we elect to govern serve largely ornamental purposes, while those who actually wield power, especially in the realm of national security, do so chiefly with an eye toward preserving their status and prerogatives. Read this incisive and richly documented book, and you'll understand why. * Andrew J. Bacevich, Professor of History and International Relations, Boston University *Taking a leaf from Walter Bagehot's thesis of dual government in Britain, Michael Glennon has transported the concept of 'double government' to the United States analyzing the constitutional institutions, or what he calls the 'Madisonian' side; and a cohort of several hundred senior military, diplomatic, and intelligence officials who run the daily business of national security, or what he calls the 'Trumanite' side. This explains the relatively little difference between the Bush 43 and the Obama presidencies. In this brilliant, deeply researched book, Glennon spells out the relation of his overall thesis to contemporary issues such as the Snowden revelations. * Charles G. Cogan, Associate, International Security Program Belfer Center for Science and International Affairs, Harvard Kennedy School *Michael Glennon has written a brilliant book that helps explain why U.S. foreign policy changes so little over time, despite frequent failure. Barack Obama certainly promised to fundamentally alter America's approach to the world, but little changed after he took office. Glennon shows how the underlying national security bureaucracy in Washington - what might be called the deep state - ensures that presidents and their successors act on the world stage like Tweedledee and Tweedledum. * John J. Mearsheimer, R. Wendell Harrison Distinguished Service Professor of Political Science, University of Chicago *In this timely book Michael Glennon provides a compelling argument that America's national security policy is growing outside the bounds of existing government institutions. This is at once a constitutional challenge, but is also a case study in how national security can change government institutions, create new ones, and, in effect, stand-up a parallel state. This is a well-argued book of academic import and policy relevance. It is recommended reading for an informed debate on an issue of great significance. * Vali Nasr, Dean of Johns Hopkins University's School of Advanced International Studies *National Security and Double Government is an important and insightful book. It should be read by anyone concerned that Obama's national security policies differ so little from those of the Bush Administration, and by every in-coming President and her staff. * Morton H. Halperin, Senior Advisor, Open Society Foundations *Glennon has written a unique book that stands out among the collection of post-9/11 works for the way it lashes historical trends to the most contemporary problems of government secrecy, power and overreach in a highly readable way. I underlined passages on just about every page and can't wait to reread it. The 'ah ha!' moments are endless. * Dana Priest, Two-time Pulitzer Prize winning national security reporter, The Washington Post *Michael Glennon's National Security and Double Government explains why U.S. foreign policy is prone to recurring failure and resistant to genuine reform. Instead of being responsive to citizens or subject to effective checks and balances, U.S. national security policy is in fact conducted by a shadow government of bureaucrats and a supporting network of think tanks, media insiders, and ambitious policy wonks. Presidents may come and go, but the permanent national security establishment inevitably defeats their efforts to chart a new course. Gracefully written and extensively researched, this book is the most penetrating analysis of U.S. foreign policy that I have read in years. * Stephen M. Walt, Robert and Renee Belfer Professor of International Affairs, Harvard Kennedy School *National Security and Double Government is brilliant, deep, sad, and vastly learned across multiple fields--a work of Weberian power and stature. It deserves to be read and discussed. The book raises philosophical questions in the public sphere in a way not seen at least since Fukuyama's end of history. * David A. Book SynopsisTrade ReviewWe have clearly not learned the lessons of past financial debacles, a central one being that crime has played a significant role in them. Unlike traditional economic and legal analyses, this volume starts from the (correct) premise that criminal offending was a central phenomenon in the meltdown. Its contents provide diverse and penetrating analyses of how fraud occurred and how it might best be prevented. This work provides an excellent foundation for further academic research and needs to be on the desk of every legislator dealing with financial regulation. -- Henry N. In this book, leading criminologists put this right by explaining impunity for the crimes of financial capitalism. It is rich with insight on how Wall Street games regulation. Book SynopsisTrade ReviewA remarkable story, rich in untold details about a vastly lucrative yet little known trade. -- Anne McClintock, University of Wisconsin-Madison An extraordinary work, at once a participatory anthropology, detached sociology, cultural history, remarkable example of oral history, series of smuggling stories, and many other things to boot. -- Anders Stephanson, Columbia University At once cutting-edge research and candid autobiography, this globe-straddling tale rolls from Southern California surf shops to the beaches of Baja, from Maui to seedy bars in Thailand and the jungles of Laos, and from communist extermination camps in Cambodia to DEA Headquarters in Washington, D.C. Along the way, the authors introduce a cast of real-life characters stranger than fiction, who earned their place in the annals of American crime by chasing their own dreams across the high seas and back again, creating a billion-dollar black market industry in the process, sometimes at the cost of their freedom and sometimes at the cost of their lives. -- Craig Etcheson, war crimes investigator From the dank highlands of Siam to the sage-blown point breaks of Alta California, Thai Stick explores the relationship between surf culture and the 'funny business.' Maguire-grounded in law, history, and the surfing life-is exactly the right author for this street-level breakdown of smuggling in the 1970s. -- Scott Hulet, The Surfer's Journal Thai Stick is a brilliant story of the surfers and watermen who pioneered the trans-Pacific pot trade. Adventurous and often hilarious, the book's narrative blows open one of the last remaining secrets of the hippie era. It also exposes the dark side of the business and its occasionally tragic consequences. Thai Stick is at once an authoritative work of history and an intense, highly entertaining read. -- Nicholas Schou, author of The Weed Runners: Travels with the Outlaw Capitalists of America's Medical Marijuana Trade Thai Stick is a rare, heart-stopping story about California surfers, hippies and straight out druggies who smuggled potent marijuana from Thailand to the United States and changed the shape of the American drug culture. Book SynopsisAn investigation into the unintended cultural and psychological consequences of our fight against terrorism.Trade ReviewVery few people are able to synthesize the disciplines of anthropology, mental health, cultural studies, political theory, religious studies, bioethics, and forensics in the way Neil Krishan Aggarwal does in this book. He offers a balanced and insightful account of the challenges of forensic psychiatry in assessing and managing terrorism suspects. -- Hamada Hamid, Yale University Using concrete clinical cases to anchor sophisticated and thought-provoking analysis, Aggarwal demonstrates that not only ethics but also the very nature of clinical knowledge and practice are at issue in the use, and especially misuse, of mental-health