  • Just Interests: Victims, Citizens and the

Edward Elgar Publishing Ltd Just Interests: Victims, Citizens and the

Book SynopsisThe idea of justice and the reality of justice are two very different things. Just Interests examines both concepts, offering accounts from lay people and legal officials to explore how the goals and interests of victims of crimes can be accommodated within the criminal justice process. Robyn Holder challenges the typical classification of ?victim? for those who have been victimized by violence, and re-positions them as members of a political community with diverse interests ? both private and public. Departing from conventional approaches that see victims as a problem for law to contain, Holder draws on democratic principles of inclusion and deliberation to posit a criminal justice approach that mobilizes citizens to produce justice in their ordinary lives. This book will be of fundamental importance for analysts and advocates in governmental and non-governmental organizations to understand victims as citizens first and their engagements with criminal justice as citizenship practices. It will also be a valuable read for socio-legal scholars and researchers examining the constitutive nature of peoples and their public criminal law.Trade Review'Robyn Holder is a reflective practitioner and thoughtful scholar of victim perspectives on what justice might mean. This impressive book brings together years of her consolidated wisdom. It treats us to rich engagement with complex realisations of justice. Empirically, it amplifies voices from below to help us learn from their experience on how to better comprehend the complexity of justice. It helps us to find our own justice imaginary as we also search for a democratic imaginary.' --John Braithwaite, Australian National University'This book constitutes a significant and highly insightful contribution into deconstructing the meaning of justice. In positioning crime victims as a community of citizens who hold legitimate justice interests, the author's arguments are a welcome riposte to a needs-based analysis of the issues which confront victims in the criminal process.' --Jonathan Doak, Nottingham Trent University, UKTable of ContentsContents: Preface 1. • A Research Agenda for Global Crime

Edward Elgar Publishing Ltd A Research Agenda for Global Crime

Book SynopsisElgar Research Agendas outline the future of research in a given area. Leading scholars are given the space to explore their subject in provocative ways, and map out the potential directions of travel. They are relevant but also visionary. It is becoming more important in the modern, globalized period to understand the power of illicit and illegal acts and actors in shaping our world. Opening with chapters that look across the diverse terrain of global crime, this Research Agenda moves on to consider key specific areas, including: organised crime, cyber crime, war crimes, terrorism, state and private violence, riots and political protest, prisons, sport and crime and counterfeit goods. Offering both critical reviews of key theories and in-depth case studies, this Research Agenda challenges the notion that criminal acts in a global age are solely the preserve of organised criminal groups, highlighting the role of other actors including governments, armies and corporations. A vital source of reference for criminology and sociology undergraduate, and post-graduate students, as well as those from a host of other social science disciplines, this Research Agenda will provoke thought and discussion across these topics. It will also be of great benefit for policy makers and practitioners working to better understand and combat transnational crime.Trade Review'This is a book that shows how legality and illegality are indeed limited concepts when it comes to global and transnational crimes. It successfully explores legal and conceptual diversities, but also procedural and thematic convergence in our globalized world where, to quote Hannah Arendt and to echo the authors of this text, certain harmful conducts simply ''explode the limits of legal thought'', leading to a constant need for deeper tools for analysis.' --Anna Sergi, University of Essex, UK, and University of Turin, Italy'Adopting the perspective that our world is increasingly tied together by flows that combine both licit and illicit, this timely volume pushes criminology into dialogue with wider debates about transnationalism and globalism, showing that crime can usefully be examined through a relational and geographical lens. But more than this, the book represents the state of the art in contemporary criminology, showing how the discipline is expanding to encompass multiple forms of economic and environmental exploitation, from human trafficking and drug smuggling through to corporate crime and environmental abuses. An exciting collection that underscores the value of inter-disciplinary thinking on questions of crime and criminology.' --Philip Hubbard, King's College London, UKTable of ContentsContents: 1. • Counterfeit and Falsified Medicines in the EU: A

