Oxford University Press International Law and the Use of Force
Book SynopsisThis book explores the large and controversial subject of the use of force in international law. It examines not only the use of force by states but also the role of the UN in peacekeeping and enforcement action, and the increasing role of regional organizations in the maintenance of international peace and security. The UN Charter framework is under challenge. Russia''s invasion of Georgia and intervention in Ukraine, the USA''s military operations in Syria, and Saudi Arabia''s campaign to restore the government of Yemen by force all raise questions about the law on intervention. The ''war on terror'' that began after the 9/11 terrorist attacks on the USA has not been won. It has spread far beyond Afghanistan: it has led to targeted killings in Pakistan, Somalia, and Yemen, and to intervention against ISIS in Iraq and Syria. Is there an expanding right of self-defence against non-state actors? Is the use of force effective? The development of nuclear weapons by North Korea has reigniteTrade ReviewReview from previous edition The detailed arguments and broad conclusions draw[n] stand fair and square. * Royal United Services Institute Journal *... the book's appearance at this critical moment for the law regulating the use of force is most welcome, especially for students ... a helpful reference. * Mary Ellen O'Connell, The American Journal of International Law *Comprehensive, easy to read, up-to-date, and informed. * Ilias Bantekas *This book provides students of international law and international relations with a highly accessible, thoroughly expert analysis of the rules governing when states may resort to military force. Taylor & Francis Ltd Personal Identity and the European Court of Human
Book SynopsisIn this new and burgeoning field in legal and human rights thought, this edited collection explores, by reference to applied philosophy and case law, how the European Court of Human Rights (ECtHR) has developed and presented a right to personal identity, largely through interpretation of Article 8 of the European Convention on Human Rights. Divided into three parts, the collection interrogates: firstly, the construction of personal identity rights at the ECtHR; secondly, whose identity rights are protected; and thirdly, the limits of identity rights. The collection is the first in the Routledge Studies in Law and Humanity series. Contributions from nine leading and emerging legal scholars from the UK, Ireland and continental Europe explore how the right has developed, rights to identity and marriage, LGBTI+, persons with disabilities, religious and cultural issues and critical perspectives on the social construction and framing of the right. Johns Hopkins University Press Felix Frankfurter
Book SynopsisOriginally published in 1960. Felix Frankfurter, a controversial figure in American judicial history, completed more than twenty-one years of service on the Supreme Court. This book is the first extended treatment of his political performance as a justice. It portrays the influence that he, both as teacher and jurist, exerted in the growth of public law over fifty years. He has exerted his influence not only through his writing but also through his personal acquaintance with many important persons in and out of government service. Beyond examining the career of one man, Thomas opens up a wider window on the history of legal thought. The main value of the book, though, lies in its presentation of the philosophy of one leading twentieth-century educator and jurist.Table of ContentsPrefacePart I: From Ivory Tower to Marble HallsChapter 1. Anthem Press Religion in Schools: Learning Lessons from Wales
Book SynopsisTo what extent should religion be taught in classrooms? Should lessons also cover non-religious beliefs? Should the teaching of religion be compulsory or should it be a matter of choice by the parents or the child? Should faith schools be allowed to teach their religious beliefs? Should religious worship be compulsory for all pupils? Questions of how religion operates within schools prove controversial and divisive. This book explores radical changes that are being made in Wales and the lessons that can be learnt. It examines the historical development of the law in this area, the new Welsh law, its potential shortcomings and areas that the new law leaves untouched, namely the rules on religious worship. The book is written by a leading authority on the interaction of law and religion whose work fed into Welsh parliament debates on the Curriculum and Assessment (Wales) Act 2021.Trade Review‘Russell Sandberg has provided a crisp, clean, concise, and cogent expert’s guide to the impressive new experiment in religion and education afoot in Wales. Not only Welsh and UK readers, but anyone interested in the vexed questions of the roles and rights of religion in the classroom and curriculum need to read this learned text.’ – John Witte, Jr., Director, Center for the Study of Law and Religion, Emory University, USA.‘This short and very well-written book probes big issues: among them the implications of devolution for educational reform and - in more detail - the recent changes in the teaching of religion in the Welsh school system. I recommend it warmly.’ – Grace Davie, Emeritus Professor of Sociology, University of Exeter, UK.‘In the aftermath of 9/11, the need for appropriate religious education has become a priority around the world. By analyzing the new Welsh system, this book addresses issues that are debated in many countries and outlines a model that can be replicated throughout Europe.’ – Silvio Ferrari, Emeritus Professor of Canon Law, University of Milan, Italy.‘This book aims to illuminate an area where there has often been more heat than light, and examines the new law with insight and nuance. It is a valuable contribution to current scholarship.’ – Helen Hall, Senior Lecturer and Associate Director of the Centre for Rights and Justice, Nottingham Trent University, UK.‘This engaging book charts how the teaching of religion is being transformed in Welsh schools and explores how other nations might learn from these changes. Essential reading for anyone interested in religion, law, and education.’ – Anna Strhan, Senior Lecturer in Sociology at the University of York, UK.'Religion in Schools: Learning Lessons from Wales' is the leading text on the law of religion in Welsh Schools. Sandberg’s work is succinct and informative, giving the reader a clear understanding of both the current law in Wales and the historical development up until this point alongside the many challenges the new Welsh provisions pose. ... This text may be of interest to public lawyers more broadly.'Sandberg’s work is succinct and informative, giving the reader a clear understanding of both the current law in Wales and the historical development up until this point alongside the many challenges the new Welsh provisions pose. The book is divided into two sections: religious education and worship under English law; and the new Welsh law on Religion, Values, and Ethics.

