Taylor & Francis Ltd Personal Identity and the European Court of Human
Book SynopsisIn this new and burgeoning field in legal and human rights thought, this edited collection explores, by reference to applied philosophy and case law, how the European Court of Human Rights (ECtHR) has developed and presented a right to personal identity, largely through interpretation of Article 8 of the European Convention on Human Rights. Divided into three parts, the collection interrogates: firstly, the construction of personal identity rights at the ECtHR; secondly, whose identity rights are protected; and thirdly, the limits of identity rights. The collection is the first in the Routledge Studies in Law and Humanity series. Contributions from nine leading and emerging legal scholars from the UK, Ireland and continental Europe explore how the right has developed, rights to identity and marriage, LGBTI+, persons with disabilities, religious and cultural issues and critical perspectives on the social construction and framing of the right. Johns Hopkins University Press Felix Frankfurter
Book SynopsisOriginally published in 1960. Felix Frankfurter, a controversial figure in American judicial history, completed more than twenty-one years of service on the Supreme Court. This book is the first extended treatment of his political performance as a justice. It portrays the influence that he, both as teacher and jurist, exerted in the growth of public law over fifty years. He has exerted his influence not only through his writing but also through his personal acquaintance with many important persons in and out of government service. Beyond examining the career of one man, Thomas opens up a wider window on the history of legal thought. The main value of the book, though, lies in its presentation of the philosophy of one leading twentieth-century educator and jurist.Table of ContentsPrefacePart I: From Ivory Tower to Marble HallsChapter 1. Springer Nature Switzerland AG Welfare Economics and Second-Best Theory: A
Book SynopsisThis book examines the implications of The General Theory of Second Best for analyzing the economic efficiency of non-government conduct or government policies in an economically efficient way. It develops and legitimates an economically efficient economic-efficiency-analysis protocol with three unique characteristics: First, the protocol focuses separately on each of a wide variety of categories of economic inefficiency, many of which conventional analyses ignore. Second, it analyzes the impact of conduct or policies on each of these categories of economic inefficiency, primarily by predicting the respective conduct’s/policy’s impact on the distortion that the economy’s various Pareto imperfections generate in the profits yielded by the resource allocations associated with the individual categories of economic inefficiency—i.e., on the difference between their profitability and economic efficiency. And third, it is third-best—i.e., it instructs the analyst to execute a theoretical or empirical research project if and only if the economic-efficiency gains the project is expected to generate by increasing the accuracy of economic-efficiency conclusions exceed the predicted allocative cost of its execution and public financing. The book also uses the protocol to analyze the economic efficiency of specific policies so as to illustrate both how it differs from the protocols that most applied welfare economists continue to use and how its conclusions differ from those produced by standard analysis.Table of ContentsIntroduction to The General Theory of Second Best, Its Central Implications, and the Appropriate Way to Respond to It.- The Economics Profession’s Responses to The General Theory of Second Best: Descriptions and Critiques.- The Concept of “the Impact of a Choice (or Natural Event) on Economic Efficiency”.- “First-Best,” “Second-Best,” and “Third-Best” Definitions, Elaborations, and Other Economists’ Usages.- The Symbols for Various Pareto Imperfections, Private and Allocative Concepts, Categories of Resource-Uses, and Categories of Resource Allocations.- The Vocabulary and Symbols of Distortion Analysis.- Analyses of Various Step-Wise Monopoly Distortions.- The Various Non-Monopoly Step-Wise Private-Benefit, Private-Cost, and Profit Distortions.- Some Negative and Positive Implications of the TBLE Distortion-Analysis Protocol for Economic-Efficiency Prediction/Post-Diction.- The Approach That Would Be TBLE for a Government to Take to Economic-Efficiency Prediction/Post-diction—the Rest of the Story.- Conclusion.

Springer International Publishing AG The Rule of Law in Cyberspace
Book SynopsisThe rule of law in cyberspace currently faces serious challenges. From the democratic system to the exercise of fundamental rights, the Internet has raised a host of new issues for classic legal institutions. This book provides a valuable contribution to the fields of international, constitutional and administrative law scholarship as the three interact in cyberspace. The respective chapters cover topics such as the notion of digital states and digital sovereignty, jurisdiction over the Internet, e-government, and artificial intelligence. The authors are eminent scholars and international experts with a profound knowledge of these topics. Particular attention is paid to the areas of digital democracy, digital media and regulation of the digital world. The approach employed is based on a comparative perspective from Germany, the Netherlands, Italy, Portugal and Brazil. The roles of legislators, the judicial system and public administrations are analysed in the light of the latest cases, conflicts and technologies. In addition to this comparative approach, the book explores the evolution of rule of law in cyberspace and the upcoming new legal regimes in the European Union and Brazil. Special care is taken to offer a critical review of both the literature and the latest legal solutions adopted and being considered regarding the regulation of cyberspace from a constitutional and administrative perspective.Given its scope, the book will be of interest to researchers and scholars in the field of digital law whose work involves constitutional problems in cyberspace and/or practical problems concerning the regulation of social networks and online commerce.Table of Contents- Introduction. - Part I Democratic Constitutionalism in Cyberspace. - “Digital Democracy”: A Threat to the Democratic System or Oxygenation of Representative Democracy and Free Speech?. - Digital Constitutionalism and Constitutional Jurisdiction: A Research Agenda for the Brazilian Case. - The Crisis of the Representative Democracy in the Face of Digital Democracy. - Rule of Law, Democracy and New Technologies. - Freedom, Democracy, Digital Government and Human Development. - The Digitization of Government and Digital Exclusion: Setting the Scene. - The Impact of Artificial Intelligence on the Structures of the Modern Public Sphere. - Part II The Threat of Disinformation and the Role of Social Networks. - Fake News and the 2018 Brazilian Presidential Election. - Political Speech, Freedom of Expression and Fake News. - Disinformation and Journalism. - Social Networks and the Exercise of Fundamental Rights: Public Administration and the Digitalization of Fundamental Rights. - Freedom of Expression in the Age of Digital Platforms: Change of Paradigm?. - Online Hate Speech and the Role of Digital Platforms: What Are the Prospects for Freedom of Expression?. - Hate Speech and Social Media. - Don’t Shoot the Message: Regulating Disinformation Beyond Content. - Models of Legal Liability for Social Networks: Between Germany and Portugal. - Self-Regulation and Public Regulation of Social Networks in Portugal. - Cyber Courts for Social Media As a New Institutional Dimension of Media Freedom?.

De Gruyter Handbook of Energy Law in the Low-Carbon
Book SynopsisThe low-carbon transition is ongoing everywhere. This Handbook, written by a group of senior and junior scholars from six continents and nineteen countries, explores the legal pathways of decarbonisation in the energy sector. What emerges is a composite picture. There are many roadblocks, but also a lot of legal innovation. The volume distils the legal knowledge which should help move forward the transition. Questions addressed include the differences between the decarbonization strategies of developed and developing countries, the pace of the transition, the management of multi-level governance systems, the pros and cons of different policy instruments, the planning of low-carbon infrastructures, the roles and meanings of energy justice. The Handbook can be drawn upon by legal scholars to compare decarbonisation pathways in several jurisdictions. Non-legal scholars can find information to be included in transition theories and decarbonization scenarios. Policymakers can discover contextual factors that should be taken into account when deciding how to support the transition.
