    2 in stock

Book SynopsisThe Role of Business in the Responsibility to Protect closes the gap between research on the Responsibility to Protect and the private sector, as previous research has focused only on state responsibilities and state actors. This book examines in detail the developing research on the significant role that private sector actors can play in promoting peace and stability. Contributors to this volume explore the key arguments for where, why, and how private sector actors can contribute to the prevention and cessation of mass atrocity crimes; and how this can inform and extend the UN policy discussion around Responsibility to Protect. The contributors include lead voices in the Responsibility to Protect discourse as well as central voices in business and peace literature.Trade Review'In the past, predatory business practices have sometimes enabled crimes against humanity. This book identifies how some businesses have profited from human misery while also providing welcome examples of how the private sector can play a crucial role in undermining the politics of the machete and the mass grave. In doing so, this book broadens our understanding of the international community, of our collective responsibility to protect, and of how the private sector - whose wealth, resources and capacity can easily exceed those of failing or fragile states - can play a vital role in the prevention of mass atrocities.' Simon Adams, Global Centre for the Responsibility to Protect, The Graduate Center, City University of New York'That business can be an instrument in building peace has now been firmly recognized. Including the business sector in the Responsibility to Protect (R2P) debate seems only natural, having in mind the capacity of the business community to influence societal attitudes and structures. In this new book professor John Forrer and Conor Seyle make an important effort in putting this agenda forward.' Per L. Saxegaard, Founder and Chairman, Business for Peace Foundation'The private sector is an increasingly influential actor in global governance - the network of arrangements that ensure order, stability and predictability even in the absence of world government. Business can sustain and profiteer from group violence. But it also has important roles to play before, in and after armed conflicts in underwriting peace, stability and prosperity as the pathway to sustainable profits. One important role is to partner with other key actors in implementing the responsibility to protect populations at risk of mass atrocities. This invaluable collection of essays by leading experts systematically explains why, how and with what prospects.' Ramesh Thakur, Australian National University, Canberra, International Commission on Intervention and State Sovereignty (ICISS) Commissioner and Editor-in-Chief, Global Governance'This volume fills an important lacuna in the literature on how business relates to the responsibility to protect. The contributing authors offer practical and theoretical insights and examples that will be of interest to many on the ways the private sector can support (or undermine) the goals of the responsibility to protect.' Abi Williams, President, The Hague Institute for Global Justice'This book, with its focus on how business actors may contribute to the global Responsibility to Protect Agenda (R2P), pioneers a whole new agenda for research and policy formulation. In the process, the authors challenge our standard conceptions of both business and R2P.' Book SynopsisA uniquely comprehensive analysis of human rights, that combines historical, philosophical, and legal perspectives with cutting edge research from psychology and the cognitive sciences. Provides accessible resources to understand the deep ethical point of human rights and to criticize deficiencies in current human rights theory and practice.Trade Review'Jurists, philosophers, historians, and (more recently) behavioral researchers have extensively studied the concept of human rights. In his thought-provoking book, Matthias Mahlmann masterfully draws all the threads together in order to gain a deeper understanding of the pertinent debates. This book offers a fresh, fascinating, and insightful analysis of this vital topic.' Eyal Zamir, Hebrew University of Jerusalem'The term, magisterial, is often used promiscuously to characterize a book, but not in this case. It is deserved because it is a successful blend of immense interdisciplinary erudition applied to a vitally important topic. Fueled by passion for human rights, Minds and Rights is beautifully written and deep, requiring the reader's attention and engagement. It is worth it.' Stephen J. Morse, University of Pennsylvania School of Law'This book reaches the summit of the ambitions and promises of the title. Relying