  • The War Against Civilians: Victims of the “War on

Springer Nature Switzerland AG The War Against Civilians: Victims of the “War on

    1 in stock

Book SynopsisThis book provides a critical analysis of how the “war on terror” affected the civilian population in Afghanistan and Pakistan. This “forgotten war,” which started in 2001 with the US-led invasion of Afghanistan, has seen more than 212,000 people killed in war-related incidents. Whilst most of the news media shifted their attention to other conflict zones, this war rages on. Badalič has amassed a vast amount of data on the civilian victims of war from both sides of the Durand line, the border between Afghanistan and Pakistan. He conducted interviews in Peshawar, Quetta, Islamabad, Kabul, Jalalabad, and many other cities and villages from 2008 to 2017. His data is mostly drawn from those extensive conversations held with civilian victims of war, Afghan and Pakistani officials, human-rights activists and members of the insurgency. The book is divided into three parts. The first examines the impact the US-led coalition, Afghan security forces and paramilitary groups had on civilians, with methods of combat such as drone strikes and kill-or-capture missions. The second part focuses on civilian victims of abuses of power by Pakistani security forces, including arbitrary detentions and forced disappearances. In the final part, Badalič explores the impact of unlawful practices used by the armed insurgency – the Afghan Taliban. Overall, the book seeks to tell the story of the civilian victims of the “War on Terror".Table of Contents1. Introduction: Creating A Reign Of Terror.- 2. • The ‘War on Terror’, State Crime & Radicalization: A Constitutive Theory of Radicalization

Springer Nature Switzerland AG The ‘War on Terror’, State Crime & Radicalization: A Constitutive Theory of Radicalization

    1 in stock

Book SynopsisThis book examines the ‘war on terror’ and radicalization from an ontological, non-state centric perspective. Since 9/11, criminology has developed in its study of terrorism, utilising alternative non-state centric frameworks to uncover and make visible state-initiated harm. Although progress has been achieved, criminology has continued to privilege the state, thereby failing to uncover forms of state crime and how such crimes facilitate radicalization and terrorism. Ahmed aims to rectify this gap by demonstrating how crimes of the state have contributed to the existence of Islamist-inspired terrorism and the emergence of global Jihadist organisations like Al-Qaeda and ISIS.The ‘War on Terror’ abandons the dominant socially-constructed discourse and application of the ‘war on terror’ and instead favours a grounded approach whereby actors, actions and consequences are analysed according to the risk they represent. Ahmed achieves this grounded approach through situating state practices in international human rights law and international humanitarian law. Through documenting the intersectionality of these practices with radicalization in the emergence of global Jihadist organisations, the book demonstrates how state crimes contribute to terrorism. Although the book sits at the intersections of critical criminology, state crime, international/transnational crime, it is relevant to all disciplines that are concerned with state crime, terrorism and radicalization.

    Out of stock

Book SynopsisWhen a tribunal was formed in 2006 to address the atrocities of the Khmer Rouge, many expected the Cambodian model for victim empowerment to open a new path for international judiciary initiatives. However, the local reality of the justice intervention has been more complicated. Rather than joining the success-or-failure debate about the court, this volume pays special attention to how the trials are perceived locally. Inclinations in institutional design, favored or excluded political agendas, mismatched values between experts and locals, and unexpected local meaning-making all flow into the current context in Cambodia. Through critical analysis by authors with on-the-ground experience, this collection—the first to address the tribunal through a sociological framework—provides insight into the tension between the global justice regime and local societal context.

Book SynopsisIn this book, Czech lawyer and scholar Jakub Drápal tells the story of the life of Kamill Resler, an attorney who defended the most prominent Nazi tried in postwar Czechoslovakia: Karl Hermann Frank, who would go on to be executed for his role in organizing the massacres of the Czech villages Lidice and Ležáky in 1942. Celebrating Resler’s lifelong commitment to justice—to honoring even the most nefarious criminals’ right to a defense—Drápal highlights events that influenced Resler’s outlook and legal career, important cases that preceded Frank’s trial, Resler’s subsequent defenses of other Nazi criminals, and the final years of Resler’s life under the communist regime.

Book SynopsisThis incisive volume brings together postcolonial studies, visual culture and cultural memory studies to explain how the Netherlands continues to rediscover its history of violence in colonial Indonesia. Dutch commentators have frequently claimed that the colonial past and especially the violence associated with it has been 'forgotten' in the Netherlands. Uncovering 'lost' photographs and other documents of violence has thereby become a recurring feature aimed at unmasking a hidden truth. The author argues that, rather than absent, such images have been consistently present in the Dutch public sphere and have been widely available in print, on television and now on the internet. Emerging Memory: Photographs of Colonial Atrocity in Dutch Cultural Remembrance shows that between memory and forgetting there is a haunted zone from which pasts that do not fit the stories nations live by keep on emerging and submerging while retaining their disturbing presence.Table of ContentsIntroduction: Icons of Memory and Forgetting Chapter 1. 1904: Imperial Frames Chapter 2. 1904-1942: Epistemic Anxiety and Denial Chapter 3. 1942-1966: Compartmentalized and Multidirectional Memory Chapter 4. 1966-2010: Emerging Memory Conclusion Bibliography List of Places Where the 1904 Photographs Can Be Found

