Rowman & Littlefield How to Think About Law School

    Out of stock

Book SynopsisThis Handbook provides a comprehensive guide for college students and high school seniors considering law school. It teaches how to build an undergraduate resume, how to gather information about law school and legal careers, how to prepare for the Law School Admissions Test (LSAT) and how to navigate the pitfalls of the law school application process. It also leads students through the law school curriculum, the central importance of the first year (1L), the roles played by Law Review, clinical programs, Moot Court, Mock Trial, interviewing, networking, summer associate positions and clerkships. Finally, it concludes with seven lessons to carry from law school into legal practice. This Handbook arises from the author's two careersone as a university professor and pre-law advisor, the other as a magna cum laude law school graduate and a successful practicing attorney. Along the way it conveys the author's love of the law and admiration for the role of law in the United States. How to ThTrade ReviewDr. Dillon succeeds where few have: he cuts through the plethora of misinformation about law school admissions, the law school experience and legal careers to author a candid, insightful and eminently readable guide that is a ‘must have’ for anyone considering law school. Only someone with Dillon’s decades of experience in practice and academia could write with such clarity on the subtle nuances that define successful applications. -- Grant W. Keener, Senior Director of Admissions, Penn State Dickinison School of LawAnxious pre-law students (and their parents) will devour this book. Professor Dillon explains–calmly and honestly–how to get in, how to get through, and how to get hired. I wish I’d had this book when I applied to law school! -- Michael W. Steinberg, senior counsel, Morgan Lewis & Bockius LLPMichael Dillon's useful and engaging book provides both law school-bound students and their parents an honest and practical analysis of the pros and cons of entering law school and lawyering. Inspiring in this era of lawyer-bashing, Dillon, a gifted teacher who spent 22 years in law practice (I know first-hand that he was excellent at it) advises would-be lawyers to 'follow your passion.' Particularly helpful is a check-list for each of the four years of college that should help undergraduates get into law school, with extended advice to carry them through into practice. -- Linda R. Her insights are shaped by years of experience and advances in psychological and learning sciences. If law students read this excellent book, perhaps as early as when arriving to law school, they will develop skills they can exercise and master to achieve success." ‒ Victor D. Quintanilla, Indiana University Bicentennial Professor; Professor, Indiana University Maurer School of Law; Adjunct Professor, Indiana University Department of Psychological and Brain Sciences"From helpful study tips to suggestions for minimizing distractions, this book is an excellent resource to guide students through the challenges of bar study. Professor Berman is a seasoned professional, who condenses years of experience into easy to read and follow advice, perfect for anyone serious about passing the bar exam." ‒ Paula Manning, Professor Western State College of Law"Wanting to shape your destiny, this book is a must-read coaching manual with action plans to boot. Professor Berman takes the mystery out of bar prep, providing hosts of inspirational tips, courageous learning strategies, and concrete wisdom for overcoming the oft-expressed intimidation that so easily immobilizes many from achieving bar exam success––success that is well within the grasp of all law school graduates aspiring to serve as professional attorneys––none be barred. This book is not meant to be read but lived. Navigate your path through this book and you will be well on your way to passing your bar exam." ‒ Scott Johns, Professor of the Practice of Law and Director of the DU Bar Success Program, Denver University Sturm College of Law"This is a must-read book for law students and law professors. It provides practical suggestions so that students can be successful in law school, law practice, and the bar exam. It is fun to read and can be used by students on their own or in a class. The self-assessment tools are particularly valuable. As a law professor, I look forward to using this valuable resource with my students." ‒ Jane Bloom Grise, Director of Academic Enhancement and Assistant Professor of Legal Writing, University of Kentucky College of Law"This book is a fantastic resource. It offers an approach, starting in 1L, that can help varied types of students develop critical skills needed for success on the bar exam with a mix of skill-building and metacognitive strategies that also help students succeed in law school. I am excited to incorporate these strategies in my 1L and 2L classes." ‒ Nicole R. Lefton, Assistant Professor of Academic Support and Bar Preparation, Director of Academic Support and Bar Preparation, Maurice A. Deane School of Law at Hofstra University"I love the book and use it as a personal reference to coach my