on state-of-the-art cognitive science and combining it with anthropology and moral philosophy it provides a compelling defense of human rights in a world of fashionable human rights skepticism.' András Sajó, Central European University, former Vice-President of the European Court of Human Rights'Mahlmann offers us a passionately argued, deeply humane manifesto in support of human rights at a time when we need it most. It deserves a wide readership across the disciplines and should become one of the most influential books on the theory of human rights.' Christopher McCrudden, Queen's University, Belfast; University of Michigan Law School'Mind and Rights is a spectacular contribution to our understanding of ethics, cognitive science, and human rights. Mahlmann's deep, systematic, and wide-ranging account takes issue with many influential trends in the study of mind, brain, and behavior, while also reviving and strengthening the case for universal human rights. A remarkably ambitious and provocative synthesis, which will shape and guide future reflection on these important topics.' Combining the best aspects of both casebook and treatise, this comprehensive textbook provides detailed explanations and analysis of the law to help understand the issues as well as case extracts to offer a flavour of the judicial reasoning of trade adjudicators. Moreover, the book is truly global in outlook, being equally useful for students of international trade law in the UK, Europe, the US, Asia and elsewhere around the world. This updated edition includes in-depth discussions of the most recent developments in international trade jurisprudence, setting out important precedents that help establish the boundaries between global trade rules and domestic national autonomy. • Regulatory Delivery

    Bloomsbury Publishing PLC Regulatory Delivery

    2 in stock

Book SynopsisThis ground-breaking book addresses the challenge of regulatory delivery, defined as the way that regulatory agencies operate in practice to achieve the intended outcomes of regulation. Regulatory reform is moving beyond the design of regulation to address what good regulatory delivery looks like. The challenge in practice is to operate a regulatory regime that is both appropriate and effective. Questions of how regulations are received and applied by those whose behaviour they seek to control, and the way they are enforced, are vital in securing desired regulatory outcomes. This book, written by and for practitioners of regulatory delivery, explains the Regulatory Delivery Model, developed by Graham Russell and his team at the UK Department for Business, Energy and Industrial Strategy. The model sets out a framework to steer improvements to regulatory delivery, comprising three prerequisites for regulatory agencies to be able to operate effectively (Governance Frameworks, Accountability and Culture) and three practices for regulatory agencies to be able to deliver societal outcomes (Outcome Measurement, Risk-based Prioritisation and Intervention Choices). These elements are explored by an international group of experts in regulatory delivery reform, with case studies from around the world. Regulatory Delivery is the first product of members of the International Network for Delivery of Regulation.Trade ReviewThe book is a must-read for regulators at all levels of government. For regulatory practitioners working at the frontlines, the chapters on regulatory practices will likely be of most interest. For those working in managerial positions in regulatory agencies, the chapters on prerequisites will likely have the most insights. Yet, as the authors of the Regulatory Delivery Model explain (in exceptionally clear language) all these aspects impact each other. Contrary to some of the other books that I have discussed on this blog, Regulatory Delivery provides regulators with an easy heuristic to work with. * New Zealand Government Regulatory Practice Initiative *Table of ContentsPART ONE WHY DELIVERY? Book SynopsisWhat effect do robots, algorithms, and online platforms have on the world of work? Using case studies and examples from across the EU, the UK, and the US, this book provides a compass to navigate this technological transformation as well as the regulatory options available, and proposes a new map for the era of radical digital advancements. From platform work to the gig-economy and the impact of artificial intelligence, algorithmic management, and digital surveillance on workplaces, technology has overwhelming consequences for everyone’s lives, reshaping the labour market and straining social institutions. Contrary to preliminary analyses forecasting the threat of human work obsolescence, the book demonstrates that digital tools are more likely to replace managerial roles and intensify organisational