Taylor & Francis Constitutionality of Law without a Constitutional
Book SynopsisThis book analyses the problem of the possibility of guaranteeing the constitutionality of law in cases when a constitutional court either has been weakened or does not exist. A starting point of the research is the emergence of the so-called illiberal constitutionalism in several states, namely Poland, Hungary and Turkey, as this phenomenon gravely affects the functioning of constitutional courts. The work is divided into three parts. The first contains contributions of a theoretical nature dedicated to the current shape of constitutional review, in particular in the light of the emergence of illiberal constitutionalism. This part of the book also deals with the collapse of the centralised constitutional review in Poland and the attempts to resolve the constitutional crisis. The second is focused on discussing specific, current problems with constitutional review, on the basis of states such as Hungary, Romania, Turkey and Poland. The third relates to other forms of constitutional revTable of Contents1. Turbulent times in the constitutionalism of Central and Eastern European countries; Part I. Taylor & Francis The Political Economy of Elites in Latin America
Book SynopsisRecent years have seen renewed interest in elites around the world, and their interconnection with power, privilege, social stratification, and social change. The contributors to this edited volume explore the many facets of the role of elites in the political economy of Latin America: their position within society, their impact upon the economy, and their influence within governing institutions. The book demonstrates that in Latin America, as in many other parts of the world, structural change and movements toward more just, inclusive, and sustainable societies seem impossible without the involvement of elites at some level. This raises important questions: Under what conditions do elites push for reform? How do elites react to societal and economic challenges and changes? To what extent can popular classes successfully pressure elites? Taylor & Francis Ltd The Incoherence of Human Rights in International Law
Book SynopsisIncoherence is a term that is all too often associated with the public international law regime. To a great extent, its incoherence is arguably a natural consequence of the fragmented nature of both the development and overall scope of the discipline. Despite significant achievements since the Universal Declaration of Human Rights (1948), a coherent human rights regime that is properly integrated with other branches of public international law is still lacking. This book explores this incoherent approach to human rights, including specific challenges that arise as a result of the creation and regulation of legal relationships between parties (state and non-state) that sit outside of the human rights framework, with a view to considering how it may be remedied. Divided into three parts, the collection provides a critical exploration of various challenges and barriers related to the absence of human rights in some instances, contemporary emergence of rights, and a lack of rights fulfi

Taylor & Francis QAnon
Book SynopsisThis book explores the QAnon movement by examining its history, fluctuations and evolution, stemming from the likelihood of multiple users behind the âœQâ account, as well as from the changes in the sociopolitical landscape since the creation of the movement. It frames QAnon as a lived religion and demonstrates that it has gone through three stages of existence: proto-QAnon, canonical-QAnon and apocryphal-QAnon. Author Marc-Andrà Argentino argues that QAnon evolved into something more than a conspiracy theory and demonstrates through a comparative analysis that QAnon is more akin to a new religious movement, in particular a hyper-real religion. He explores the role of gender and women in the QAnon movement, followed by an examination of how the QAnon conspiracy theories have legitimized and coordinated targeted gender-based violence. The book provides evidence of the nexus of QAnon and ideologically-motivated violent extremism and criminality. Finally, it examines the evolution of QAnon after the January 6th insurrection, the loss of the 2020 election by Donald Trump and the disappearance of âœQ.â This volume will be of great interest to researchers of conspiracy theories, new religious movements, American politics, and extremism.

