  • Cambridge University Press The Life of Hersch Lauterpacht

    15 in stock

Book SynopsisHersch Lauterpacht, of whom this book is an intimate biography by his son, Elihu, was one of the most prolific and influential international lawyers of the first half of the twentieth century. Having come to England from Austria in the early 1920s, he first researched and taught at the London School of Economics before moving to Cambridge in 1937 to become Whewell Professor of International Law. He did valuable work to enhance relations with the United States during the Second World War and was active after the war in the prosecution of William Joyce and the major Nazi war criminals. For ten years he was also involved in various significant items of professional work and in 1955 he was elected a judge of the International Court of Justice. The book contains many extracts from his correspondence, the interest of which will extend to lawyers, historians of the period and beyond.Trade ReviewReview of the hardback: 'Hersch Lauterpacht was widely and rightly regarded as the greatest international legal scholar of the twentieth century. His brilliant if too brief tenure as a judge of the International Court of Justice matched his scholarly attainments. His son Elihu has now written a superb biography of his father that will attract the admiration of the international legal fraternity of the twenty-first century.' Stephen M. Schwebel, Former President of the International Court of Justice (1981–2000)'Hersch Lauterpacht is a highly interesting subject, and the biography is well written. It should be of great interest not only to those who are interested in the history of international law, but to anyone who want to understand the travails and motivations of one of its major personalities, whose works still resonate.' 15 in stock

Book SynopsisIn this fully updated and revised edition, the authors explore the evolution, nature and function of international law in world politics and situate international law in its historical and political context. They propose three interdisciplinary 'lenses' (realist, liberal and constructivist) through which to view the role of international law in world politics and suggest that the concept of an international society provides the overall context within which international legal developments occur. These theoretical perspectives offer different ways of looking at international law in terms of what it is, how it works and how it changes. Topics covered include the use of force, international crimes, human rights, international trade and the environment. The new edition also contains more material on non-western perspectives, international institutions and non-state actors and a new bibliography. Each chapter features discussion questions and guides to further reading.Table of ContentsPreface to the second edition; Introduction; Part I. The Foundations: 1. The nature of international law; 2. Book SynopsisJürgen Kurtz addresses the growing connections between international trade and investment law, proposing a theoretically grounded and doctrinally tractable framework to understand the deepening relationship between them. This book also offers reform ideas and possibilities, which will be of interest to treaty negotiators and other government officials.Trade Review'Professor Kurtz's book is a stimulating and evocative treatment of a field of contemporary and growing importance. His thorough scholarship impresses, and his analysis and insight both inform and challenge. This is a very important work.' Donald McRae, Jerusalem Review of Legal Studies'The WTO and International Investment Law by Professor Jürgen Kurtz is without a doubt the most comprehensive and thorough study to date of the evolving relationship between international trade law and international investment law. It is magisterial in its scope, covering a broad range of international disputes (within the World Trade Organization) and relevant investor-state arbitrations. It engages with both trade law, and investment protection law, each on its own terms, with a fluency of discourse that will surely be appreciated by scholars and practitioners in both fields … [It] will be the standard against which all academic forays into this area of regime interaction will be measured.' Tomer Broude, Jerusalem Review of Legal Studies'Without doubt, this book is a comprehensive and stimulating study by an expert in both fields that will deepen understanding of the relationship between trade and investment. The author masterfully brings together discourses that are taking place between scholars and practitioners in each regime but frequently in relative isolation from each other.' Rhea T. Hoffmann, European Journal of International Law'… remarkable for the richness of its approach, covering both black letter law and doctrine as well as the conceptual and historical context of the converging, overlapping and still diverging systems - which makes for a book valuable even to those outside the immediate fields treated.' Out of stock

Book SynopsisFrom 1948 to 1966, the United Nations worked to create a common legal standard for human rights protection around the globe. Resisting Rights traces the Canadian government's changing policy toward this endeavour, from initial opposition to a more supportive approach. Jennifer Tunnicliffe takes both international and domestic developments into account to explain how shifting cultural understandings of rights influenced policy, and to underline the key role of Canadian rights activists in this process. In light of Canada's waning reputation as a traditional leader in developing human rights standards at the United Nations, this is a timely study. Tunnicliffe situates policies within their historical context to reveal that Canadian reluctance to be bound by international human rights law is not a recent trend, and asks why governments have found it important to foster the myth that Canada has been at the forefront of international human rights policy.Trade ReviewTunnicliffe weaves primary sources including parliamentary debates with private and public archival materials and secondary sources to produce a fascinating reflection. -- Charlotte Skeet, University of Sussex * British Journal of Canadian Studies *Table of ContentsIntroduction: Resisting Rights 1 The Roots of Resistance: Canada and the Universal Declaration of Human Rights2 Canada’s Opposition to a Covenant on Human Rights 3 A Reversal in Policy: The Decision to Support the Covenants 4 The Road to Ratification, 1966–765 Conclusion: The Making of the MythAppendicesNotesBibliographyIndex

Book SynopsisDuring the Nuremberg trials, Leon Goldensohn—a U.S. Army psychiatrist—monitored the mental health of two dozen Germans leaders charged with carrying out genocide. These recorded conversations went largely unexamined for more than fifty years, until Robert Gellately—one of the premier historians of Nazi Germany—made them available to the public in this remarkable collection.  Here are interviews with the likes of Hans Frank, Hermann Goering, Ernst Kaltenbrunner, and Joachim von Ribbentrop—the highest ranking Nazi officials in the Nuremberg jails. Here too are interviews with lesser-known officials essential to the inner workings of the Third Reich. Candid and often shockingly truthful, The Nuremberg Interviews is a profound addition to our understanding of the Nazi mind and mission.