processes in workplaces, rather than opening the way for mass job displacement. Can flexibility and protection be reconciled so that legal frameworks uphold innovation? How can we address the pervasive power of AI-enabled monitoring? How likely is it that the gig-economy model will emerge as a new organisational paradigm across sectors? And what can social partners and political players do to adopt effective regulation? Technology is never neutral. It can and must be governed, to ensure that progress favours the many. Digital transformation can be an essential ally, from the warehouse to the office, but it must be tested in terms of social and political sustainability, not only through the lenses of economic convenience. Your Boss Is an Algorithm offers a guide to explore these new scenarios, their promises, and perils.Trade ReviewTechnology is fundamentally revolutionising the world of work - in this magisterial contribution, Aloisi and De Stefano traverse the impact of innovation on jobs, from the prospect of full automation to platform work and future-proofing labour law. It will be of great value to scholars and practitioners in law, labour market economics, and beyond. * Jeremias Adams-Prassl, Professor of Law, Oxford University, UK *Your Boss is an Algorithm is an indispensable resource to anyone thinking about how to understand and govern technology at work. Aloisi and De Stefano provide brilliant—and urgent—analysis of platform labor and the role of artificial intelligence in constraining our collective futures. Book SynopsisAre you fed up with the divided and unequal society or suffocating laws and regulations of the country where you live? Ever dreamed of starting your own country or just want to understand how that happens? In this refreshing new book, Matt Qvortrup provides a step-by-step guide to forming an independent country, from organising a referendum and winning it, to receiving official international recognition, establishing a currency and even entering the Eurovision song contest. The book delves into the legal, economic and political problems of creating new states, using historical examples and anecdotes from all over the world to illustrate the obstacles to these campaigns. Qvortrup recounts his globetrotting experiences as an expert consultant on referendums to give a no-nonsense explanation of the many hurdles and barriers, as well as the opportunities for those who want to break free.Trade Review‘I want to break free is the unapologetic book of political independence movements, by an advisor who has both global, ground-level political experience and encyclopaedic historic knowledge. Would-be states need this book as much as existing states in danger of runaway nations. If you are neither of these, you will simply find this book immeasurably informative and entertaining.’Dahlia Scheindlin, PhD., international political consultant and foreign affairs analyst'Matt Qvortrup’s concise book provides an expert guide to the practical issues of making a country formally independent, self-governing and part of the community of democratic nation-states. Myths are challenged, and historic and contemporary examples drawn from, which are relevant to how we make sense of independence in the age of interindependence. Essential reading for anyone with an interest in self-government in Scotland, Catalonia and elsewhere.'Gerry Hassan, Professor of Social Change, Glasgow Caledonian University and author of Scotland Rising: The Case for Independence'Full of insight and rich detail, Matt Qvortrup’s important new book provides an engaged and wonderfully engaging study of the passions and politics of state making.'Professor Alastair Bonnett, author of Off The Map and Beyond The Map'This book is a pearl within the study of secessionism that could only be written by someone knowing both the realpolitik of state-making and the depths of the multiple academic debates on this topic.'Marc Sanjaume-Calvet, Regional & Federal Studies'A good, well-written, practical survey of much of the law, politics, & economics of secession which should be informative to secessionists and counter-secessionists both.'Mark McGeoghegan, doctoral researcher at the University of Glasgow'Overall, this book is refreshing and excellent, making it easy to recommend. It renders visible and accessible to a wider audience things that would be easily recognisable to specialists. For those of us outside of the small circles of the Scottish and British insider political classes, looking in from diverse standpoints, I want to break free clearly explains what is possible and, in general terms, how. It doesn’t play down how hard it is, and it doesn’t dumb down nor back down from the difficult issues. In thinking about ‘the now’ and the ‘not yet’ in Scotland, such a pragmatic contribution