Book SynopsisIrregular migration is one of the most momentous phenomena of the 21st century. While it is a lifeâchanging process for migrants themselves, it also entails a number of significant challenges for destination countries and their local populations. Consequently, irregular migration is now a heavily debated and polarising issue in most receiving states. However, the multiple perspectives on this phenomenon are rarely assessed together, and statesâ role in shaping national and international responses remains understudied, which hinders a comprehensive understanding of irregular migration governance. To address this issue, this innovative book investigates irregular migration by concurrently analysing the viewpoints of migrants, states, and their local populations. To that end, it builds on multidisciplinary insights from international relations, migration studies, political science, and other disciplines, and adopts Italy and Australia as two highly relevant yet rarely compared c

The understandings of security shift and advocating a particular reading of security involves entering the political contest with actors advancing different conceptions. The contributors analyse these different modalities, overlapping scenes and shifting meanings that bring about EU security policies. Taylor & Francis Health insurance in the United States of America
Book SynopsisThe U.S. health care system is dominated by private and public (governmental) insurance which makes it difficult for many Americans to imagine access to health care without it. The health care system in the USA is sometimes mistakenly referred to as market-based, partly because of the previous lack of compulsory insurance. As this book shows, however, even before ObamaCare it was a system heavily influenced by the government. This short and accessible book demonstrates that governmental long-term interventionism in the American health insurance market has led to many contemporary serious problems, such as significant and uncontrolled increases in health care costs, rising health insurance prices, marginalization of direct payments, limited competition, and problems with uninsured Americans. Many observers wrongly blame the market for this state of affairs and demand more regulation, which further deteriorates the situation. The study is divided into two parts: an analysis of the history of interventions (and their effects) in the private health insurance market, and an analysis of the genesis and evolution of governmental Medicare and Medicaid insurance. Thus, the book constitutes a unique synthesis of Austrian theory of interventionism and the history of health insurance in the USA.This book is vital reading for health economists, managers, and policymakers, as well as those interested in the Austrian approach to economics.

Book SynopsisThe United Progressive Alliance (UPA) government (200414) led by the Congress came to power with a radical agenda for religious minorities. This included legislation and policies against discrimination and disadvantages suffered by religious minorities, especially Muslims, and a new framework for delivering substantive equality of opportunity. In critically re-evaluating the UPA''s performance, it uses an institutional policy analysis approach which combines historical institutionalism (and path dependence) with policy analysis. It draws on official sources and extensive interviews with elite administrators and policy makers who were at the core of decision making during the UPA''s tenure in office. Cambridge University Press Regime Support Beyond the Balance Sheet
Book SynopsisThis book challenges the conventional wisdom that policy performance is the most important determinant of regime support. It does so by focusing on two countries where performance and support do not match. Chile is the economic envy of every country in Latin America, yet support has been surprisingly anemic. By contrast, Venezuela managed to maintain extremely high levels of support during the reign of Hugo Chávez despite severe failures of governance. Resolution of these paradoxes requires turning away from policy decisions and focusing instead on how those decisions are made. Taking inspiration from democratic theory and social psychology, this book argues that extensive opportunities for direct participation in the political process engenders in citizens strong feelings of efficacy - a sense of control over the course of politics. Rhodes-Purdy uses a mixed-methods approach to test this theory, including qualitative case studies, analysis of survey data, and experimental methods.Trade Review'This book offers a bold challenge to conventional thinking about what democracies need to do to generate and maintain public support. Rhodes-Purdy draws from democratic theory and social psychology to argue that citizens expect more than policy effectiveness from their rulers; popular support also depends on opportunities to participate in collective decision-making processes. He employs an impressive array of methodological tools to develop and test his arguments, and his comparative analysis of Chile and Venezuela offers a novel interpretation of highly paradoxical cases. At a time when citizen disenchantment with even well-established democracies seems to be on the rise, Rhodes-Purdy provides a provocative and compelling case for why participation matters.' Kenneth Roberts, Cornell University'Why do citizens support their regimes? Conventional wisdom, dating back to Lipset, tells us that support is built by performance in response to citizen demands. Rhodes-Purdy turns conventional wisdom on its head, demonstrating via creative use of survey data from LAPOP's AmericasBarometer along with extensive qualitative data that a sense of efficacy and citizen self-governing participation matter far more than policy performance. Students as well as aspiring politicians will come away enlightened from reading this excellent, well-written book.' Mitchell A. Cambridge University Press Diversity Judgments