students, especially those who are first generation. It captures high expectations for success and normalizes the sense of inadequacy that they all feel and fear. It helps them to acknowledge it and push past it in both substance and tone. The underlying expectation is that the reader will pass the bar exam. When they read it, it keeps them tethered to their goals and their practical strategies amidst the panic, because it builds in intentional recursiveness." ‒ Kimberly Williams D'Haene, Director of Law Academic Success, Georgia State University College of Law"If I could give only one resource to someone who wants to increase the likelihood of passing the bar exam, it would be this book. Author Sara Berman tells the truth about the challenge of bar preparation while showing the taker how—through preparation, planning, and practice—success is achievable. Rather than scaring them, the book encourages bar takers. That, itself, is why I will refer all my students to it." ‒ Benjamin V. Madison III, Professor and Director of the Bar Passage Initiatives, Regent University School of Law"This book is like having a personal trainer help you prepare for the bar exam. It is a doubt-busting, confidence-boosting, interactive tour guide on the road to success. Sara Berman gives practical advice on motivation, time management, financial planning, and more. This book both explains and motivates—students will be wise to take Berman's advice, encouragement, and support." ‒ Catherine (Cassie) Christopher, Professor of Law, Associate Dean for Bar Success, Texas Tech University School of Law"Along with the excellent strategies on studying and test taking, Professor Berman illuminates the unspoken barrier to success, namely the student's mindset. This guide aptly describes the various barriers encountered by students and suggests interventions to maintain a positive and healthy outlook for success." ‒ Rodney Fong, Associate Dean for Academic Achievement, Institutional Assessment & Bar Preparation, and Clinical Professor of Law, The University of Illinois at Chicago John Marshall Law School

Book SynopsisBar exams—the notoriously rigorous multi-day tests required to become a licensed lawyer—include essays, multiple choice questions, and a practical section called the performance test ("PT"). Most jurisdictions use a multi-state performance test ("MPT"). Without a doubt, MPTs and PTs generally are the best parts of modern bar exams, and the best time to master them is during law school. Do not wait until bar review after graduation. Train now and pass your first bar exam.Performance tests are practical and realistic; they are open-book skills exams that require the kind of critical reading, analysis, and writing work that today's lawyers actually do. They do not require memorization; they include libraries so you can look up relevant rules during the exam—just as you would in practice. Because PTs test skills and not memory, once you learn how to successfully complete a performance test, you can take and pass any MPT the bar examiners throw at you. All you need is to 1) understand the exam and the skills it tests, 2) develop a success strategy, and 3) practice, practice, practice. This book provides everything necessary for MPT success—a clear and logical explanation of what you need to know; test-taking strategies, tips, and tools; and a bank of online resources with practice exams and sample answers.Reading Bar Exam MPT Preparation & Experiential Learning for Law Students during law school: Gives you a down payment for success on the bar exam; Provides exposure to practical lawyering skills that will help you transition effectively to law practice; Helps law school come alive, especially if it sometimes feels like you are just reading and briefing cases; and Empowers you to see beyond your student identity and envision yourself as a future professional. The research guide focuses on how to find and use instruments of European regional organizations. It is mainly intended to be a practical instrument for students of an advanced level, lawyers and public servants who work in the field of European law. In a practical way, this book offers a detailed description on how to do research in sources of European law in the most efficient way. The different sources of European law are examined. The research guide gives an answer to a variety of questions one may be confronted with when dealing with European law. What are these sources? Where can I find them? And once I have found them, how do I read them? The main focus lies on the wide range of electronic databases on European law, although reference is also made to the traditional way of finding sources. The use of screenshots and clear examples make this book a very practical instrument so that every person who deals with European law on a permanent or occasional basis will value it as an extremely useful tool.Trade ReviewAbout the first edition: 'Thankfully, faith in method is restored through a task successfully undertaken and completed by the authors of this work. [...] This work is intended to serve as a compass to anyone who needs to safely navigate the waters of European regional organisation research, and it serves its purpose well. The authors make their presentation and analysis in a consise, informative and direct way that is comfortable even with those who are unfamiliar with the subject. Overall, this book is recommended both as a starting point and as reference material' A.G. Out of stock