is very welcome.'Hannah Graham, Bella Caledonia'How does a would-be nation become a legitimate, internationally recognized state? This short, accessible book is framed as a step-by-step guide to nation-building. In it, Matt Qvortrup paints secessionism as a very public divorce; or, at least, a trial separation.'Kerryn Baker, Australian National University -- .Table of ContentsIntroduction1 A brief history of self-determination and the making of new states2 Start me up: how to establish a movement and win support3 What’s law got to do with it? Book SynopsisA TABLET AND WALL STREET JOURNAL BOOK OF THE YEAR Shortlisted for the Wingate Literary Prize ‘A tremendous feat of storytelling, propelled by numerous twists and revelations, yet anchored by a deep moral seriousness . . . Enthralling‘ Guardian Across the world the last Nazi trials are winding their way through the courts. Nearly a century on from the Holocaust, survivors are still asked to give proof – and, in an era of rising revisionism and denialism, have their stories questioned. In this spellbinding debut, Linda Kinstler investigates both her family story and the archives of ten nations to ask: what does it take to prove history in our uncertain century? 'Reminds us of the dangerous instability of truth and testimony' Anne Applebaum 'Such a brilliant book – I couldn't put it down‘ Lea Ypi, author of Free 'Outstanding' Philippe Sands, author of East West Street ‘Astonishing‘ Patrick Radden Keefe, author of Empire of PainTrade ReviewVictims and perpetrators meet in Kinstler’s bloodline, but family history is only one strand of a remarkable book that braids together her own rigorously reported investigations in 10 countries with the survivors’ eight-decade quest for justice and poetic meditations on such subjects as history, law, Latvian identity, Franz Kafka and the politics of remembrance. This is a tremendous feat of storytelling, propelled by numerous twists and revelations, yet anchored by a deep moral seriousness * Guardian *Combines meticulous historical research with philosophical inquiries into nationalism, holocaust denial, guilt and the burden of proof. This is an invaluable and highly readable account of not only one family’s story, but also of a period on the cusp of passing from living memory * New Internationalist *[A] remarkable new book . . . There is a complex and powerful family story here . . . Asks large questions about the capacity of historical and legal practice to encompass the moral horror of the Holocaust, and about what justice is, or has ever been, possible * The Critic *Linda Kinstler has achieved something truly unusual: a book that captures the paradoxes and nuances of memory politics in contemporary Eastern Europe, while at the same time invoking the trauma that past tragedies leave on individuals and families. Using rigorous, evocative prose, she reminds us of the dangerous instability of truth and testimony, and the urgent need, in the 21st century, to keep telling the history of the 20th -- Anne ApplebaumObviously a masterpiece. A book that makes the Holocaust fresh, slipping seamlessly between story, thinking, politics, poetry and the personal -- Peter Pomerantsev, author of THIS IS NOT PROPAGANDABefore reading (devouring) Come to This Court and Cry, I wouldn't have thought a book like this was even possible. A moving family portrait on top of a sensational whodunit murder on top of a brilliant mediation on memory, the law, and identity? And yet here it is. Linda Kinstler has threaded the needle. This book is many things, and yet it fits together perfectly . . . It's a marvel -- Menachem Kaiser, author of PLUNDERFirst I was moved, then I was gripped and now I am haunted by Linda Kinstler's astonishing new book -- Ben Judah, author of THIS IS LONDONThe atrocities of the twentieth century have still not passed, still less the effects of the period’s most pernicious secrets. Now a new generation is reckoning with the crimes of the Holocaust and the dark shadows of the Cold War. In this brilliant and compelling book, Linda Kinstler takes us back to Latvia, to her family history, and to a question which – in our new age of fascist-tolerance – is more urgent still: what is justice? -- Lyndsey StonebridgeImplicit in Kinstler’s heart-breaking narrative is a key question. How, when the victims of these hideous crimes are all gone, can we uphold the truth and deny the deniers? -- Julia Boyd, author of TRAVELLERS IN THE THIRD REICHIn this searching and powerful book, Linda Kinstler sets out to solve the mystery of her grandfather's role in the genocide of Latvia’s Jews during World War II. But the questions she ends up confronting – about national pride, the need for heroes and the elusiveness of the past – couldn't be more relevant in the 21st century. Come to the Court and