Elle aimerait maintenir vivante l'amitié franco-américaine. À Washington, pourtant, on s'inquiète d'une collaboration qui soumettrait la France à l'Allemagne. Et, de plus en plus, au fil des mois, le rapprochement avec la Grande-Bretagne devient l'objectif principal du président Franklin Roosevelt. Le facteur idéologique dans le conflit Est-Ouest est désormais pleinement pris en compte : la France est vraiment entrée en Guerre froide. Mais le principal sujet, c'est la guerre de Corée. Le danger d'une extension du conflit est pris tout de suite très au sérieux. Paris choisit cependant la fermeté, ce qui n'empêche pas la prudence. Et on s'entend avec Londres dans ce sens, lors d'une rencontre le 2 décembre entre Pleven et Schuman et leurs homologues, Attlee et Bevin. En effet l'entrée en lice des Chinois en octobre et les réactions américaines inquiètent beaucoup Paris. Encore fin décembre, on veut garder l'option d'un retour des forces des deux camps sur le 38e parallèle, c'est-à-dire le rétablissement du statu quo ante. L'affaire coréenne a de grandes répercussions sur l'ensemble de la politique extérieure. D'abord le problème du réarmement allemand est posé tout de suite de façon urgente. Les Américains envisagent la formation de dix divisions allemandes. On s'inquiète devant l'entente manifeste de Washington, Bonn et Londres à ce sujet. Le 16 septembre, Jean Monnet adresse à Schuman son fameux mémorandum : il suggère un plan Schuman élargi reprenant l'esprit de la proposition de Communauté charbon - acier présentée le 9 mai précédent, mais déclinée pour encadrer le réarmement allemand dans un ensemble européen. Cependant le Quai n'apprécie guère la proposition de Jean Monnet et freine des quatre fers. La majorité des diplomates estiment que ce serait une rupture avec l'URSS et un obstacle à la politique d'intégration de l'Allemagne en Europe. Indiquons d'ailleurs qu'en ce qui concerne le Plan Schuman du 9 mai, le Quai ne s'en occupe vraiment que sur deux points : la question de la participation britannique et le problème de l'autorité de contrôle de la future Communauté charbon-acier. La guerre de Corée a aussi de considérables conséquences pour le problème indochinois, en particulier à cause de la menace chinoise croissante et de l'évolution de l'attitude américaine par rapport à ce conflit : Washington commence à s'intéresser à la défense de l'Indochine.

    Book SynopsisThis open access book examines the multiple intersections between national and international courts in the field of investment protection, and suggests possible modes for regulating future jurisdictional interactions between domestic courts and international tribunals. The current system of foreign investment protection consists of more than 3,000 international investment agreements (IIAs), most of which provide for investment arbitration as the forum for the resolution of disputes between foreign investors and host States. However, national courts also have jurisdiction over certain matters involving cross-border investments. International investment tribunals and national courts thus interact in a number of ways, which range from harmonious co-existence to reinforcing complementation, reciprocal supervision and, occasionally, competition and discord. The book maps this complex relationship between dispute settlement bodies in the current investment treaty context and assesses the potential role of domestic courts in future treaty frameworks that could emerge from the States’ current efforts to reform the system.The book concludes that, in certain areas of interaction between domestic courts and international investment tribunals, the “division of labor” between the two bodies is not always optimal, producing inefficiencies that burden the system as a whole. Although the results remain limited to the single issue of PTA-DSM adjudication for liberalization of trade in goods, they are indicative of key misconceptions regarding the fragmentation of ITL. As the findings confirm, the PTA-DSMs assessed have ultimately come to equivalent decisions, taking into consideration their overall use, the nature of the legal commitments embedded in the respective PTAs, and the economic wellbeing of the respective PTA partners. The book reveals the influence of specific PTA-DSMs on other PTA-DSMs and thereby paves the way for legal unification, rather than fragmentation.Table of Contents1.