categories in the War on Terror. His book brings a new level of critical self-reflection to the psychology of terrorism. -- James W. Jones, author of Blood That Cries Out from the Earth: The Psychology of Religious Terrorism An indispensable and astute account of the insidious cultural manifestations emerging from the justifying framework that is the War on Terror. In light of the increasingly intolerable actions permissible through deference to notions of national security, Aggarwal's review of bioethics is crucial to understanding the evolution, through politicization, of approaches to mental health. Aggarwal's review of orientalist positions within psychotherapy literature, which underpin this creeping securitization of mental health, reinforces the impact of culturally laden views on Islam and Muslims. An essential read. -- Orla Lynch, Centre for the Study of Terrorism and Political Violence, University of St Andrews Aggarwal has written a theoretically sophisticated, multisided exploration of how the War on Terror and mental health are powerfully connected through the 'culture' of psychiatry, psychoanalysis, hospitals, courts, the military, and Islam. His argument is that science, religion, and moral experience are not just infiltrated with cultural meanings but come to create new cultural forms such as 'trauma,' forensic processes, and 'terrorism,' which in turn remake the world. An important achievement. -- Arthur Kleinman, Harvard University A clear and impassioned discussion of the presence of psychiatrists and mental-health knowledge practices in the micro-functioning of the War on Terror and the impact of each on the other. The book is a compelling portrayal of the way that medicine and its scientific languages and knowledge structures are able to move through and across political domains, being put to use to challenge and undo the very power structures they are meant to serve. Engaging, rigorous, and beautifully written. -- Sarah Pinto, Tufts University In this impressive and provocative volume, Aggarwal reveals many hidden failings of dominant social and political thought on radicalization and terrorism. Bioethics, arabic science, and symptoms in Guantanamo detainees are all debated to present an alternative, rounded, and compelling approach that includes medicine and cultural psychiatry as essential actors. -- Kamaldeep Bhui, Queen Mary University of London The questions it poses are valuable, difficult, and without easy answers - for clinicians, military leaders, or even civilians, all of whom must live with a medical culture deeply marked by the war on terror. Book SynopsisThis authoritative book provides a holistic overview of terrorist groups and finances, including consideration of the necessity and differing financial needs of different groups.Trade Review’In recent years a great deal has been written about terrorism and how best to inhibit and undermine terrorists’ aspirations. Much of this literature tends to be one dimensional reflecting the experience of the author. Dr Ridley having had a long and diverse career in intelligence and in particular financial analysis has succeeded in going far beyond description of a series of war stories to providing not only a starting account of the range and character of modern terrorism, but also a knowledgeable analysis of the measures adopted around the world to combat the threat. Of critical importance, in the minds of many, has been the adoption of techniques in the main from the “war against drugs” facilitating the identification and disruption of finance. While emphasising the value of financial intelligence Dr Ridley, now as a scholar, dispassionately questions how successful this strategy has been and where it might take us. Such issues need to be aired and resolved if we are not to undermine the very values which we seek to protect.’ -- Barry Rider, University of Cambridge, UK’This is hugely important and highly relevant contribution by a world expert, which adds to our knowledge of terrorist funding. It will make practitioners and academics alike, not to mention politicians who should be seeking their advice, stop and think.’ -- John Grieve, Portsmouth University, UK and former UK National Co-ordinator for Counter Terrorism’Dr. Ridley has authored an excellent, analytical, comprehensive, and solutions-oriented book addressing the complexities of terror financing and the challenges in combating this menace. A must-read for concerned citizens (Library Journal, starred review) from bestselling author Jeremy Scahill and his colleagues at the investigative website The Intercept.Drones are a tool, not a policy. The policy is assassination. But drone strikes often kill people other than the intended target. These deaths, which have included women and children, dwarf the number of actual combatants who have been assassinated by drones. They have generated anger toward the United States among foreign populations and have even become a recruiting tool for jihadists. The first drone strike outside a declared war zone was conducted more than twelve years ago, but it was not until May 2013 that the White House released a set of standards and procedures for conducting such strikes. Book SynopsisThis timely edited collection brings together experts in the fields of legal history, criminal justice, human rights and counter-terrorism law to appraise Ireland’s Offences Against the State Act on the eightieth anniversary of its enactment. The origins, development, invocation and extension of the powers contained in the legislation are analysed and critiqued using a broad range of methodologies. The book engages fully with the 1939 Act’s scope and complexity including consideration of the impact of the Act on issues as diverse as trial by jury, paramilitary organisations, organised crime, disclosure, the rules of evidence, freedom of expression and association, parliamentary oversight of legislation and adherence to international human rights norms. In addition, the interplay of the Act with the universal themes of normalcy, exceptionalism, contagion and due process are explored throughout. This book will appeal to an audience beyond those with a particular interest in the Act itself. It combines historical and contemporary insights with theoretical and practical perspectives that will enrich the reader’s understanding of emergency law, wherever it arises.Trade ReviewA deeply intriguing and arresting read from start to finish … particularly timely in light of the advent of emergency legislation pertaining to the Covid-19 pandemic … an essential read for all scholars and enthusiasts of Irish constitutional law, Irish politics and modern Irish history for many years to come. -- Michael Carmody, University of Limerick * Irish Jurist *Table of Contents1. Book SynopsisThis book offers a unique account of British and United States government's attempts to adapt their propaganda strategies to global terrorist threats in a post-9/11 media environment. It discusses Anglo-American coordination and domestic struggles that brought in far-reaching changes to propaganda. These changes had implications for the structures of legitimacy yet occurred largely in isolation from public debate and raise questions regarding their governance. The author argues that independent and public reexamination of continuing strategy development is essential for government accountability and the formation of systems and policies that both respect citizens and build constructive foreign relations. The book's themes will appeal to a wide readership including scholars and professionals. It draws on illuminating interviews with high-profile British/US sources including journalists, PR professionals and key foreign policy, defence and intelligence personnel.Trade Review'Simply put, this is the single best book I have ever encountered about propaganda and information operations, bar none. Manchester University Press The Securitisation of Islam: Covert Racism and