Book SynopsisThe US Supreme Court''s legitimacy-its diminishing integrity and contribution to the good of society-is being questioned today like no other time in recent memory. Criticisms reflect the perspectives of both ''insiders'' (straight white males) and ''outsiders'' (mainly people of color, women, and the LGBTQ community). Neither perspective digs deep enough to get at the root of the Court''s legitimacy problem, which is one of process. The Court''s process of decision-making is antiquated and out of sync with a society that looks and thinks nothing like the America of the eighteenth century, when the process was first implemented. The current process marginalizes many Americans who have a right to feel disenfranchised. Leading scholar of jurisprudence Roy L. Brooks demonstrates how the Court can modernize and democratize its deliberative process, to be more inclusive of the values and life experiences of Americans who are not straight white males.Trade Review'Dazzling and original work again by the indefatigable legal scholar Roy Brooks. Book SynopsisSince the publication of the first edition, substantial changes have occurred in the political landscape of Jordan and the Middle East. King Abdullah II has cemented his rule amidst an onslaught of threats which have faced his kingdom since he succeeded his father in 1999. The Syrian civil war has fundamentally shifted the political context of its neighbouring countries, with Jordan experiencing a huge population explosion as people moved across the border from Syria. Beginning in the early 1920s in the Mandate years, and now benefiting from new material on the rise of the Muslim Brotherhood, attempts at democratisation, the collapse of the economy, the Jordan Spring and refugee crisis, this new edition featuring original research brings Jordan''s political history into the twenTrade Review'Robins … arguably knows more about Jordan than anyone in the West, and this second edition of his history of the kingdom is as authoritative and informative as the first. Cambridge University Press Building Participatory Institutions in Latin
Book SynopsisWhile prior studies have shown the importance of participatory institutions in strengthening civil society and in improving policy outcomes, we know much less about why some participatory institutions take root while others do not. This book explains the divergent trajectories of nationally mandated participatory institutions'' ''stickiness'' by highlighting the powerful and lasting impacts of their origins in different policy-reform projects. Mayka argues that participatory institutions take root when they are bundled into sweeping policy reforms, which upend the status quo and mobilize unexpected coalitions behind participatory institution building. In contrast, participatory institutions created through reforms focused on deepening democracy are easy for entrenched interests to dismantle and sideline. Building Participatory Institutions in Latin America draws on rich case studies of participatory institutions in Brazil and Colombia across three policy areas, offering the first crossTrade Review'Mayka's book is a gem. It provides an original conceptualization and argument for the process of institutional strengthening of participatory innovations. In her carefully crafted and thoroughly researched comparison of participatory institutions in the public policy sectors of health, social assistance, and planning in Brazil and Colombia, Mayka reveals the importance of originating sweeping reforms and policy entrepreneurs that can activate broad coalitions. This book is a must read for anyone interested in institutional creation and change, civic participation, health, social assistance, and the recent institutional innovations and politics of Latin America.' Tulia Falleti, Director of the Latin American and Latino Studies Program, University of Pennsylvania.'Latin America played an innovative role in the global diffusion of participatory reforms in recent decades, but as Lindsay Mayka shows in this insightful book, these reforms varied widely in their effectiveness and levels of grass-roots engagement. This book is a must-read for scholars and policymakers alike who want to understand the larger institutional environments that make popular participation meaningful, inclusive, and responsive to citizens at the grass-roots.' Cambridge University Press Iran