Edward Elgar Publishing Ltd Counterfeit and Falsified Medicines in the EU: A

Book SynopsisThis timely book investigates the issue of counterfeit and falsified medicines (CFM) in the EU, identifying that this is a problem that lies at the intersection of three spheres of law - medicine, intellectual property (IP), and criminal law. The book highlights key issues such as infiltration of the legal supply chain and the involvement of organised crime, analysing relevant EU law and demonstrating the challenges of CFM.Using examples from several case studies, Vishv Priya Kohli reveals the gaps in the current legal framework, underlining the particular difficulties created by the interplay between different areas of law as well as the lack of criminal penalties. The author explores areas where improvements have already been made, in particular through the Falsified Medicines Directive, and articulates a number of recommendations to fill in the gaps, for example by harmonizing criminal law and building synergies within law enforcement.Counterfeit and Falsified Medicines in the EU will be of great interest to academics and students in IP, health and medical law, and criminal law in the EU. It will also prove valuable for practitioners and policymakers working in and with enforcement authorities in the EU, as well as those working in the medical field itself.Trade Review‘The problem of counterfeit medicines, while having its political, economic, medical and social dimension, is also a legal problem. This work is a study of the legal side of counterfeiting from the EU perspective. It provides a comprehensive analysis of the current EU regulatory framework, including medical law, IP law and criminal law. In addition to that, the book also offers detailed case studies of some of the most exciting counterfeiting examples explaining how they were dealt with. A timely and useful work.’ -- Andrej Savin, Copenhagen Business School, DenmarkTable of ContentsContents: Preface 1. Introduction to counterfeit and falsified medicines 2. • Transnational Organized Crime: Challenging

Edward Elgar Publishing Ltd Transnational Organized Crime: Challenging

    15 in stock

Book SynopsisThis timely book provides a critical consideration of one of the most pressing matters confronting global and regional strategies for suppressing transnational organized crime today: the question of the scope and rationale of States’ criminal jurisdiction over these cross-border offences. It shines a light on the complex challenges posed by transnational organized crime to international criminal law.Fulvia Staiano analyses the ways in which transnational organized crime has pushed States, as well as international organizations and institutions, to rethink the boundaries and rationale of territorial and extraterritorial State jurisdiction. The book examines consolidated instances of transnational organized crimes, such as human trafficking, migrant smuggling and trafficking in firearms, but also looks at emerging phenomena which have come to the attention of scholars and practitioners in more recent times, including cybercrime. In doing so, it draws a connection between States’ responses to ‘old’ and ‘new’ transnational crimes while providing an up-to-date analysis of international practice in this field.Contributing to the broader academic debate on the need to conceptualize transnational criminal law as an area of study separate from international criminal law, this book will be a key resource for postgraduate students, researchers and academics in the fields of public international law, criminal law, international relations, as well as social and political studies.Trade Review‘In Transnational Organized Crime: Challenging International Law Principles on State Jurisdiction, Fulvia Staiano engages in an admirably clear-eyed exploration of how states have overcome the fundamental problems of projecting their legal authority beyond their borders in order to suppress transnational organized crime, and how their practice has catalysed alteration of the orthodox international law principles of expanded territorial and extraterritorial criminal jurisdiction. This wide-ranging but concise and up-to-date analysis of the complex and rapidly evolving laws involved, deserves a place on your book-shelf.’ -- Neil Boister, University of Canterbury, New Zealand‘This is a most timely book which showcases how the international law of jurisdiction has evolved in the context of transnational organized crime, in ways that often differ from other fields of the law. The author foregrounds the peculiar interpretations which are given to jurisdictional concepts in this particular field, and convincingly explains their rationales. This book invites us to think anew about the variegated forms which jurisdictional assertions take on, depending on the issue-area.’ -- Cedric Ryngaert, Utrecht University, the NetherlandsTable of ContentsContents: Introduction to Transnational Organized Crime 1. 10 in stock