    Out of stock

Book SynopsisThis book is a timely analysis of the securitisation of Islam since 9/11 and presents an original study of Islamophobia and White fragility in a context where far-right extremism is rising in Europe and the US. It unpacks how it is possible for various U.S. governments to impose discriminatory counterterrorism measures on Muslim communities whilst simultaneously declaring they are ‘not racist’. Eroukhmanoff addresses these contradictions by linking the Islamic terrorism discourse with covert racism and by revealing the covert ways in which this securitisation is made. Furthermore it offers a critique of the ‘soft’ and ‘hard’ approaches to counterterrorism and advances an alternative way to think of (counter)-radicalisation by introducing a quantum perspective. Drawing on the ‘affective turn’, Eroukhmanoff argues that covert securitisations remove the emotional experience that usually invest the act of securitisation and that this de-affectivisation allows White American subjects to be constructed as innocent and threatened whilst constructing Muslim subjects as potential terrorists and thus as mere sites of securitisation.Trade Review'Clara Eroukhmanoff has conducted a superb linguistic analysis of the ways in which covert forms of anti-Muslim racism inform the securitization of Islam. A deeply erudite and interdisciplinary study, this book offers a nuanced analysis of the interplay between various security actors’ methods of constructing Islam and Muslims within a security framework. It offers valuable insights for scholars of anti-Muslim racism and Security Studies.'Professor Deepa Kumar, Associate professor of Journalism and Media Studies, Rutgers University'Eroukhmanoff delivers an intriguing and original study of Countering Violent Extremism operations in the United States. Her book is motivated by the clash between the careful rhetoric of several Presidents, which strives to maintain plausible deniability of racism, and the infiltration of mosques and Islamic community centres across the U.S. by CVE networks. Through interviews with CVE practitioners, Eroukhmanoff delivers an important analysis of how the field indirectly securitises Muslims through language, sting operations and affective governance. The book then steps beyond conventional risk-based epistemology to pose the question of counter-radicalisation through a quantum social science lens.'Dr Charlotte Heath-Kelly, Reader in International Security, University of Warwick'This is an impressive and mature work of critical analysis. Elegantly argued, insightful and impeccably timed, it makes a major contribution to our growing understanding of racial politics and Islamophobia in contemporary American society. Impressively, in its dissection and analysis of the indirect securitisation of Islam in American political discourse, it adds a new layer of correction and sophistication to current versions of securitisation theory. A major step forward in security analysis, I highly recommend this book.'Professor Richard Jackson, University of Otago, New Zealand -- .Table of ContentsAcknowledgements List of abbreviations Introduction1 Language and securitisation2 Framing Islam as a non-security issue3 Securitising Islam covertly4 Counterterrorism and countering violent extremism in the United States5 Classical versus quantum radicalisation6 Affect, white victimhood and the denial of racismConclusionBibliographyIndex

  • Avoiding The Terrorist Trap: Why Respect For

Imperial College Press Avoiding The Terrorist Trap: Why Respect For

    Out of stock

    Book SynopsisFor more than 150 years, nationalist, populist, Marxist and religious terrorists have all been remarkably consistent and explicit about their aims: provoke states into over-reacting to the threat they pose, then take advantage of the divisions in society that result. Yet, state after state falls into the trap that terrorists have set for them. Faced with a major terrorist threat, governments seem to reach instinctively for the most coercive tools at their disposal and, in doing so, risk exacerbating the situation. This policy response seems to be driven in equal parts by a lack of understanding in the true nature of the threat, an exaggerated faith in the use of force, and a lack of faith that democratic values are sufficiently flexible to allow for an effective counter-terrorism response. Drawing on a wealth of data from both historical and contemporary sources, Avoiding the Terrorist Trap addresses common misconceptions underpinning flawed counter-terrorist policies, identifies the core strategies that guide terrorist operations, consolidates the latest research on the underlying drivers of terrorist violence, and then demonstrates why a counter-terrorism strategy grounded in respect for human rights and the rule of law is the most effective approach to defeating terrorism.Table of ContentsIntroduction; A Not-So-Secret Formula: Asymmetrical Warfare; Attrition; Propaganda by Deed; The Revolutionary Prototype; The Concept of Martyrdom; Provoking an Overreaction; Polarization; Building Legitimacy; The Centrality of Popular Support; Conclusion; Social Science and Violent Extremism: Empathy; Dehumanization; Backlash; Self-Actualization; Youth Bulge; Burn Out; Social Networks; Socialization; Framing Narratives; Poverty; Relative Deprivation and Social Exclusion; Political Opportunity; Government Aggression; Micromobilization; Precipitating Incidents; Conclusion; Countering Terrorism Within a Human Rights Framework: Terrorism and International Law; Defining Terrorism in International Law; Terrorism and International Human Rights Law; Non-State Actors and Human Rights; Putting Human Rights at the Heart of Counter-Terrorism; Community Engagement; Community-Oriented Policing; Early Intervention Programs; Proscribing Hate Speech and Extremist Organizations; Special Investigation Techniques; The Right to Privacy; Human Intelligence Operations; Surveillance Operations; Investigative Interviewing; The Presumption of Innocence; Human Rights Compliant interviews; Torture; Detention Regimes; The Right to Liberty and Due Process; The Humane Treatment of Prisoners; Prisoners of War and Enemy Combatants; Deradicalization Programs; Using Force; Maintaining Public Order; The Right to Life; Targeted Killing; Conclusion; Final Thoughts;

