Nach dieser Entscheidung zählen Mitarbeiter der Hochschulen nur dann zum wissenschaftlichen Personal, wenn sie die Möglichkeit haben, im Rahmen ihrer Dienstaufgaben selbstständig schöpferisch tätig zu werden und einen eigenen innovativen Forschungsbeitrag zu leisten. Thomas Raab zeigt auf, dass diese Definition des Begriffs "wissenschaftliches Personal" weder der Entstehungsgeschichte des Gesetzes noch deren Zwecksetzung gerecht wird, den Hochschulen zum Zwecke der Förderung des wissenschaftlichen Nachwuchses die rechtssichere Befristung von Arbeitsverhältnissen zu ermöglichen.
