Police forge partnerships with businesses, government agencies, and communities to co-produce public safety. Third-party policing (TPP) is a particular type of partnership that involves the police addressing crime and disorder by working through (and with) third-party partners. This Element focuses on the nature and effectiveness of TPP partnerships. Using systematic review and meta-analytic techniques, it shows that TPP interventions are effective in efforts to reduce crime and disorder, without displacement of these problems. Cooperative partnerships are associated with considerably larger crime control effects than interventions relying on coercive engagement styles. Dyad partnerships ? twosome partnerships between police and one third-party partner ? are likely to offer the ?sweet spot? in TPP. The Element concludes that partnership policing using non-criminal justice legal levers is a promising approach to crime control. This title is also available as Open Access on Cambridge Core.

Die Rechtsnatur des Geständnisses bestimmt Jens Andreas Sickor deshalb ausgehend von rechtshistorischen und rechtsvergleichenden Betrachtungen sowie unter Rückgriff auf die Prozessstruktur und das Beweisrecht der StPO.     Book SynopsisDie Freiheitsstrafe ist im Hinblick auf die Resozialisierung der Sanktionierten kontraproduktiv. Auch ihre Erforderlichkeit für die übrigen Zwecke des Strafrechts konnte bisher nicht belegt werden. Ihre Zurückdrängung war daher das zentrale Anliegen zahlreicher Reformen. Allerdings ist sie im Kernbereich des Strafrechts - der Reaktion auf mittlere und schwere Kriminalität - die unangefochtene Hauptsanktion geblieben und erfährt in diesem Bereich sogar Ausweitungen. Dabei ist ein Strafrecht ohne Freiheitsstrafen keine absurde Utopie. Vielmehr ist die Abschaffung der jeweils härtesten Sanktion - also eine fortwährende Bemühung um Humanisierung - die konstitutive Aufgabe des Strafrechts. Auch Aspekte des gerechten Schuldausgleichs und die vermeintlich ansteigenden Strafbedürfnisse der Bevölkerung stehen einer Abschaffung der Freiheitsstrafe nicht entgegen. Denn entscheidend für die vom Strafrecht angestrebte symbolische Verdeutlichung der Tat- und Schuldschwere ist vorrangig, dass das Sanktionensystem verschiedene Schweregrade von Unrecht unterscheidet und diese zueinander in ein angemessenes Verhältnis setzt. Der Autor legt dar, dass ein Strafrecht ohne Freiheitsstrafen diesem Erfordernis besser gerecht werden kann als das derzeitige Sanktionensystem. Die von ihm entwickelte modifizierte Laufzeitleistungsstrafe stellt eine funktional äquivalente aber weniger desintegrierende Alternative zur Freiheitsstrafe dar. Zugleich beinhaltet sie empfindliche Strafübel, um den auf dem Weg der Humanisierung nicht zu vernachlässigenden Funktionserhalt des Strafrechts zu gewährleisten.