Book SynopsisThis timely volume by distinguished scholar Günter Frankenberg offers a sophisticated analysis and sharp critique of the reactions of nations such as the US, Great Britain and Germany to perceived terrorist threats, organized crime actions and other political emergencies that have occurred in recent years. The author demonstrates how governments have increasingly sacrificed the rule of law and human rights for the benefit of security programs ? as evidenced by a rise in extraordinary measures such as surveillance, detention and torture ? thus normalizing the state of exception and privileging preemptive, proactive and coercive methods of political engineering. An interdisciplinary and multi-jurisdictional study, this book develops and implements a unique theoretical and conceptual framework for understanding the rise of technical-political rationality and the fall of the rule of law, and submits both to a firm critique. Particularly relevant in light of current controversies, this provocative book will appeal to scholars and students of international and constitutional law, legal theory, political science, and terrorism studies.Trade Review‘Books abound on the question whether states of emergency can be legally controlled. But Frankenberg’s account stands out because of his mastery of the political and legal contexts in which the terms of the debate about states of emergency were framed for us – the situation of Weimar and the constitutional reaction in postwar Germany. In addition, Frankenberg has an astonishing command of the history of political theory from Hobbes to the present. His innovative but scholarly analyses permit him to construct a narrative about the potential of the rule of law to respond to emergencies that includes detailed examinations of Schmitt, Foucault, Habermas, Agamben, and many others. His treatments of these figures seek to draw out the genuine insights they might offer, so that, even though none of the figures escapes the force of his criticism, his argument will challenge the assumptions of all involved in the debate.’ -- David Dyzenhaus, University of Toronto, CanadaTable of ContentsContents: Preface 1. • Constitutionalism Across Borders in the Struggle

Edward Elgar Publishing Ltd Constitutionalism Across Borders in the Struggle

    15 in stock

Book SynopsisThis edited collection explores the topic of constitutionalism across borders in the struggle against terrorism, analyzing how constitutional rules and principles relevant in the field of counter-terrorism move across borders. Various chapters underline how constitution-like norms consolidate at the level of international and supranational organizations as a limit to the exercise of public power in the field of counter-terrorism policy, especially counter-terrorism financing. Other chapters examine the extraterritorial application of constitutional rights and the migration of constitutional norms - or anti-constitutional practices - from one state to another. Still others consider how transnational cooperation between states in areas such as intelligence gathering and data sharing may call for updating domestic constitutional law rules or for new international law compacts entrenching rights across borders. What emerges is a picture of the complex interplay of constitutional law, international law, criminal law and the law of war, creating webs of norms and regulations that apply in the struggle against terrorism conducted across increasingly porous borders. The book will be of particular interest to academics and graduate or post-graduate students working in the fields of constitutional law, international law, human rights, comparative law and national security law. It may also be of interest to practitioners concerned with national security, counterterrorism, and related questions of individual rights.Contributors: O. Bassok, D. Cole, K. Cooper, J. Daskal, E. de Wet, B. Dickson, A. Ejima, S. Ellmann, F. Fabbrini, L. Garlicki, J. Hafetz, V.J. Jackson, C.C. Murphy, M. Scheinin, K.L. Scheppele, A. Su, C. WalkerTrade ReviewJust as current terrorism threats permeate state borders, legal responses to them should as well. Bringing together and making a significant contribution to comparative constitutionalism, international law, and the anti-terrorism law, this book perfectly exemplifies the benefits of transmitting legal concepts and ideas across geographical and conceptual borders - between differing national systems, as well as in manners that open international law and constitutional law to one another. It is a wonderful source for studying and understanding anti-terrorism law, and at the same time an inspiration to those thinking about the tension between globalized and contextualized law. --Daphne Barak-Erez, Justice of the Supreme Court of IsraelSince September 2001, international terrorism has been the major challenge to the traditional understanding of modern constitutionalism, based on state territorial institutions. The outstanding contributions collected by Fabbrini and Jackson address this challenge under many respects and in many different fields; yet, they all confront a common concern: how to accommodate the basic constitutional guarantees such as human rights, rule of law and due process to actions that overcome territorial borders? In the twenty-first century, security implies control over people, finance and data that move quickly across the borders. Antiterrorism legislation requires a multi-directional cooperation of actors at the transnational level, including regional and international organizations. The book explores this multifaceted branch of law and offers a rich plurality of reading of the major legal responses to one of the most relevant social, political and legal difficulties of our time. --Marta Cartabia, Vice President of the Constitutional Court, ItalyNo one nation is equipped to combat terrorism. The problem transcends borders and the traditional demarcation of the state. This presents a challenge to constitutional norms and national legal structures. This book represents an insightful and engaging response. It contains a stellar cast of authors who dissect and analyze these issues in a series of illuminating contributions. --George Williams, Scientia Professor, University of New South Wales, AustraliaTable of ContentsContents: 1. Book SynopsisWhen Minh Pham was extradited from Britain to the US to face terrorism related charges, his appeal against the deprivation of his British citizenship was still pending. Soon after he arrived his appeal was lost and he was effectively made stateless. Pham's story is one of the many in Deport, Deprive, Extradite, illustrating the perpetual enhancement of state power and its capabilities to expel. In looking at these stories of Muslim men accused of terrorism-related offences, Nisha Kapoor exposes how these racialised subjects are dehumanized, made non-human, both in terms of how they are represented and via the disciplinary techniques used to expel them. She explores how the establishment of these non-humans enables the expansion of inhumanity more broadly, targeting Muslims, people of colour, immigrants and refugees. In asking what such cases illuminate and legitimate about precariousness and dispossession, she offers a radical analysis of the contemporary security state.Trade ReviewA monumental study of how the 'War on Terror' has allowed states to operate outside the boundaries of reason and decency. This is courageous research, a book that should be read by all citizens of 21st century states that claim to be fighting extremism but have themselves become extremist states. -- Vijay Prashad, Executive Director, Tricontinental: Institute for Social Research, and author, The Poorer Nations: A Possible History of the Global SouthGripping, frightening, urgent - Nisha Kapoor's book is essential reading for anyone trying to understand the shifting terrain of securitisation, racialisation and the rolling back of human rights. It should be required reading for every student, teacher and advocate concerned to challenge state racism. For those inclined to trust the government, this book reveals the hidden and not so hidden injustices carried out in y/our name. For those who find themselves in the sights of a securitising state, this book lets you know that you are not alone. For anyone who doubts that the treatment of those suspected of terrorism reveals a shift in state practices that can seep out into other realms, this book offers a careful but devastating warning. We understand, what can be done to them can be done to us. After this book, none of us can pretend again that we did not know. -- Gargi Bhattacharyya, author of Dangerous Brown Men

