Nova Science Publishers Inc Federal Forfeiture Law: Provisions, Issues &
Book SynopsisForfeiture has long been an effective law enforcement tool. Congress and state legislatures have authorised its use for over 200 years. Every year, it redirects property worth billions of dollars from criminal to lawful uses. Forfeiture law has always been somewhat unique. By the close of the 20th century, however, legislative bodies, commentators, and the courts had begun to examine its eccentricities in greater detail because under some circumstances it could be not only harsh but unfair. The Civil Asset Forfeiture Reform Act was a product of that reexamination. This book is an overview of federal forfeiture law. It sketches the origins and general attributes of forfeiture, describes the distribution of the hundreds of millions of dollars it generates, and identifies some of the constitutional issues it raises. Furthermore, the book provides an overview of selected legal issues and reforms surrounding asset forfeiture, including the burden-of-proof standard and innocent-owner defense in civil asset forfeiture cases, access to counsel in both civil and criminal forfeiture cases, allocation of profits from confiscated assets, and DOJ''s equitable sharing program.

Nova Science Publishers Inc Law & State in the Globalized World: A
Book SynopsisMore than at any other time in history, today, law governs us all. As a result, some level of knowledge of the law is becoming increasingly important at all levels. It is especially useful for students of law, international relations, politics, and social sciences. International professionals as well as civil society organisations also benefit from the basic knowledge of law. In the post-war era, it is not only domestic laws, but also international laws that govern our individual rights, duties, and social interactions, including international relations. This is particularly the case in the fields of peace, security, human rights, international crime, environmental protection, and world trade. Moreover, the demand for harmonisation between domestic and international law has, in many respects, caused international law to become the main source for the creation and development of domestic law. This book offers a comparative perspective on the basic concepts and ideas about law and state. It was created in response to a number demands. It is written in a simple and comprehensive style so that general readers, law students, paralegals, and students from different social science disciplines can, in a straightforward fashion, all understand the legal concepts, legal philosophy, and law-state relationships in the context of globalisation, international cooperation, and the maintaining of the rule of law at the domestic level. This book aims to offer legal knowledge not only to students who are required to study law as an introductory course, but also to general readers on a wider scale. Its treatment is not confined to a particular legal system full of technical jargons, but rather explains general legal principles applicable to different legal systems in a non-technical manner, allowing the reader to understand the basic legal concepts from a general standpoint.

Nova Science Publishers Inc Sex Trafficking: Issues from a Gender-Based
Book SynopsisThe trafficking of persons has frequently been described as a "modern" or "Twenty-First Century" form of slavery. According to the Department of State, the U.S. government considers trafficking in persons to include all of the criminal conduct involved in forced labor and sex trafficking. Under the TVPA, trafficking in persons does not require actual movement of the victim. It is the many forms of enslavement that lay at the heart of human trafficking. Individuals may be trafficking victims regardless of whether they once consented, participated in a crime as a direct result of being trafficked, were transported in the exploitative situation, or were simply born into a state of servitude. This book discusses the gender-based civil right violations and provides proposals from the 114th Congress to amend the criminal laws of sex trafficking.

Nova Science Publishers Inc Medicaid Fraud Control: Integrity Efforts in
Book SynopsisMedicaid is a significant expenditure for the federal government and the states, with total federal outlays of $310 billion in fiscal year 2014. The Centers for Medicare & Medicaid Services (CMS) reported an estimated $17.5 billion in potentially improper payments for the Medicaid program in 2014. This book identifies and analyses indicators of improper or potentially fraudulent payments in fiscal year 2011, and examines the extent to which federal and state oversight policies, controls, and processes are in place to prevent and detect fraud and abuse in determining eligibility.

Nova Science Publishers Inc Supervised Release for Federal Crimes: Overview &
Book SynopsisSupervised release is the successor to parole in the federal criminal justice system. In 1984, Congress eliminated parole to create a more determinate federal sentencing structure. In its place, Congress instituted a system of supervised release, which applies to all federal crimes committed after November 1, 1987. Both parole and supervised release call for a period of supervision following release from prison and for reincarceration upon a failure to observe designated conditions. Parole ordinarily stands in lieu of a portion of the original term of imprisonment, while supervised release begins only after full service of the original term (less any "good time" credits). This book provides an overview of supervised release for federal crimes, and discusses U.S. parole commission issues.