Book SynopsisAlthough women comprise nearly half of all law students and incoming associates at law firms, and have done so for many years, they remain greatly outnumbered by men at senior levels. If nothing is done to change this trend, the percentage of women equity partners will remain under 20 percent for decades to come. Slow progress in gender equality at senior roles raises awkward questions for the industry – and highlights the challenges that women lawyers face when developing their careers. Indeed, at mid-career, when earnings peak, the top 10 percent of female lawyers earn more than $300,000 a year, while the top 10 percent of male lawyers earn more than $500,000. Coupled with this, the number of female equity partners at top US law firms has risen by only five percent in the last 12 years. Although women comprise 47 percent of associate ranks at law firms, female lawyers make up only 31 percent of those entering the equity partnership class. This book is for women, by women – to help female lawyers progress their careers in an industry still struggling with gender equality. Written by outstanding women lawyers in their respective fields, each contribution takes a personal and professional view of the legal sector, providing insight and analysis of issues as diverse as flexible working, portfolio careers, unconscious bias and the modern career trajectory. The book is split into four sections, and begins with the results of original research undertaken by ARK Group in early 2019. Surveying 100 women lawyers from across the globe, we asked women at all stages in their careers to open up about their experiences, from recruitment to retirement, and the challenges – and opportunities – that being female has brought. The results make for interesting, and perhaps surprising, reading.Table of ContentsPart 1: A woman’s world Chapter 1: Introduction, ARK Group Chapter 2: The gender pay gap By Susan Eandi and Monica Kurnatowska, partners, Baker McKenzie) Chapter 3: Being a woman in a woman’s world By Joanne Frears and Belinda Lester, Lionshead Law Part 2: Making your mark Chapter 4: Framing your career and designing an effective job search By Debbie Epstein Henry, Founder, DEH Consulting, Speaking, Writing; co-founder, Bliss Lawyers Chapter 5: The branded lawyer – professional development through confident brand-building By Nika Kabiri, VP, Lux insights Chapter 6: Blurring the professional and the personal – relationship building By Karen Johnson-McKewan, Partner, Orrick, Herrington & Sutcliffe Chapter 7: The power of maximizing your strategic network By Christie Guimond, corporate development manager, Bird & Bird Chapter 8: Executive presence to advance career success By Susan Saltonstall Duncan, Rainmaking Oasis Part 3: Making your career work for you Chapter 9: Flexible working arrangements – the next stage from the “office nine-to-five” By Katherine Thomas and Bailey Bosch, Free Range Lawyers Chapter 10: Going it alone – setting up your own practice By Rachel Khiara, Khiara Law Chapter 11: Work’s not working – portfolio careers By Rachel Brushfield, The Talent Liberator, Energise Legal Chapter 12: Law as a second career By Pam Loch, managing partner, Loch Associates Part 4: The future Chapter 13: Uncovering bias that sabotages career development and success By Rosalie Chamberlain, Chamberlain Consulting Chapter 14: Modern career trajectories – is partnership still the end goal? Book Synopsis'A clear, accurate and extraordinary concise guide to the major doctrines of private law and current thought about what they mean.- James Gordley, Tulane University School of LawElgar Advanced Introductions are stimulating and thoughtful introductions to major fields in the social sciences and law, expertly written by the world's leading scholars. In this Advanced Introduction, one of the world's leading private law scholars takes the reader on an intellectual journey through the different facets and dimensions of the field, from the family home to Kuta Beach and from Thomas Piketty to Nina Hagen. This concise book provides an accessible and fresh introduction to private law, presenting the topic as a unified whole of which the main branches - on contract, tort, property, family and inheritance - are governed by conflicts between individual autonomy and countervailing principles. The book stands out as a unique account of how private law allows individuals to optimally flourish in matters of economy, work, leisure, family and life in general.Key features include:- succinct yet engaging and highly informative overview of private law, aimed at an audience of specialists and non-specialists alike- written in a clear and engaging style- ample attention to the policy choices behind the rules- examples from a wide range of jurisdictions in both Europe, the UK and the US- places private law in its larger economic and societal context- addresses the potential