Book SynopsisThis illuminating book offers a timely assessment of the development and proliferation of precursor crimes of terrorism, exploring the functions and implications of these expanding offences in different jurisdictions. In response to new modes and sources of terrorism, attempts to pre-empt potential attacks through precursor offences have emerged. This book examines not only the meanings and effectiveness of this approach, but also the challenges posed to human rights and social and economic development.Featuring contributions from leading academic and practitioner experts in counter-terrorism law, the book covers the broad scope of activities tackled by these new legal interventions, including membership, collaboration, communications, training and financing. Taking a comparative approach that relies on extensive experience in various jurisdictions, including the UK and Spain, the chapters also discuss important related issues such as international cooperation, investigations and penology, offering insights into the context of policies and practices.Scholars and advanced students of criminal and human rights law with an interest in terrorism and terrorism offences will find this book essential reading. It will also benefit legal practitioners and policy makers in fields such as international criminal law cooperation and counter-terrorism.Trade Review‘This impressive collection of chapters, from internationally respected academics and practitioners with expertise on terrorism and criminal law, tackles an important recent phenomenon. As ever more States seek to counter the threat of terrorism in innovative ways, specialised criminal offences proliferate and expand to reach those who fund, plan, encourage, prepare, or glorify terrorism in the physical and online worlds. The perceived threat posed by terrorism permits legislatures to criminalise more widely and punitively. The need for adequate scrutiny and safeguards is obvious as these offences challenge orthodox definitions and structures of criminal laws and their jurisdictional reach as well as traditional trial processes. The book provides an insightful exploration of the theoretical, social and practical dimensions to pre-cursor offences and offenders, drawing particularly on European experience. It will serve as a valuable resource for scholars and policy makers examining the many challenges that such legislation brings.’ -- David Ormerod CBE, QC, University College London, UK'This work explores and updates the study on the limits of criminal intervention against terrorism. It masterfully combines the study of the fundamentals with a common thread in the "advancement" of the punitive barrier to crimes of expression or crimes of belonging to organisations, without neglecting procedural aspects, cooperation or prison execution. And all of this with a comparative law approach that makes this work a genuinely European contribution to a more contained, legitimate and, at the same time, effective anti-terrorist strategy.' -- Jon-Mirena Landa, Director, UNESCO Chair for Human Rights, University of the Basque Country, SpainTable of ContentsContents: PART I INTRODUCTION 1 Introduction to Precursor Crimes of Terrorism 2 Mariona Llobet Anglí, Manuel Cancio Meliá, and Clive Walker 2 Counter terrorism through precursor crimes 20 Clive Walker PART II CRIMINALISATION OF ANTICIPATORY RISK OF TERRORISM ATTACKS 3 Law as reason vs law as will in the fight against terrorism: from a Hobbesian conception of law to an Orwellian society 44 Aniceto Masferrer and Pedro Talavera 4 The criminalisation of terrorism risk within the European Union: a suitable choice? 56 Francesca Galli 5 Voluntary abandonment related to the crime of membership of a terrorist group 72 Mertxe Landera Luri 6 Precursor crimes in Australia’s anti-terrorism legislation 83 Christopher Michaelsen PART III PRECURSOR COMMUNICATION CRIMES IN RELATION TO TERRORISM 7 The legitimacy of offences criminalising incitement to terrorist acts: a European perspective 99 Anneke Petzsche 8 Twitter after Charlie Hebdo and the Paris Bataclan attacks: identifying and measuring the different types of violent speech on the internet 113 Fernando Miró-Llinares 9 Spanish writing on the wall? Edward Elgar Publishing Ltd The Nexus Between Organized Crime and Terrorism:

    15 in stock

Book SynopsisIn the post-9/11 era, the nexus between organized crime and terrorism has raised much concern and has been widely discussed in both academic and policy circles, but is still largely misunderstood. This critical book contributes innovatively to the debate by distinguishing three types of nexus—interaction, transformation/imitation and similarities—and identifying the promoting factors of each type. With its multifaceted but complementary chapters, the book provides conceptual and theoretical frameworks for readers, as well as the evidence needed to develop more realistic, effective and humane policies to tackle organized crime, terrorism and the nexuses between them. Bringing together a range of international multidisciplinary specialists, it includes three comparative analyses of worldwide transfers of personnel, weapons and money between organized crime and terrorism and 12 case studies examining local manifestations of the nexus in Africa, Asia, Europe and the Americas. Two other chapters further review the national, European and international policies adopted and implemented so far to deal with the different nexuses. This book will be a valuable resource for researchers and policymakers in the fields of comparative law, criminal law and justice and public policy, who specialize in the analysis and control of organized crime and terrorism. It will also appeal to senior law enforcement officials and practitioners due to the counterintuitive policy implications drawn from the comparative analysis of the findings.Trade Review‘This book is a milestone on the road towards a better understanding of the linkages in the underworlds of crime and terror.’ -- Alex P Schmid, Perspectives on Terrorism‘Terrorism is a very 21st century global threat. Organized crime has a distinctly 20th century feel to it yet is often related in the public mind with terrorism. This book explores the variable connections of the two. Book SynopsisThis insightful book provides a unified repository of information on jihadist terrorism. Offering an integrated treatment of terrorist groups, zones of armed conflict and counter-terrorism responses from liberal democratic states, it presents fresh empirical perspectives on the origins and progression of conflict, and contemporary global measures to combat terrorist activity. Bringing together a multi-disciplinary team of scholars and professionals, the book examines the growth and activities of four key terrorist organizations: Al Qaeda, Islamic State, Hamas and Lashkar-e-Taiba. It discusses their theologies, motivations and the threat that they pose to liberal democracies through terrorist attacks. Chapters contain perspectives and case studies on zones of armed conflict in which terrorist organizations are being fought directly in Afghanistan, Iraq, Syria and Israel/Palestine, evaluating the historic roots of these conflicts and their evolution over time. It also examines national efforts in the US, the UK, France, India and Israel in combating terrorism, considering the preventative measures and activities of intelligence and security agencies through personal interviews conducted with service and retired professionals. Based on crucial empirical investigations conducted by intelligence professionals, scholars, research specialists and journalists, this is critical reading for researchers and advanced students in terrorism studies, international studies and conflict resolution, as well as those studying political science more broadly. It will also benefit policymakers and intelligence and law enforcement specialists in need of a comparative study of contemporary counter-terrorism responses.Table of ContentsContents: Foreword xi Acknowledgement xiii 1 Introduction to Global Jihadist Terrorism 1 Paul Burke, Doaa’ Elnakhala and Seumas Miller PART I TERRORIST GROUPS 2 Al-Qaeda 10 Paul Burke 3 The so-called Islamic State 36 Michael Robillard 4 Hamas 58 Doaa’ Elnakhala 5 Lashkar-e-Taiba 84 Anthony Davis PART II ZONES OF ARMED CONFLICT 6 Afghanistan 107 Anthony Davis 7 Iraq 133 Paul Burke 8 Syria 167 Michael Robillard 9 Palestine‒Israel 188 Doaa’ Elnakhala PART III NATIONAL COUNTER-TERRORISM RESPONSES 10 National counter-terrorism responses: United States of America 212 Michael Robillard 11 National counter-terrorism responses: United Kingdom 233 Paul Burke 12 National counter-terrorism responses: France 253 Doaa’ Elnakhala 13 National counter-terrorism responses: Israel 277 Doaa’ Elnakhala 14 National counter-terrorism responses: India 299 Anthony Davis Index 321