Cry is an exemplary work of investigative journalism and historical research, showing why writers like Kinstler are needed now more than ever -- Adam KirschIn her completely absorbing and profound debut, Linda Kinstler sets out to solve a mystery – journeying from a murder scene in Uruguay to the former killing fields of Europe to unravel a family secret about her late grandfather – and in the process unearths vexing questions about the past and how we understand it. Part detective story, part family history, part probing inquiry into how best to reckon with the horrors of a previous century, Come To This Court and Cry is bracingly original, beautifully written, and haunting. An astonishing book -- Patrick Radden KeefeA powerful and very moving account of the aftermath of the Holocaust in Latvia, & the value and meaning of different kinds of evidence, by [Linda Kinstler]. Highly recommended. -- Richard OvendenCome to This Court and Cry is a reminder that memory is fallible, that the desire for forgetting is strong and that, when it comes to a subject so bitterly contested for so long, truth is all the more unstable -- Caroline Moorehead * Literary Review *Exploring the tension between the justice of the courtroom and the retribution of assassination, the logic of the law and the frailty of memory, Linda Kinstler’s intelligent and thoughtful study Come to This Court and Cry utilises the story of Latvia’s wartime experience to meditate on the limits of the postwar reckoning with the Final Solution -- Mark Mazower * Times Literary Supplement *The book, Ms. Kinstler’s first, is an exquisite exploration into ‘how the memory of the Holocaust extends into the present and acts upon it’ -- Tunku Varadarajan * Wall Street Journal *In this gripping book, author Kinstler asks: was my grandfather a war criminal? … Kinstler chronicles her tireless investigation into anything she can glean about the life (and death) of grandfather Boris. At times, it acquires the qualities of an Agatha Christie spy novel. But she also raises fundamental philosophical issues … the gripping volume ends with more questions than answers -- Daniel Snowman * Jewish Chronicle *There has never been a better time to read a book such as this…As a historian, she is engaged in neither flight nor fight. She skillfully invites readers into the complexity of her craft * Sydney Morning Herald *Avoiding any simplistic or definitive conclusions, Kinstler provides a model of deep historical research and fluid, engaging narrative * New York Journal of Books *[A]n exquisite exploration * Wall Street Journal *She traces its twists and turns with patience, care, and a burning sense of integrity, bringing the reader into an answerless place between conflicting witness testimonies, between history and literary narratives, and between what is recorded as evidence and what is otherwise passed down or felt * Jewish Currents *[A] gripping debut … a deeply researched, engrossing and important look at how Holocaust stories have been passed down and altered * Washington Post *

Book SynopsisEPDF and EPUB available Open Access under CC-BY-NC-ND licence. In principle, couples getting married in England and Wales can choose to do so in a way that reflects their beliefs. In practice, the possibility of doing so varies considerably depending on the religious or non-religious beliefs they hold. To demonstrate this divergence, this book draws on the accounts of 170 individuals who had, or led, a wedding ceremony outside the legal framework. The authors examine what these ceremonies can tell us about how couples want to marry, and what aspects of the current law preclude them from doing so. This new evidence shows how the current law does not reflect social understandings of what makes a wedding meaningful. As recommended by the Law Commission, reform is urgently needed.Table of Contents1. Introduction 2. Anglican, Quaker, and Jewish Weddings 3. Christian Weddings in Registered Places of Worship 4. A forceful statement of liberal principles - championing the legal, moral and political rights of the individual against the state - Dworkin demolishes prevailing utilitarian and legal-positivist approaches to jurisprudence. Atlantic Books Muslim, Actually: How Islam is Misunderstood and

