Edward Elgar Publishing Ltd Advanced Introduction to Private Law
Book Synopsis'A clear, accurate and extraordinary concise guide to the major doctrines of private law and current thought about what they mean.- James Gordley, Tulane University School of LawElgar Advanced Introductions are stimulating and thoughtful introductions to major fields in the social sciences and law, expertly written by the world's leading scholars. In this Advanced Introduction, one of the world's leading private law scholars takes the reader on an intellectual journey through the different facets and dimensions of the field, from the family home to Kuta Beach and from Thomas Piketty to Nina Hagen. This concise book provides an accessible and fresh introduction to private law, presenting the topic as a unified whole of which the main branches - on contract, tort, property, family and inheritance - are governed by conflicts between individual autonomy and countervailing principles. The book stands out as a unique account of how private law allows individuals to optimally flourish in matters of economy, work, leisure, family and life in general.Key features include:- succinct yet engaging and highly informative overview of private law, aimed at an audience of specialists and non-specialists alike- written in a clear and engaging style- ample attention to the policy choices behind the rules- examples from a wide range of jurisdictions in both Europe, the UK and the US- places private law in its larger economic and societal context- addresses the potential and the limits of private law in dealing with global societal challenges, such as economic inequality, the fair use of resources and protecting future generations- considers how the field could develop in the future. Engaging and wide-ranging, this is an excellent introduction for students and academics new to the field and allows practitioners to quickly master the core principles behind private law.Trade Review'This Advanced Introduction to Private Law reviews the development of private law on contract, tort, property, family and succession. The way in which it underlines conflicts between private autonomy and countervailing principles is fascinating for all those needing to quickly gain an understanding of the core principles and key issues on private law.' --Benedicte Fauvarque-Cosson, University of Paris II Pantheon-Assas, France'Jan Smits succeeds in giving a jargon-free and masterly concise overview of the essential questions and debates in private law. Law students would be well advised to read it twice: once at the very beginning and again at the very end of their private law studies. Non-lawyers will find it accessible and stimulating, and they will be surprised how interesting the law is, once it is reduced to its core issues.' --Stefan Vogenauer, Max Planck Institute for European Legal History, Frankfurt, Germany'This book provides a splendid overview of the key questions of private law. It is written in a crystal-clear and straightforward language and addresses all core problems of the law of contract, tort and property and of family law and succession law. All issues are placed in a wider social context and often illustrated by references to solutions of English, American, French or German law. While the book was written for a general audience and lacks technical jargon and conceptual refinements it should nonetheless be read by law students as well because it demonstrates in a stimulating and persuasive manner how private law tries to find its way between ensuring the individual's freedom of choice, on the one hand, and the search for fairness, the defense of the weak and vulnerable and the protection of the public interest, on the other.' --Hein Kotz, Max Planck Institute for Comparative and International Private Law, Hamburg, GermanyTable of ContentsContents: Preface 1. American Bar Association Bar Exam MPT Preparation & Experiential Learning
Book SynopsisBar exams—the notoriously rigorous multi-day tests required to become a licensed lawyer—include essays, multiple choice questions, and a practical section called the performance test ("PT"). Most jurisdictions use a multi-state performance test ("MPT"). Without a doubt, MPTs and PTs generally are the best parts of modern bar exams, and the best time to master them is during law school. Do not wait until bar review after graduation. Train now and pass your first bar exam.Performance tests are practical and realistic; they are open-book skills exams that require the kind of critical reading, analysis, and writing work that today's lawyers actually do. They do not require memorization; they include libraries so you can look up relevant rules during the exam—just as you would in practice. Because PTs test skills and not memory, once you learn how to successfully complete a performance test, you can take and pass any MPT the bar examiners throw at you. All you need is to 1) understand the exam and the skills it tests, 2) develop a success strategy, and 3) practice, practice, practice. This book provides everything necessary for MPT success—a clear and logical explanation of what you need to know; test-taking strategies, tips, and tools; and a bank of online resources with practice exams and sample answers.Reading Bar Exam MPT Preparation & Experiential Learning for Law Students during law school: Gives you a down payment for success on the bar exam; Provides exposure to practical lawyering skills that will help you transition effectively to law practice; Helps law school come alive, especially if it sometimes feels like you are just reading and briefing cases; and Empowers you to see beyond your student identity and envision yourself as a future professional. With this book's practice exams, you will act as the lawyer and "represent" almost a dozen clients—some facing criminal charges, others embroiled in civil litigation, and some dealing with business transactions. You will draft memos, briefs, discovery plans, affidavits, closing arguments, cross examinations, letters to clients, and more. So, dig in! Enjoy the read, and prepare for a successful future.

