Hierzu hat Sebastian Sobotta die über 100 Gerichtsentscheidungen der Jahre 2004 bis 2020 zu solchen Schadensereignissen im Irak und in Afghanistan erstmals vollständig erfasst, systematisiert und ausgewertet. Dabei kommt er zu dem Ergebnis, dass die Entwicklung der Rechtsprechung faktisch zu einer "Immunität" privater Militärunternehmen geführt hat.