Book SynopsisAS RECOMMENDED ON THE TROJAN HORSE AFFAIR PODCASTWhy are Muslim men portrayed as inherently violent? Does the veil violate women's rights? Is Islam stopping Muslims from integrating?Across western societies, Muslims are perhaps more misunderstood than any other minority. How did we get here? In this landmark book, Tawseef Khan draws on history, memoir and original research to show what it is really like to live as a Muslim in the West. With unflinching honesty, he dismantles stereotypes from inside and outside the faith, and explores why many are so often wrong about even the most basic facts. Bold and provocative, Muslim, Actually is both a wake-up call for non-believers and a passionate new framework for Muslims to navigate a world that is often set against themMuslim, Actually was previously published in 2021 in hardback under the title The Muslim Problem.Trade ReviewI can't recommend this sober, level-headed and highly readable book too highly. It painstakingly dismantles the poisonous myths about Muslims spread in the British media and on the far right. I read it at a sitting and learnt something new from every page. * Peter Oborne, author and journalist *A thoughtful, exploratory, candid, passionate and thoroughly modern book on migration, identity, individuality, integration and faith, reflecting on what it means to be a member of the religion we both belong to. * The i *This is a remarkable, insightful, searingly honest book on how British Muslims live and feel and think, and how one can be a happy and fulfilled Muslim in a world so frequently defined by Islamicist extremists and racists. For me, a progressive Muslim, it was like finding an oasis of intelligence and truths, of hope and possibilities. * Yasmin Alibhai-Brown, author and journalist *Meticulously researched and thought-provoking... an utterly convincing treatise on Muslim identity... Even readers who consider themselves sympathetic and well informed should find food for thought in the depth of analysis Khan offers... the book's defining characteristics are humanity and hope. * Business Post *Timely, urgent and eloquent. An honest and well-researched exploration of how biases, stereotypes and prejudices affect identity both from within and outside the Muslim community. * Pragya Agarwal, author of Sway: Unravelling Unconscious Bias *Powerful and disturbing. This deeply personal and forensically researched book exposes the stain of Islamophobia that has long festered in British society * Chris Atkins, Sunday Times bestselling author of A Bit of a Stretch *A vital exploration of Islamophobia. I learned so much from reading this book. Tawseef Khan has given us an insightful, intelligent and intimate discussion of issues we all need to grapple with. * Jeffrey Boakye, author of Black, Listed *A bracing and brilliant book. From women's rights to terrorism, [Muslim, Actually] takes apart misconceptions and shows what it's really like to be a Muslim today. By placing Islamophobia in a historical context, Khan gives powerful insights into one of the most hotly-contested and topical issues of our times. * Reza Aslan, author of No God But God *Through an eclectic and powerful mix of personal memoir and first-hand reporting, Tawseef Khan shows the unique challenges faced by British Muslims as they seek to remedy decades of fear-baiting media narratives and government policy that have negatively impacted their communities. * Hussein Kesvani, journalist *A vital and timely book for those who wish to engage more honestly with Muslims and for those Muslims struggling with their identity in 21st century Britain. * Tez Ilyas, author of The Secret Diary of a British Muslim Aged 13 ¾ *Essential reading... a blisteringly honest account of what it means to be a Muslim today and a much-needed corrective to prejudice. * Magid Magid, author and former Lord Mayor of Sheffield *A powerful book demystifying the Islamic experience and a must read for those wishing to expand their world view beyond stereotypes. * Asifa Lahore, Britain’s first out Muslim drag queen *Table of Contents0: Introduction 1: 'Muslims Don't Integrate' 2: 'Islam Is Violent' 3: 'Muslim Men Are Threatening' 4: 'Islam Hates Women' 5: 'Islam Is Homophobic' 6: Conclusion: The Muslim Problem

The Islamic Texts Society Equity and Fairness in Islam

    2 in stock

Book SynopsisThis is the first work in the English language to deal specifically with the subjects of equity and fairness in Islamic law. Prof M H Kamali takes these concepts back to their origin in the Qur''an, the sayings of the Prophet Muhammad and the era of the Companions of the Prophet in the first two centuries of Islam. This is followed by discussions of equity as a basis for the formulation of Islamic law and a comparison between it and other concepts essential for law making such as general consensus, analogical reasoning and considerations of public interest. Part Two of Equity and Fairness in Islam is an attempt to apply the concepts of equity and fairness to certain issues of contemporary concern and especially to commercial transactions. The issues raised here are related to Islamic banking, sale transactions, charitable endowments, pensions funds and other long-term saving accounts. Equity and Fairness in Islam can be read in conjunction with M H Kamali''s titles especially Islamic Commercial Law.
