  • Choosing Environmental Policy: Comparing

Taylor & Francis Inc Choosing Environmental Policy: Comparing

    1 in stock

Book SynopsisThe two distinct approaches to environmental policy include direct regulation-sometimes called 'command and control' policies-and regulation by economic, or market-based incentives. This book is the first to compare the costs and outcomes of these approaches by examining realworld applications. In a unique format, paired case studies from the United States and Europe contrast direct regulation on one side of the Atlantic with an incentivebased policy on the other. For example, Germany‘s direct regulation of SO2 emissions is compared with an incentive approach in the U.S. Direct regulation of water pollution via the U.S. Clean Water Act is contrasted with Hollands incentive-based fee system. Additional studies contrast solutions for eliminating leaded gasoline and reducing nitrogen oxide emissions, CFCs, and chlorinated solvents. The cases presented in Choosing Environmental Policy were selected to allow the sharpest, most direct comparisons of direct regulation and incentive-based strategies. In practice, environmental policy is often a mix of both types of instruments. This innovative investigation will interest scholars, students, and policymakers who want more precise information as to what kind of 'blend' will yield the most effective policy. Are incentive instruments more efficient than regulatory ones? Do regulatory policies necessarily have higher administrative costs? Are incentive policies more difficult to monitor? Are firms more likely to oppose market-based instruments or traditional regulation? These are some of the important questions the authors address, often with surprising results.Trade Review'The editors offer an informative review, especially for readers interested in the specifics of how economically developed countries have, in different ways, often successfully controlled major sources of pollution.' • Unspeakable Subjects: Feminist Essays in Legal

Bloomsbury Publishing PLC Unspeakable Subjects: Feminist Essays in Legal

    1 in stock

Book SynopsisNicola Lacey's book presents a feminist critique of law based on an analysis of the ways in which the very structure or method of modern law is gendered. All of the essays in the book therefore engage at some level with the question of whether there are things of a general nature to be said about what might be called the sex or gender of law. Ranging across fields including criminal law, public law and anti-discrimination law, the essays examine the conceptual framework of modern legal practices: the legal conception of the subject as an individual; the concepts of equality, freedom, justice and rights; and the legal construction of public and private realms and of the relations between individual, state and community. They also reflect upon the deployment of law as a means of furthering feminist ethical and political values. At a more general level, the essays contemplate the relationship between feminist and other critical approaches to legal theory; the relationship between the ideas underlying feminist legal theory and those informing contemporary developments in social and political theory; and the nature of the relationship between feminist legal theories and feminist legal politics. The essays in this book tell the story of an intellectual journey which has led the author to question some of the central assumptions of traditional legal education and scholarship. They also set out a distinctive vision of jurisprudence as a form of critical social theory.Trade ReviewThis collection of essays brings together work of a leading figure within feminist legal thought and provides an excellent example of the particular contribution of feminism to analysis of the legal system. The essays engage with, respond to and develop a variety of feminist perspectives upon law and demonstrate the enormous, challenging and exciting task ahead for feminist legal theorists. Jo Bridgeman Modern Law Review September 2002 Lacey exemplifies the best characteristics of British academic writing, namely, a sincere attempt to convey complex positions and arguments as clearly as possible and an uncompromising honesty about her own work which means that her critical gaze is as much directed at her own views as at others. Book SynopsisHow do you go about drafting an Act of Parliament? In this classic text, Lord Thing, the great Victorian Parliamentary Counsel, sets out the basic rules of the art and craft of creating legislation. Operating in a field where there are no concrete rules, Thring saw the need to formulate general rules of guidance for those inexperienced in the art of legislative drafting and published his work following his appointment as First Parliamentary Counsel. Much of what he says remains relevant now and so, this new edition presents it to a modern readership.Trade ReviewThring's Practical Legislation has been popular with legislative drafters for a long time. Book SynopsisJurisprudence, Fourth Edition commences with a comprehensive and in-depth account of the three main sources of jurisprudence: classical jurisprudence, substantive jurisprudence and adjunctive jurisprudence. Classical jurisprudence is a historical source of jurisprudence and traces the evolution of natural law and positive law to modern times. Substantive jurisprudence as the primary source of jurisprudence is comprised of the modern theories of naturalism and positivism, the juristic theories of Ronald Dworkin and American legal theory. Adjunctive jurisprudence as a secondary source of jurisprudence is comprised of socio-legal theory and historico-legal theory save only insofar as those theories recognise law as a social or historical phenomenon. This book also introduces and develops a new analytical concept of jurisprudence called the concept of juristic practice. This new concept may be applied when undertaking jurisprudential analyses of legal systems.Table of ContentsPART ONE: CLASSICAL JURISPRUDENCE Classical Naturalism Classical Positivism PART TWO: SUBSTANTIVE JURISPRUDENCE Modern Natural Law The Internal Morality of Law A Theory of Rules A System of Norms Dworkin’s Juristic Theories American Legal Theory PART THREE: ADJUNCTIVE JURISPRUDENCE Sociological Interpretation of Legal Theory German and French Socio-Legal Theory Historico-Legal Interpretations of Legal Systems Historical Constitutions and Social Contracts The Evolution of Common Law and Equity in Ireland PART FOUR: THE CONCEPT OF JURISTIC PRACTICE The Concept of Juristic Practice Substantive Legal Principles and Adjunctive Rules Substantive Equitable and Contractual Principles and Adjunctive Rules Substantive and Evidential Principles of Construction Exercises in Interpretative Methodology The Effect of Legal Rules The Composition and Classification of Criminal Rules Criminal Law and Morality A Programme for the Re-Vitalisation of Equity