and the limits of private law in dealing with global societal challenges, such as economic inequality, the fair use of resources and protecting future generations- considers how the field could develop in the future. Engaging and wide-ranging, this is an excellent introduction for students and academics new to the field and allows practitioners to quickly master the core principles behind private law.Trade Review'This Advanced Introduction to Private Law reviews the development of private law on contract, tort, property, family and succession. The way in which it underlines conflicts between private autonomy and countervailing principles is fascinating for all those needing to quickly gain an understanding of the core principles and key issues on private law.' --Benedicte Fauvarque-Cosson, University of Paris II Pantheon-Assas, France'Jan Smits succeeds in giving a jargon-free and masterly concise overview of the essential questions and debates in private law. Law students would be well advised to read it twice: once at the very beginning and again at the very end of their private law studies. Non-lawyers will find it accessible and stimulating, and they will be surprised how interesting the law is, once it is reduced to its core issues.' --Stefan Vogenauer, Max Planck Institute for European Legal History, Frankfurt, Germany'This book provides a splendid overview of the key questions of private law. It is written in a crystal-clear and straightforward language and addresses all core problems of the law of contract, tort and property and of family law and succession law. All issues are placed in a wider social context and often illustrated by references to solutions of English, American, French or German law. While the book was written for a general audience and lacks technical jargon and conceptual refinements it should nonetheless be read by law students as well because it demonstrates in a stimulating and persuasive manner how private law tries to find its way between ensuring the individual's freedom of choice, on the one hand, and the search for fairness, the defense of the weak and vulnerable and the protection of the public interest, on the other.' --Hein Kotz, Max Planck Institute for Comparative and International Private Law, Hamburg, GermanyTable of ContentsContents: Preface 1. 15 in stock

Book SynopsisAdvocacy skills, which are learnt in the moot court, as a precursor to the effective communication of persuasive legal argument, are essential for those seeking a career in law. The skills associated with successful mooting, cover the entire range of the domains of human activity: intellectual, physical and emotional. This informative book examines the theories relevant to the development of skills necessary for effective participation in competition moots. By consideration of underlying theories, Mark Thomas and Lucy Cradduck develop unique models of the skills of the cognitive, psychomotor and affective domains and effective team dynamics, emphasising the importance of written submissions. The authors use this analysis to develop a unique integrated model that informs the process of coaching moot teams according to reliable principles. The Art of Mooting distils the theories and principles that support successful moot performances, grounding these in practical examples of how a mooter's skills may be developed and improved. It is an essential guide for moot coaches, law and advocacy students and academics seeking to improve their skills, and new and existing practitioners. Trade Review'This book offers brilliant new insights on the intellectual, physical and emotional aspects of mooting. In an era of growing emphasis on experiential learning and innovation in legal education, Thomas and Cradduck have given law teachers and students worldwide a valuable new tool to hone their crafts. The intertwining of pedagogical concepts and practical strategies is indispensable for full-time professors, adjunct coaches, peer mentors, and moot directors. The explanation of why and how to prepare for success also makes this book a must-read resource for every student mooting for fun or competition.' --Jeremy de Beer, University of Ottawa, Canada'The Art of Mooting provides an effective guide to the practical and theoretical aspects of mooting. The book combines the practical know-how that mooters need at each stage of a moot competition with the thorough theoretical and pedagogical approach that coaches require. It is therefore an indispensable resource for both mooters and moot coaches. If mooting is an art, this book puts everyone on the path to becoming an artist.' --Louise Parsons, Bond University, Australia'Happily, it has become fashionable to nod when told what a good thing mooting is for legal students and their instructors. But with their book, Mark Thomas and Lucy Cradduck take a more considered and rigorous approach, examining how and why mooting is so beneficial. Good advocacy synthesises thoughtfulness and experience. So does this book. It will be of interest and value to anyone with a stake in good legal education - and that, surely, is all of us.' --Stuart Baran, Three New Square, UKTable of ContentsContents: Foreword 1.