Book SynopsisElgar Research Agendas outline the future of research in a given area. Leading scholars are given the space to explore their subject in provocative ways, and map out the potential directions of travel. They are relevant but also visionary. This insightful Research Agenda explores the varied manifestations of organised crime, both on the street and through transnational enterprises, and reveals its impact on the integrity of the financial system. Leading academics identify measures which would disrupt and discourage these threats, however sophisticated, and consider avenues for future research. Taking an interdisciplinary approach to the multi-faceted dangers posed by organised crime, the book begins with an overview of the misconceptions surrounding the topic, evaluating the limitations of the traditional justice system in addressing corruption and conspiracy. Progressive chapters illustrate a practical knowledge of addressing such threats, identifying new directions for the study of concepts such as organised crime and power, as well as tackling the ways in which enterprises use money laundering to clean their proceeds. They also point to ways in which the law will need to develop to address the opportunities for cyber-enabled crime facilitated by recent technological developments. An engaging platform for future scholarship, this topical Research Agenda will prove a thought-provoking read for academics and policymakers in the areas of criminal justice law, criminology, corruption, and economic crime.Trade Review‘The 1986 US President’s Commission on Organized Crime concluded that the problem with defining “organized crime” was not with the word crime, but rather with the word organized. In this valuable contribution to the literature on what it is agreed is a multifaceted, understudied topic, a fruitful mix of authors from academic, policy and practitioner backgrounds provide an agenda for better understanding and thus confronting organized crime. This roadmap should stimulate much needed research on a matter of global concern.’ -- James O. Book SynopsisExpertly drawing on international examples and existing literature, Penal Populism closes a gap in the field of criminology. In this fascinating expose of current crime policy John Pratt examines the role played by penal populism on trends in contemporary penal policy.Penal populism is associated with the public's decline of deference to the criminal justice establishment amidst alarm that crime is out of control. Pratt argues that new media technology is helping to spread national insecurities and politicians are not only encouraging such sentiments but are also being led on by them. Pratt explains it is having most influence in the development of policy on sex offenders, youth crime, persistent criminals and anti-social behaviour. This topical resource also covers new dimensions of the phenomenon, including: the changing nature and structure of the mass media less reliance on the more orthodox expertise of civil servants and academics <Trade Review'This is an important, acessible international perspective on the rise of penal populism and surely deserves a place in every academic library' - Mike Ryan, University of Greenwich, Punishment and Society 'John Pratt has long understood the importance of this inter-disciplinary approach to our understanding of public discourses on crime and punishment, and this new text on penal populism is yet another example of his ability to put together, and then convincingly apply, an extensive intellectual tool kit... 15 in stock

Book SynopsisThis Handbook brings together the voices of a range of contributors interested in the many varied experiences of women in criminal justice systems, and who are seeking to challenge the status quo.Although there is increasing literature and research on gender, and certain aspects of the criminal justice system (often Western focused), there is a significant gap in the form of a Handbook that brings together these important gendered conversations. This essential book explores research and theory on how women are perceived, handled, and experience criminal justice within and across different jurisdictions, with particular consideration of gendered and disparate treatment of women as law-breakers. There is also consideration of women's experiences through an intersectional lens, including race and class, as well as feminist scholarship and activism. The Handbook contains 47 unique chapters with nine overarching themes (Lessons from history and theory; Routes into the criminal jus

    15 in stock

Book SynopsisCybercrime and Digital Deviance, Second Edition, combines insights from sociology, criminology, psychology, and cybersecurity to explore cybercrimes such as hacking, identity theft, and romance scams, along with forms of digital deviance such as pornography addiction, trolling, and âœcancelingâ people for perceived violations of norms.Other issues are explored including cybercrime investigations, nation-state cybercrime, the use of algorithms in policing, cybervictimization, and expanded discussion of the theories used to explain cybercrime. Graham and Smith conceptualize the online space as a distinct environment for social interaction, framing their work with assumptions informed by their respective work in urban sociology and spatial criminology, and offering an engaging entry point for understanding what may appear to be a technologically complex course of study. The authors apply a modified version of a typology developed by David Wall: cybertrespass, cyberfraud, cyberviolence, and cyberpornography. This typology is simple enough for students just beginning their inquiry into cybercrime, while its use of legal categories of trespassing, fraud, violent crimes against persons, and moral transgressions provides a solid foundation for deeper study. In this edition each chapter includes a new âœCurrent Events and Critical Thinkingâ section, using concepts from the chapter to explore a specific event or topic like the effect of disinformation on social cohesion and politics.Taken together, Graham and Smithâs application of a digital environment and Wallâs cybercrime typology makes this an ideal upper-level text for students in sociology and criminal justice. It is also an ideal introductory text for students within the emerging disciplines of cybercrime and cybersecurity.

Book SynopsisProviding a comparative analysis of both vulnerable witnesses and vulnerable suspects, this book discusses the increasingly difficult issue faced by many in modern policing, forensic psychology, criminology, and social justice studies.Examining recent legislation, guidance, current psychological theory, and contemporary research and literature, the book enhances the currently limited knowledge of vulnerability in the criminal justice system (CJS) through the presentation of theoretical understanding, case law and real-life case studies. It also explores how vulnerable victims, witnesses, and suspects progress through the system in England and Wales from initially being identified as vulnerable through to the measures used to assist them during interviews and at trial. In doing so, it provides a historical overview of how vulnerability has previously been considered, and how effective those with vulnerabilities were perceived to be in actively participating in the CJS. • Taylor & Francis The Freedom Fighter A Terrorists Own Story

