Book SynopsisA collection of curious tales questioning the ownership of airspace and a reconstruction of a truly novel moment in the history of American law, Banner's book reminds us of the powerful and reciprocal relationship between technological innovation and the law.Trade ReviewBanner claims that with this work he has written an intellectual history of American aviation law in the first half of the 20th century. And he has done exactly that--very well...This book is not only a great repository of the history of the question it poses, but is also a great yarn. Banner's friendly writing style gets one through the stickier details, and one simply feels better--not just better informed--for having read the book. -- James T. Crouse * Times Higher Education *At the heart of this clever, intricate, elegant book is the improbable fact that, for over fifty years, an arcane statute devised by medieval European scholars managed, in the twentieth century, to impede the growth of aviation in the very nation that invented it. -- Alexander Frater * Times Literary Supplement *[An] engaging book...Historically, British and then US common law declared that property in one's land extended from the center of the earth to the heavens. Yet ownership of the sky was all but impossible until the inventions of the 19th and 20th centuries made it accessible. At the very moment that ownership was possible, laws recognizing that property right were challenged. Banner narrates a terrific story, discussing how technology, first with the balloon and then other air travel, challenged the law and eventually changed it. The book weaves together the Wright brothers, legal scholarship, the emergence of the airline industry, and eventually the Supreme Court, offering fascinating details about the law on airspace. These changes climax first in a landmark decision by the Supreme Court clarifying airspace property rights, and then the 1967 Outer Space Treaty declaring the universe a common heritage beyond ownership...This is a fun, well-written, and informative book. -- D. 2 in stock

Book SynopsisA substantial proportion of all domestic aviation accidents and fatalities that occur each year involve general aviation (GA), which includes all aviation except commercial and military. Under federal law, the Secretary of Transportation is responsible for ensuring that commercial air carriers carry liability insurance. However, no such federal requirements exist for GA aircraft owners. In some cases, accidents involving uninsured or underinsured GA aircraft owners have occurred where individuals (passengers or third parties) who incurred losses received little or no compensation. This book examines existing liability insurance requirements for GA aircraft owners; premiums for GA liability insurance; and factors that selected stakeholders cited which should be considered in determining whether to adopt a federal liability insurance requirement. Furthermore, this book discusses the characteristics of and trends in general aviation accidents from 1999 through 2011; and recent actions taken by the Federal Aviation Administration (FAA) to improve general aviation safety.

Book SynopsisOperational Procedures is one of the first Theoretical Knowledge (TK) subjects to be tackled on almost any pilot''s licence course.Nevertheless, many student pilots approach ''Ops Proc'' with a heavy heart, not helped by the original syllabus for the subject which was confused and lacked practical knowledge. This shortcoming was addressed in the new 2015 EASA pilot training syllabi, designed to bring pilot training into line with the modern flying environment. To make the best of this new approach to teaching aviation Theoretical Knowledge requires new training material for the student pilot, and Aeronautical Knowledge - Operational Procedures is part of a brand-new series of training manuals, designed from the beginning to take full advantage of this new methodology in aviation training. Rather than merely making revisions to an existing publication, AFE has produced a totally new training manual for Operational Procedures, covering new topics such as Threat and Error Management (TEM), EASA ''Part-NCO'' regulations, Portable Electronic Devices (PED) and incident reporting.Written by the best-selling aviation author of over 25 pilot training manuals, Aeronautical Knowledge - Operational Procedures finally brings this important aviation subject fully up-to-date.

Offering a forward-thinking perspective, chapters also bring to light key scholarly debates concerning the potential revisions to the MC99 and highlight the likely need for reform.Key Features: Provides a contextual and comparative approach The most thorough contemporary treatment of the MC99 Examines the contemporary judicial trends in interpreting the MC99 Written by 36 leading aviation lawyers and eminent academics from across the globe Detailed article-by-article analysis of the MC99, surveying its meaning and application Contributing to a deeper understanding of the MC99 and its practical implications, this authoritative Commentary is a fundamental resource for aviation lawyers in private practice and in-house, as well as industry professionals. It will also be a reference source for scholars of aviation and transport law.Trade Review‘The successful development and ratification of the Montreal Convention 1999 was historic because all previous attempts to modernize and consolidate the Warsaw Convention of 1929 for the Unification of certain rules relating to international carriage by air had led to less unification and more dissatisfaction.Professor Leloudas, Professor Dempsey and Attorney Chassot, as well as the impressive selection of foremost international experts in aviation law, must therefore be commended for their most comprehensive Article-by-Article analysis of the Montreal Convention 1999 in this essential tool for all aviation lawyers worldwide, be they in private practice, in public service or in-house, and indeed for all those interested in aviation!’‘Governing the disposition of liability claims arising in international aviation just about everywhere, the Montreal Convention 1999, like the Warsaw Convention that preceded it, is one of the world’s most important private international law treaties. George Leloudas and his expert cadre of co-editors and writers have produced an immensely useful and highly practical guide to the MC99 regime. Its clear and accessible discussions of the treaty’s articles are hugely enhanced by the inclusion of drafting history, notes on commercial context, and issues of interpretation, all copiously documented. The book is destined to become a standard reference on the treaty and a must-have for law libraries everywhere. While it will serve as an excellent primer for lawyers and others new to aviation liability cases, even seasoned practitioners will find great value in this impressively researched volume.’ -- Jeffrey N. Shane, former General Counsel, International Air Transport Association‘This is a very timely publication reviewing the Montreal Convention, a quarter of a century after its adoption. An erudite and detailed analysis of the Convention itself and its interpretation, which is an invaluable resource for aviation (re)insurance underwriters and claims adjusters to use in informing their current assessment of exposures to passenger liability and baggage claims around the world. Many congratulations to Professors Leloudas and Dempsey and Dr Chassot for bringing together so many expert practitioners in the various aviation specialties and jurisdictions in order to provide such a comprehensive tome!’ -- Marko Ninkovic, Head of Claims – Specialty, Brit, UK‘Thank you to Professors Leloudas, Dempsey and Attorney Chassot, as well as the impressive cohort of international contributors from the foremost experts in aviation law, for this very comprehensive Article-by-Article analysis of the Montreal Convention 1999.