Book SynopsisMaking a timely contribution to the legal literature, this important book discusses an under-analysed issue of great importance to international peace and security. It provides a comprehensive overview and analysis of the prevention of nuclear terrorism specifically through an international (arms control) law lens.Jonathan Herbach sets out a basis for better understanding how the international legal framework for nuclear security is structured and why it is structured that way, and offers a critical analysis of the component instruments that make up the framework. He highlights the strengths and analyzes possible gaps and weaknesses of these instruments and the legal framework as a whole, as well as explaining the framework’s key characteristics, approaches and rationale. As nuclear security is by no means a static topic, with changing circumstances a defining feature of the area, the book also offers ideas for the path forward and conceptualizes ways to further strengthen the nuclear security legal framework.Offering a fresh perspective on the prevention of nuclear terrorism, this book will benefit academics and students of public international law, counter-terrorism and conflict and security law. It will also be a useful resource for governmental legal advisors, think-tanks and diplomats to inform their work on means and mechanisms to help strengthen the global nuclear security regime and to provide guidance for decision-making.Trade Review‘With the prospect of a possible tactical nuclear attack by Russia if it loses in the Ukraine war a real possibility, the subject of nuclear terrorism is once again at the top of governments’ national security concerns, especially if Russia were to utilise a terrorist group proxy to carry out such an attack. This important book provides a comprehensive examination of how nuclear terrorism can be prevented through various measures, including an international arms control regime (ACR). The author explains how an ACR is structured, its key characteristics, its strengths, weaknesses, and gaps, and future directions for strengthening it.’ -- Joshua Sinai, Perspectives on Terrorism Journal‘Jonathan Herbach has written a masterly account of the place of nuclear security, particularly prevention of nuclear terrorism, in the broader context of nuclear arms control. While focused on international law aspects, this book is invaluable reading for policymakers, diplomats, officials and others interested in nuclear security. Book SynopsisCounterterrorism and Investigative Detention explores the practice of investigative detention of terrorist suspects in the legal systems of the United States, the United Kingdom, and France. In addition to illuminating the characteristics, capabilities, and limitations of various investigative detention regimes, this book examines ways in which international law and national security imperatives have served as vectors for change and convergence in these otherwise divergent legal systems. The chapters include an examination of the way in which each country has experienced and confronted terrorism; an overview of each country's legal system; a detailed analysis of each country's counterterrorism laws; and a discussion of the ways in which international law has impacted their respective counterterrorism approaches. This book, therefore, is situated at the nexus of comparative law, international law, and national security, providing scholars and policymakers with insight into how different countries with contrasting legal traditions address a common national security threat. This compelling discussion of how different legal systems use their detention laws to address the threat of terrorism will be of interest to comparative lawyers, international lawyers, and national security professionals.Trade Review‘Dan Stigall provides a compelling explanation that the inevitable tension between security requirements and civil liberty imperatives never allows for clean-cut solutions, and instead Americans must insist on processes that allow both requirements to peacefully vie with each other, and accept the reality that the best outcomes result from compromise.’ -- Lieutenant General (retired) Michael K. • The Regulation of Intelligence Activities under

Edward Elgar Publishing Ltd The Regulation of Intelligence Activities under

    15 in stock

Book SynopsisPresenting a thorough examination of intelligence activities in international law, Sophie Duroy provides theoretical and empirical justifications to support the cutting-edge claim that states’ compliance with international law in intelligence matters serves their national security interests. This book theorises the regulation of intelligence activities under international law, identifying three layers of regulation: a clear legal framework governing intelligence activities (legality); a capacity to enforce state responsibility (accountability); and the integration of legality and accountability into responsive regulation by the international legal order (compliance). The empirical relevance of these three layers of regulation is demonstrated through in-depth case studies of state responsibility in the CIA-led war on terror and an analysis of the accountability of Djibouti, the Gambia, Poland, the United Kingdom, and the United States for conduct in the CIA-led war on terror. Overall, the author shows that the most reliable path to long-term national security is the effective regulation of intelligence activities under international law. Making an original contribution to existing theories of compliance and regulation, as well as the law of state responsibility and its enforcement, this book will be essential for students and scholars of public international law, human rights, intelligence and security studies, and international relations. It will also be a valuable resource for practitioners of international law with an interest in intelligence, state responsibility, and terrorism and security law.Trade Review‘This exceptionally rich book deals with important and topical issues of international law and human rights, namely the international law governing intelligence agencies and their oversight, as well as accountability for the phenomenon of secret detention and torture in the so-called war on terror. It manages to combine the treatment of these two themes into a single coherent line of research. But the study does much more than that. It is methodologically highly diverse and advanced, combining doctrinal legal analysis with behavioural approaches concerning state compliance and developing models of semi-quantification and network analysis to explain why and how accountability matters for whether states choose to comply with international law. On the basis of these different but intertwined lines of research, it then argues that compliance with international law serves the national security interests of states. The outcome is highly impressive, signalling the author’s emergence as a prominent scholar, an innovative and original thinker, and a theorist.’ -- Martin Scheinin, University of Oxford, UK‘International regulation of the second oldest profession was long characterised by hypocrisy: states denounced what they routinely (if clandestinely) did themselves. In this book, Sophie Duroy argues that the years after September 11, 2001, put enormous pressure on the nascent norms regulating intelligence activities — and, counter-intuitively, strengthened those norms as a result.’ -- Simon Chesterman, National University of Singapore‘Dr Duroy’s book provides a sophisticated analysis of the application of international law to the work of the intelligence community. But more than that, it explores how states can be held accountable for their unlawful intelligence activities. By focusing on issues of accountability and compliance, this book brings new research to the debate and should be widely read by security studies scholars, international lawyers, practitioners, and policymakers.’ -- Russell Buchan, University of Sheffield, UKTable of ContentsContents: 1. 2 in stock

Book SynopsisRecent thinking on globalization places risk at the centre of contemporary life. Yet what if our perception of risk is misplaced? What if the greatest risk is not terrorism itself but the conditions that allow terrorism to flourish? This fascinating book illustrates that elevated perceptions of terrorism-related risks are having a deleterious impact on many societies, exacerbating feelings of exclusion among individuals and groups. Via their exploration of various societies, the expert contributors show that as a causal factor of terrorism, social exclusion can be remedied by inclusive, participatory and deliberative measures. They argue that it would be beneficial to recalibrate counter-terrorism policies to unite rather than divide multi-ethnic, religiously diverse and multicultural societies, stressing the importance of understanding and addressing underlying causes of social tensions. They also assess how global and domestic forces have impacted on the prospects for longer term social cohesion in the countries under review, presenting studies from Western and non-Western societies such as Algeria, Australia, Russia and the United Kingdom, to demonstrate that the differences between these societies are not as stark as is often assumed. This path-breaking book questions the validity of attacks on multiculturalism. As such, it will appeal to a wide-ranging audience including academics, students and researchers in the fields of counter-terrorism, peace-building, and the sociology of religion. It will also provide valuable insights to policy-makers in the areas of immigration, security and community building.Contributors: W. Aly, V. Andre, Y. Bouandel, G.D. Bouma, S. Carland, A. Edward Elgar Publishing Ltd Terrorism, Organised Crime and Corruption:

Book SynopsisLeslie Holmes and a team of specialists from three continents analyse terrorism, organised crime and corruption both individually and in terms of the connections between them. It is argued that if we are better to understand these three phenomena, their links not only to each other but also to corporate crime need to be analysed. There has been a marked growth in the awareness of corruption, organised crime and terrorism in recent years, especially since the end of the Cold War. Yet the linkages and resonances between these three forms of anti-social and anti-state behaviour are still not sufficiently recognised. Leslie Holmes and his fellow contributors analyse all three phenomena in concert to explain why it has taken so long for states, international organisations and the public to begin to appreciate the interplay between them. It is demonstrated that, while the recent growing awareness of connections between these three types of crime is welcome, there is also a fourth player that must sometimes be considered; transnational corporations. Although the book focuses mainly on Europe, Australia and the US, much of the analysis and theorising has global relevance. This timely book will appeal to advanced undergraduates and postgraduates in political science, international relations, international political economy, security studies and criminology.Trade Review'This book is multidisciplinary, as it contains contributions from criminology, politics and international relations scholars. It includes a wide variety of fascinating papers with a dominant focus on the conceptual broadening of security. This is a noteworthy research agenda which, hopefully, will be followed by many more scholars. . . a very stimulating book which will attract the interest of a large audience in different disciplines. It deals with a variety of cases around the globe and contributes to a range of intellectual debates across several disciplines. Consequently, it should be read by many scholars.' -- Christian Kaunert, Political Studies Review'I congratulate Leslie Holmes and the other contributors to this book. The chapters bring fresh insights and richly theorized findings. Together the authors contribute to an essential moving away from the stereotypical good-guy/bad-guy portrayal of serious criminals. This book is about collusion. Politics, corporate conspiracies, national security and military empires, opportunity, vast illicit resources, ambiguous or impossible "rules" and the complicity of the public all result in the growth of organized crime, corruption, and terrorism. As the title suggests, it is the linkages among these three types of crimes and the linkages between criminals and "legitimate" citizens that must be dissected for better-informed policy-making and potentially greater security.' -- Margaret Beare, Nathanson Centre on Transnational Human Rights, Crime and Security, Osgoode Hall Law School, Toronto, Canada'In making connections between the three types of crime - terrorism, organized crime and corruption - this wide-ranging collection of essays is path breaking. Each chapter contains new insights and new information; as a whole, the collection is masterfully brought together by the editor, Leslie Holmes, who, always careful not to claim too much for the linkages between the three categories of crimes, makes a persuasive concluding argument for corporate crime to be added to the three forms of criminality. This collection brings the darker side of politics out of the shadows and into the foreground and highlights the importance in the fight against terrorism and organized crime of the state being able to trust its own officers.' -- Rosemary H.T. O'Kane, University of Keele, UK'Leslie Holmes' edited book is a fascinating and wide-ranging collection on the interface between terrorism, organised crime, corruption, legitimate businesses, and local communities. The cases range from Australia, to Russia, to the Netherlands and focus on the complex links between the economic motives of corrupt officials and organized criminals, on the one hand, and terrorists, on the other. The result is a sobering look at a growing problem and a plea for more research into linkages often left unexplored by narrow specialists. It should set the agenda for future research that crosses disciplinary boundaries and tackles the difficult empirical challenges.' -- Susan Rose-Ackerman, Yale University, USTable of ContentsContents: Preface 1. Book SynopsisIn this clear and observant book, Kenneth Button provides an overview of the economics and political economy of transport security, considering its policy from an economic perspective. His analysis applies micro-economic theory to transport issues, supporting and enhancing the larger framework of our knowledge about personal, industrial, and national security.Button's focus on the economic aspects of transportation security strives to move beyond established technical and legal approaches, working within both the narrower microeconomics of individual and corporate efficiency and the larger trends in economic policy-making. By fitting current security trends into economic analysis, he discusses not only contemporary developments, but also their economic implications and approaches for assessing alternative strategies. This examination of applied economics is a must-read for those looking to gain a broader view of transport security issues. Book SynopsisMoney Laundering and Terrorist Financing Act 2010: Annotated is a detailed and expert annotation of the Criminal Justice (Money Laundering and Terrorist Financing) Act 2010. The Act implements the Third Money Laundering Directive in Ireland. It replaces the Criminal Justice Act 1994 as the legislative centrepiece of Ireland's anti-money laundering and anti-terrorist financing regime. This annotated version of the new Act considers the: * Risk-based customer due diligence (or "CDD") requirements that the Act introduces * New provisions concerning politically exposed persons. * Reporting requirements arising under the Act. * Offence of "tipping off". * Provisions for the monitoring of designated persons by competent authorities. * Authorisation of trust or company service providers. * Approval of guidelines by the Minister for Justice and Law Reform. * Registration of persons directing private members' clubs at which gambling activities are carried on. * "Whistle-blowing" or "good faith reporting" provision made in the Act. This book also seeks to set the Act in its historical and wider legal context, making reference to international and European measures, most particularly the Third Money Laundering Directive, where appropriate. In addition the text identifies and briefly considers all the secondary legislation that has, at the time of writing, been made pursuant to the Act.