    5 in stock

Book SynopsisThe ability of terrorist groups to inflict death and destruction has markedly increased with technological advances in the areas of communication, transportation, and weapon capability. Using these new tools and networks, terrorists now seek to inflict mass casualties worldwide. Given these realities, it is essential to research the factors that underlie a terrorist groupâs origins, grievances, and demands. Such insights might help others respond more effectively to insurgencies, especially when military campaigns to capture or kill every terrorist have proven unsuccessful. The Freedom Fighter: A Terroristâs Own Story explores why so many Kurdish peopleâespecially young adultsâjoin the Kurdistan Workersâ Party (PKK) and conduct terrorist acts. Inspired by the ground-breaking classic, The Jack-Roller: A Delinquent Boyâs Own Story, by Clifford R. Shaw, the author explores the issue of radicalization into terrorist organizations through the life-history method, enabling a PKK terroristâor âœfreedom fighterââto tell his story. Over a five-month period, the author interviewed âœDeniz,â a high-level PKK terrorist in a Turkish prison, who during his time in the PKK rose from the lowest level to near the top in terms of terrorist operations. This riveting life history, told in Denizâs own words, provides unique insights into why someone becomes a âœfreedom fighterâ and what such a life entails. The account provides extensive information on the PKK, including the groupâs recruitment, ideological and military training, armed strategies, internal structures and code of ethics, treatment of women, and goals for peace. Denizâs story not only explains why more Kurdish âœfreedom fightersâ will be recruited to engage in terrorist acts, but also facilitates understanding of how âœnormal peopleâ can become involved in conflict and organizations that are designated as âœterrorist groups.â A foreword by renowned criminologist Francis T. Cullen helps contextualize the material. This book will interest students of criminology, terrorism/counterterrorism, political violence, and security.Table of ContentsForeword by Francis T. • Cambridge University Press Partnerships in Policing

    15 in stock

Book SynopsisPartnerships in policing are used worldwide to reduce crime and disorder problems. Police forge partnerships with businesses, government agencies, and communities to co-produce public safety. Third-party policing (TPP) is a particular type of partnership that involves the police addressing crime and disorder by working through (and with) third-party partners. This Element focuses on the nature and effectiveness of TPP partnerships. Using systematic review and meta-analytic techniques, it shows that TPP interventions are effective in efforts to reduce crime and disorder, without displacement of these problems. Cooperative partnerships are associated with considerably larger crime control effects than interventions relying on coercive engagement styles. Dyad partnerships ? twosome partnerships between police and one third-party partner ? are likely to offer the ?sweet spot? in TPP. The Element concludes that partnership policing using non-criminal justice legal levers is a promising approach to crime control. This title is also available as Open Access on Cambridge Core.

    15 in stock

Book SynopsisFor centuries, most people believed the criminal justice system worked - that only guilty defendants were convicted. DNA technology shattered that belief. DNA has now freed more than three hundred innocent prisoners in the United States. This book examines the lessons learned from twenty-five years of DNA exonerations and identifies lingering challenges.Trade Review'This thoughtful collection of essays on one of the most important scientific and legal advances of the past century is a must read for anyone who wants to understand American criminal justice. Exonerations have so much to teach us about what goes wrong in police encounters, prosecutors' offices, and courtrooms around the country, and this book serves as a much needed guide.' Rachel E. Barkow, Segal Family Professor of Regulatory Law and Policy and Faculty Director, Center on the Administration of Criminal Law, New York University School of Law'This excellent and timely collection examines the revolutionary impact of DNA identification on American criminal justice. It explores the major changes triggered by DNA exonerations, starting in 1989 - in criminal investigation, trial procedure, the use of the death penalty - and it discusses the challenges we still face and reforms that may yet happen.' Samuel R. Gross, Thomas and Mabel Long Professor of Law, University of Michigan'Wrongful Convictions and the DNA Revolution should be required reading for prosecutors, defense attorneys, judges, and jurors alike. The book magnificently lays bare the painful but critical lessons from twenty-five years of struggle for exoneration of the innocent.' Jeannie Suk Gersen, John H. Watson, Jr Professor of Law, Harvard Law School'The chapters of Wrongful Convictions and the DNA Revolution summarize remarkable strides achieved by the Innocence Movement, provide insight into the movement's legal and institutional elements, and point to future challenges. Every criminal law scholar in law schools and criminal justice departments would benefit by reading the volume. It is an excellent high-level entry point for criminologists new to wrongful conviction research. Instructors could assign individual chapters in advanced wrongful conviction courses. In sum, Daniel S. Medwed's volume deserves a central place in the growing library of wrongful conviction scholarship.'