    1 in stock

Book SynopsisThe vast size of the United States and extensive variation of its climate, topography, and biota across different regions contribute to both the richness of the nation‘s natural heritage and the complexities involved in managing its resources. A follow-up to RFF‘s popular America‘s Renewable Resources (1990), Perspectives on Sustainable Resources in America updates readers about the current challenges involved in managing America‘s natural resources, especially in light of the increasing emphasis on sustainability and ecosystem approaches to management. Written to inform general audiences and students, as well as to engage the interest of experts, the book includes assessments by some of the nation‘s most renowned scholars in natural resource economics and policy. An introductory chapter critically examines the concept of sustainability as it has been developed in recent years and asks how the concept might apply to individual resource systems. It considers the interrelatedness of ecosystem, economic, and social sustainability; the paradigms of resource sufficiency and functional integrity; and the contrast between weak and strong sustainability. The chapters that follow examine America‘s experience with forests, water, agricultural soils, and wildlife. Highlighting the adaptability and resilience of resource systems, each chapter provides a description of the physical characteristics of the resource, a history of its use, a policy history, and a review of ongoing debates in management and policy. Perspectives on Sustainable Resources in America concludes with an innovative treatment of biodiversity as a natural resource. The chapter reviews the definitions of biodiversity, the ecological and economic meanings of biodiversity, and current efforts to preserve biodiversity, especially through regulatory approaches.Trade Review'An insightful and provocative look at the evolving definition of resource sustainability, encompassing diverse resource uses, and essential ecosystem services along with commodity production. Its review of past trends and the current conditions of America‘s natural resources clearly illustrates the accelerating pace of change, and the growing challenge this poses for scientists and resource managers alike.' 1 in stock

Book SynopsisNon-governmental organizations (NGOs) play an increasingly prominent role in addressing complex environmental issues such as climate change, persistent bio-accumulative pollutants, and the conservation of biodiversity. At the same time, the landscape in which they operate is changing rapidly. Markets, and direct engagement with industry, rather than traditional government regulation, are often the tools of choice for NGOs seeking to change corporate behavior today. Yet these new strategies are poorly understood-by business, academics, and NGOs themselves. How will NGOs choose which battles to fight, differentiate themselves from one another in order to attract membership and funding, and decide when to form alliances and when to work separately? In Good Cop/Bad Cop, Thomas P. Lyon brings together perspectives on environmental NGOs from leading social scientists, as well as leaders from within the NGO and corporate worlds, to assess the state of knowledge on the tactics and the effectiveness of environmental groups. Contributions from Greenpeace, Rainforest Action Network, the Environmental Defense Fund, and the World Wildlife Fund describe each organization‘s structure and key objectives, and present case studies that illustrate how each organization makes a difference, especially with regard to its strategies toward corporate engagement. To provide additional perspective, high-level executives from BP and Ford share their views on what causes these relationships between companies and NGOs to either succeed or fail. For students of the social sciences and NGO practitioners, this book takes an important step in addressing an urgent need for objective study of NGO operations and their effectiveness.Trade Review'A unique and essential resource. This book is a must read for businesses and NGOs as we work to develop new collaborations to solve the worlds major challenges.' Neil C. Hawkins, Vice President of Sustainability and Environment, Health and Safety, The Dow Chemical Company 'NGOs - in various shapes and forms - play a critical role in the formation and implementation of environmental policy. This splendid volume weaves insights from different disciplinary backgrounds into a cohesive and compelling whole. An excellent book on an important topic, and I would commend it to anyone with a stake in understanding environmental policy in the 21st century.' • The First Fifteen: How Asian American Women

Rutgers University Press The First Fifteen: How Asian American Women

    1 in stock

Book SynopsisIn 1998, an Asian woman first joined the ranks of federal judges with lifetime appointments. It took ten years for the second Asian woman to be appointed. Since then, however, over a dozen more Asian women have received lifetime federal judicial appointments. This book tells the stories of the first fifteen. In the process, it recounts remarkable tales of Asian women overcoming adversity and achieving the American dream, despite being the daughters of a Chinese garment worker, Japanese Americans held in internment camps during World War II, Vietnamese refugees, and penniless Indian immigrants. Yet The First Fifteen also explores how far Asian Americans and women still have to go before the federal judiciary reflects America as a whole. In a candid series of interviews, these judges reflect upon the personal and professional experiences that led them to this distinguished position, as well as the nerve-wracking political process of being nominated and confirmed for an Article III judgeship. By sharing their diverse stories, The First Fifteen paints a nuanced portrait of how Asian American women are beginning to have a voice in determining American justice.Trade Review"The history and stories captured by Susan Oki Mollway not only preserve an important history of Asian American women in the federal judiciary, but also hopefully encourage more Asian American and other women to put themselves forward for nomination by demystifying the process. Out of stock

    3 in stock

    1 in stock

    2 in stock