Bloomsbury Publishing PLC Getting a PhD in Law
Book SynopsisGetting a PhD in Law is a unique guide to obtaining the degree of Doctor of Philosophy of Law in the UK. While there is a wide range of study guides for PhD students in the social sciences and other science-based disciplines, there is very little information available on the process of obtaining a PhD in law. Research degrees in law share some attributes with those in related disciplines such as the humanities and social sciences. However, legal methodology and the place of the PhD in law in the young lawyer’s career create unique challenges that have not been addressed by existing guides. Getting a PhD in Law fills this clear gap in the market, providing an accessible guide to the PhD process from topic selection to thesis publication. This readable and informative guide draws on interviews and case studies with PhD students, supervisors and examiners. Getting a PhD in Law will be essential reading for the growing numbers of PhD students in the UK’s many law schools—and those internationally who wish to learn from UK best practice.Trade Review...will be useful for the growing numbers of PhD students in UK law schools, particularly those who may be coming to study in the UK for the first time. Those considering whether the PhD is right for them will undoubtedly benefit from the book's clear and pragmatic approach, but many topics (for example, writing up and the viva and beginning to build an academic career) will be relevant to those currently in the throes of doctoral study. ...a concise and easy to read introduction [which] certainly fulfils its stated objective of providing an accessible and readable guide to the UK doctoral degree. -- Bonnie Holigan * Edinburgh Student Law Review Volume 2, Issue 1 *[The book was] extremely helpful in being awarded the PhD studentship, especially the section about methodology about which I was asked and without the book I would not have been able to answer, so thank you very much, I would definitely recommend your book. -- Sarah Cunningham PhD Student, Lincoln UniversityI...was immensely pleased to see a new publication from Hart Publishing called Getting a PhD in Law by Caroline Morris and Cian Murphy. I believe it is the first of its kind and has been an enjoyable read...It provides practical guidance in an easy to read format. In its Introductory chapter it explains the nature and value of a PhD in law and why a PhD in Law is different to those taken in other disciplines. It makes sense and puts everything that I have thought into perspective. -- Christopher Hull * http://christopherhull.worldpress.com *...a very fine guide to doctoral studies in law [which] answers many questions and provides much invaluable advice. I don't think a doctoral student should be without it. -- William A. Bloomsbury Publishing PLC Modern Sports Law: A Textbook
Book SynopsisThe aim of this book is to provide an account of how the law influences the operation, administration and playing of modern sports. Although the book focuses on legal doctrine it has been written bearing in mind sport's historical, cultural, social and economic context, including the drama and colour of sport's major events and leading personalities. And although it is inevitably very much concerned with elite professional sports it is not dominated by them, and seeks to cover the widest possible range of sports, professional and amateur. Initially, the book addresses practical issues such as the structures of national and international sport, and examines the evolution of the body of law known as 'sports law'. Thereafter three main themes are identified: regulatory; participatory; and, financial aspects of modern sport. The regulatory theme is dealt with in chapters considering the manner in which decisions of sports governing bodies may be challenged in the ordinary courts and the development of alternative dispute resolution mechanisms in sport. The participatory theme includes the legal regulation of doping and violence in sport, as well as the broader topic of tortious liability for sporting injuries. The financial theme, reflecting the enhanced commercialisation of sport at all levels, is developed in chapters concerning issues in applied contract and employment law for players and legal matters surrounding the organisation of major sports events. The conclusion summarises modern sport's experience of EU law, pointing the way to the future direction of sports law more generally. While the book is aimed primarily at students, and is designed to cover fundamental and topical areas of sports law (sports law in general; sports bodies and the courts; arbitration in sport; corruption; doping; violence; civil liability; discrimination; the commodification of modern sport; and, the likely future of sports law), it should also prove of wider interest to practitioners, sports administrators and governing bodies; and though focused primarily on UK law it will also appeal to readers in Australia, Canada, New Zealand and the USA.Trade ReviewLet me say it directly! Jack Anderson's book is very good and recommended reading for anyone interested in the sport's future regulation, the standard of development and its relationship to social trends. Bo Carlsson Idrottsforum.org November 2011 This recently published book provides a welcome addition for those engaged in the study of legal aspects of sport. [Anderson] has provided careful analysis of many major features of modern sports law. One of the strengths of his work is the way in which he draws useful comparisons between the experience and decisions of the English courts with those of other common law jurisdictions. In addition, the ultimate readers are helped in their understanding by the reasoned and helpful referencing throughout the book. One must also add congratulations to Hart Publishing for their provision of an easy to follow structure and indexing of the text. Finally, it is suggested that Anderson's book will no doubt be a popular purchase by those who wish to enhance their study and interest in sports, whether as practitioners, students or general readers. David Dovey Sport and the Law Journal Volume 18, Issue 2 ...its content is minutely up to date and its analysis is strong and has a distinct and very interesting individuality to it. I, for one, will be recommending the book as an insightful and up-to-date treatise on the discipline that is sports law. Neville Cox Irish Jurist Volume 45 Modern Sports Law, A Textbook, is a very comprehensive and overall original approach to Sports Law. Jack Anderson brings about a fresh approach to the study of the topic. What is undeniable is that it's a magnificent work, which shows the encyclopedic knowledge of the author. The books included in the references are numerous and varied, it's truly impressive. ...this book would be very appropriate for students with a law degree and even for professionals that want to increase their knowledge about specific areas. Alfonso Valero www.lawinsport.com June 2011 This is a well-researched and well-written Book on 'Sports Law' and one that I would heartily and unhesitatingly recommend to students and practitioners alike. Professor Ian Blackshaw International Sport Law JournalTable of Contents1. Introduction: What is Sports Law? 2. Challenging Decisions of Sports Governing Bodies 3.
