Sie gibt einen Einblick in die jëngste Geschichte des politischen Raumes in Europa als Teil des globalen Wandels der politisch-räumlichen Ordnung. Zum Gegenstand ihrer Untersuchung wählt sie dabei nicht nur die Grenz-, Migrations- und Europäische Nachbarschaftspolitik der EU, sondern auch die polnische Ost- und Europapolitik sowie die transnationale Zusammenarbeit in der polnisch-ukrainischen Grenzregion. Dabei zeigt sich, dass die EU den Entwurf ihrer Grenze mitder Schaffung eines Ergänzungsraums verband. Diesen konnte die Union nicht allein gestalten, vielmehr beanspruchten Akteure innerhalb und außerhalb der Union, auf der nationalen wie der regionalen Ebene, Mitsprache. Insbesondere Polen - zunächst Außenseiter - konnte sich als Trendsetter einer neuen EU-Ostpolitik präsentieren.

    Book SynopsisEven though the Constitution proclaims treaties entered into by the United States to be part of the supreme law of the land and authorises prosecution of offences against the law of nation in federal courts, the United States has had a checkered record in ratifying human rights instruments, in upholding decisions of international tribunals, and indeed in submitting itself to the jurisdiction of such tribunals. It refused to uphold judgments of the International Court of Justice within its municipal legal system, terminated the competence of the ICJ to adjudicate international disputes to which it is a party, and attempted to undermine the functioning of the international criminal court. It engaged in armed conflicts in blatant violation of international humanitarian law and subjected belligerent detainees to unbecoming interrogation techniques. The study shows that Framework Decision 2009/948/JI fails to satisfactorily protect the legal interests of individuals but also of the EU member states, and is unable to fulfil the requirements of the area of freedom, security and justice. The study presents a draft model for the distribution of responsibilities among the EU member states. The aim of the model is the foreseeable determination of the criminal legislation applicable to certain conduct, whereby state value-based decisions not to deem conduct as punishable are also acknowledged on the principle of territoriality.