Book SynopsisFrom encounters with Western powers in the nineteenth century through to a Constitutional Revolution at the beginning of the twentieth century, and from the overthrow of the democratically elected Prime Minister Mosaddeq in the 1950s to the current Islamic Republic, Iran''s history has rarely been far from tumultuous and dramatic. And the ways in which Iranian society has participated in and reacted to these events have been equally fascinating and revolutionary. Here for the first time in English, Yann Richard offers his take on the social and political history of Iran since 1800. Richard''s account traces the common threads of national ideology and violent conflict that have characterised a number of episodes in Iranian history. By also concerning himself with the reactions and feelings of Iranian society, and by referring frequently to Persian sources and commentaries, Richard gives us a unique insight into the challenges encountered by Iranians in modern times.Trade Review'The book is well written, covers the main events in modern Iranian history up to the present, and will be an important source for scholars and others interested in understanding modern Iran.' Cambridge University Press Salafism and Political Order in Africa
Book SynopsisViolent Islamic extremism is affecting a growing number of countries in sub-Saharan Africa. In some, jihadi Salafi organizations have established home bases and turned into permanent security challengers. However, other countries have managed to prevent the formation or curb the spread of homegrown jihadi Salafi organizations. In this book, Sebastian Elischer provides a comparative analysis of how different West and East African states have engaged with fundamentalist Muslim groups between the 1950s and today. In doing so, he establishes a causal link between state-imposed organizational gatekeepers in the Islamic sphere and the absence of homegrown jihadi Salafism. Illustrating that the contemporary manifestation of violent Islamic extremism in sub-Saharan Africa is an outcome of strategic political decisions that are deeply embedded in countries'' autocratic pasts, he challenges conventional notions of statehood on the African continent, and provides new insight into the evolving relTrade Review'Elischer successfully achieves his goal of contributing to the debate surrounding state-society relations in areas of weak statehood … Elischer's work enhances the debate on jihadi Salafi mobilization and demobilization making it essential reading for anyone interested in furthering their knowledge on Salafism.' Cambridge University Press Power Grab
Book SynopsisFor rulers whose territories are blessed with extractive resources - such as petroleum, metals, and minerals that will power the clean energy transition - converting natural wealth into fiscal wealth is key. Squandering the opportunity to secure these revenues will guarantee short tenures, while capitalizing on windfalls and managing the resulting wealth will fortify the foundations of enduring rule. This book argues that leaders nationalize extractive resources to extend the duration of their power. By taking control of the means of production and establishing state-owned enterprises, leaders capture revenues that might otherwise flow to private firms, and use this increased capital to secure political support. Using a combination of case studies and cross-national statistical analysis with novel techniques, Mahdavi sketches the contours of a crucial political gamble: nationalize and reap immediate gains while risking future prosperity, or maintain private operations, thereby passing Trade Review'Political survival is essential to rulers. In this thoughtful and far-ranging new book, Paasha Mahdavi shows exactly how rulers use control over energy and mining companies to advance their own political survival – often at the peril of their own people and the planet.' David Victor, University of California, San Diego'This is a very interesting and provocative book on a timely and important topic. It should be read with great interest by academics, policymakers, and students. It speaks to issues that concern comparative political science, international relations, industrial organization, and macroeconomics. The best part about it is that it transcends stale debates about whether there is or is not a resource curse; rather, Mahdavi looks at the causes and consequences of state run oil companies with fresh eyes and exploits original data to make a truly nuanced argument. In doing so, he has really pushed the ball forward and, hopefully, opened up a new research agenda. Bravo!' Victor Menaldo, University of Washington'Mahdavi's Power Grab offers perhaps the most comprehensive and sophisticated analysis of oil nationalisation and re-nationalisation to date. By focusing on political leaders' perceptions of their probability of survival in oil rich states, it identifies an important paradox in the decision to nationalize: weaker leaders nationalize to bolster their power and become stronger as a result due to greater access to oil revenues, and yet, strong leaders opt not to nationalize, which serves to weaken their power by limiting their access to oil revenue. Power Grab thus offers important insight into the relationship between state ownership of the oil sector and regime survival.' Pauline Jones, Director, International Institute, University of Michigan'Challenging conventional understandings of resource nationalization as the domain of strong rulers whose tenures are secure, Paasha Mahdavi carefully maps out and then demonstrates how much nationalization is in fact a strategy borne of political insecurity. Power Grab deftly weaves cross-national econometrics and carefully crafted comparative historical analysis to show how. Mahdavi's analysis of the domestic and global-economic milieu in which leaders like Qaddafi gambled on, and won through, resource seizures, represents an ambitious and formidable new scholarly voice in the study of resource politics.'