Book SynopsisHunt for Nazis is the first comprehensive account of the post-1945 efforts to bring Nazi war criminals who had escaped to South America to justice. The author shows that the Nazi hunt -- which resulted in spectacular cases like the kidnapping of Adolf Eichmann -- should not only be understood as part of the afterlife of the Third Reich, but that it also became an integral aspect of dealing with repression at the hands of authoritarian regimes in South America. Dissidents and human rights activists assumed that the escaped Nazi perpetrators and collaborators continued to be involved in violent crimes in the service of these new dictatorships.Trade Review"Stahl delivers a sweeping narrative of fifty years of frustrated post-war justice hampered by international politics and national self-interest. His exhaustive research of relevant European and South American archives informs a convincing argument for why such extensive efforts to hunt Nazis in South America netted only six."- Tony Foreman, Francia-Recensio 2020/2"Daniel Stahl has conducted research in European and South American archives. The work supplies a certain and disgraceful answer to what has long been suspected: that there was a broad coalition of people -- across continents and within the courts, police, governments and administrations -- that was unwilling to act or even thwarted the prosecution of Nazi criminals for decades."- Der SpiegelFor the German publication of Hunt for Nazis Daniel Stahl received the Opus Primum award (10.000 Euros) of the Volkswagen Foundation, Germany's largest private research funder: "In Hunt for Nazis, Daniel Stahl takes up one of the controversial topics of recent history. The author's strength is his great mastery of content and style, allowing him to reveal the various motivations of the investigations into Nazi crimes, which were carried out over the course of generations. Stahl's depiction of the changing constellations of interests and the continuities of functions and functionaries is backed up with detailed sources. The author dares to engage with a piece of contemporary history that will only get more relevant in the years to come.- The jury of the Opus Primum award of the Volkwagen Foundation"Some of the facts concerning the hunt for Nazis in South America are familiar. But Daniel Stahl's great achievement is to put this process in the context of attempts to come to terms with and cover up the past, human rights activists and interpreters of the Holocaust, and the politics of national and international interests. A milestone in the treatment of this topic."- Deutschlandfunk RadioTable of ContentsIntroduction I. The 'Fourth Reich' 1. World War II: The Particularity of Argentina 2. Book SynopsisIn Hungary, which fell under Soviet influence at the end of WWII, those who had participated in the wartime atrocities were tried by so called people's courts. This book analyses this process in an objective, quantitative way, contributing to the present timely discussion on the Hungarian war guilt. The authors apply a special focus on the gender aspect of the trials. Political justice had a specific nature in Hungary. War criminals began to be brought to trial while fighting was still underway in the western part of the country, well before the Nuremberg trials. Not only crimes committed during the war were tried in the same frame but also post-war ones. As far as the post-war period is concerned, legal proceedings regarding these crimes were most often launched on the basis of Act VII of 1946. This act of law concerned "the criminal law protection of the democratic constitutional order and the republic" and its basic aim was to facilitate the creation of a communist dictatorship and to deal with perceived or real enemies of the regime.Table of ContentsContents: LEGAL BACKGROUND TO THE PEOPLE'S TRIBUNALS AND THEIR OPERATION IN HUNGARY The System of People's Tribunals and the Actors in the Process The Crimes and the Range of Punishments Controversies Surrounding the Law on People's Tribunals RESEARCH METHODOLOGY Method of Approach Preparation Phase Pilot research Expert roundtable Training of the Encoders The Final Questionnaire Research Phase Sampling procedure From filling in the questionnaires to the data files Preparing the data files for analysis Several Notes on the Methodology and the Findings ANALYSIS OF THE PEOPLE'S TRIBUNAL CASES Types of Cases Distribution of the types of cases over time Characteristics of the Case Files Analysis of the Various Actors in the People's Tribunals Summary of the Demographics of Defendants and Witnesses in the Various Types of Cases Lawyers Characteristics of the People's Tribunal Cases The length of trials and the number of hearings The role of witnesses at the people's tribunals Judgments Effect of the composition of witnesses on judgments A GENDERED ANALYSIS OF POLITICAL JUSTICE IN HUNGARY IN THE AFTERMATH OF WWII Women in Political Justice: Stereotypes and Reality about Women Perpetrators Witnesses Court Judgments Women People's Judges Summary: Gender in political justice JEWISH IDENTITY AND THE PEOPLE'S TRIBUNALS Characteristics of the People's Tribunal Cases Defendants and Their Characteristics Witnesses and Their Characteristics Court Judgments Jewish Identity and the Practice of Political Justice SUMMARY BIBLIOGRAPHY
