Peter Lang AG Implementation of International Law in the United
Book SynopsisEven though the Constitution proclaims treaties entered into by the United States to be part of the supreme law of the land and authorises prosecution of offences against the law of nation in federal courts, the United States has had a checkered record in ratifying human rights instruments, in upholding decisions of international tribunals, and indeed in submitting itself to the jurisdiction of such tribunals. It refused to uphold judgments of the International Court of Justice within its municipal legal system, terminated the competence of the ICJ to adjudicate international disputes to which it is a party, and attempted to undermine the functioning of the international criminal court. It engaged in armed conflicts in blatant violation of international humanitarian law and subjected belligerent detainees to unbecoming interrogation techniques. There are clear indications that the Obama administration is setting the United States on a new course of international comity and Völkerrechtsfreundlichkeit.Table of ContentsContents: American foreign policy – Prosecuting offences against the law of nations – Ratification of international human rights instruments – A juvenile justice system that violates international standards of rights of the child – A hostile attitude toward jurisprudence of international tribunals – American exceptionalism and the international criminal court – Military interventions in Kosovo, Afghanistan and Iraq.

Book SynopsisThe author examines the basic principles of the extent of state penal power as well as the causes and legal facets of criminal jurisdictional conflicts. The study shows that Framework Decision 2009/948/JI fails to satisfactorily protect the legal interests of individuals but also of the EU member states, and is unable to fulfil the requirements of the area of freedom, security and justice. The study presents a draft model for the distribution of responsibilities among the EU member states. The aim of the model is the foreseeable determination of the criminal legislation applicable to certain conduct, whereby state value-based decisions not to deem conduct as punishable are also acknowledged on the principle of territoriality.

Peeters Publishers A Philosophy of European Union Law
Book SynopsisIs the European Union a new Walden? Although a contrast in form and format, the Union is surprisingly close to the latter's underlying philosophy. One can read this proximity in the Treaties or the many facets of the European idea which mirrors in the Union's emerging legal system. Today there is no longer a Union of a limited number of Nation States desiring to end divisions among themselves, to acquire mutual respect and prosperity or a higher standard of living and working conditions for its members. European citizenship shows a global orientation and is in continuous competition with the discourse of a globalizing economy and its Internet democracy. Analyses of concepts such as political geography, global, (supra)national and regional citizenship, democracy, learning society, native tongue and market lead to the insight that the Union's legal system wishes to ensure its citizens a legally engendered, formatted and protected global position for action. Walden's philosophy has a new face. Jan M. Broekman is Professor Emeritus Contemporary Philosophy and Philosophy of Law, KU Leuven, Philosophy of Medicine and Medical Ethics, Free University Amsterdam, and Honorary Professor Universidad Nacional de Argentina in Mar del Plata. He is visiting Professor of Law at the University of Illinois College of Law, Champaign/Urbana, USA.