Springer Nature Switzerland AG Welfare Economics and Second-Best Theory: A
Book SynopsisThis book examines the implications of The General Theory of Second Best for analyzing the economic efficiency of non-government conduct or government policies in an economically efficient way. It develops and legitimates an economically efficient economic-efficiency-analysis protocol with three unique characteristics: First, the protocol focuses separately on each of a wide variety of categories of economic inefficiency, many of which conventional analyses ignore. Second, it analyzes the impact of conduct or policies on each of these categories of economic inefficiency, primarily by predicting the respective conduct’s/policy’s impact on the distortion that the economy’s various Pareto imperfections generate in the profits yielded by the resource allocations associated with the individual categories of economic inefficiency—i.e., on the difference between their profitability and economic efficiency. And third, it is third-best—i.e., it instructs the analyst to execute a theoretical or empirical research project if and only if the economic-efficiency gains the project is expected to generate by increasing the accuracy of economic-efficiency conclusions exceed the predicted allocative cost of its execution and public financing. The book also uses the protocol to analyze the economic efficiency of specific policies so as to illustrate both how it differs from the protocols that most applied welfare economists continue to use and how its conclusions differ from those produced by standard analysis.Table of ContentsIntroduction to The General Theory of Second Best, Its Central Implications, and the Appropriate Way to Respond to It.- The Economics Profession’s Responses to The General Theory of Second Best: Descriptions and Critiques.- The Concept of “the Impact of a Choice (or Natural Event) on Economic Efficiency”.- “First-Best,” “Second-Best,” and “Third-Best” Definitions, Elaborations, and Other Economists’ Usages.- The Symbols for Various Pareto Imperfections, Private and Allocative Concepts, Categories of Resource-Uses, and Categories of Resource Allocations.- The Vocabulary and Symbols of Distortion Analysis.- Analyses of Various Step-Wise Monopoly Distortions.- The Various Non-Monopoly Step-Wise Private-Benefit, Private-Cost, and Profit Distortions.- Some Negative and Positive Implications of the TBLE Distortion-Analysis Protocol for Economic-Efficiency Prediction/Post-Diction.- The Approach That Would Be TBLE for a Government to Take to Economic-Efficiency Prediction/Post-diction—the Rest of the Story.- Conclusion.

De Gruyter Handbook of Energy Law in the Low-Carbon
Book SynopsisThe low-carbon transition is ongoing everywhere. This Handbook, written by a group of senior and junior scholars from six continents and nineteen countries, explores the legal pathways of decarbonisation in the energy sector. What emerges is a composite picture. There are many roadblocks, but also a lot of legal innovation. The volume distils the legal knowledge which should help move forward the transition. Questions addressed include the differences between the decarbonization strategies of developed and developing countries, the pace of the transition, the management of multi-level governance systems, the pros and cons of different policy instruments, the planning of low-carbon infrastructures, the roles and meanings of energy justice. The Handbook can be drawn upon by legal scholars to compare decarbonisation pathways in several jurisdictions. Non-legal scholars can find information to be included in transition theories and decarbonization scenarios. Policymakers can discover contextual factors that should be taken into account when deciding how to support the transition.
