  • The Law and Practice of Expulsion and Exclusion

Bloomsbury Publishing PLC The Law and Practice of Expulsion and Exclusion

Book SynopsisResort by the state to measures of exclusion and expulsion from the territory of the UK and/or from British citizenship have multiplied over the past decade, following the so-called ‘War on Terror’, increased globalisation, and the growing politicisation of national policies concerning immigration and citizenship. This book, which focuses on the law and practice governing deportation, removal and exclusion from the UK, the denial of British citizenship, and deprivation of that citizenship, represents the first attempt by practitioners to provide a cohesive assessment of UK law and practice in these areas. The undertaking is a vital one because, whilst these areas of law and practice have long existed as the hard edge of immigration and nationality laws, in recent years the use of some powers in this area has greatly increased and such powers have arguably expanded beyond secondary existence as mere mechanisms of enforcement. The body of law, practice and policy created by this process is one which justifies treatment as a primary concern for public lawyers. The book provides a comprehensive analysis of the law in these areas and its background. This involves a consideration of interlocking international and regional rights instruments, EU law and the domestic regime. It is a clear and comprehensive everyday guide for practitioners and offers an invaluable insight into likely developments in this dynamic area of public law. ‘...deserves to be on the bookshelves of all those who seek to practise within this carefully defined area of immigration and nationality law.’ From the Foreword by Lord Hope of Craighead KTTrade ReviewOverall, The Law and Practice of Expulsion and Exclusion from the United Kingdom provides an analytical and comprehensive legal account of the relevant law and practice in areas of deportation, removal, and exclusion from the UK, and the denial and deprivation of British citizenship -- Amanda Spalding * Border Criminologies *[This is] a detailed and exhaustive guide to the law as it currently stands in this fascinating and politically sensitive area. Editor Eric Fripp and deputy editors Rowena Moffatt and Ellis Wilford are experienced practitioners who regularly appear before the Immigration and Asylum chambers and the senior courts – as such they are able to give practical and not merely academic guidance. The comprehensive and practical nature of this text shines through from the outset. The book is to be commended for an analysis that seeks to look not only at the law as it stands but also, albeit in neutral fashion, at the political context in terms of the rationale and intentions of government… It is a forensic work of real authority and a triumph not only for the editors but for the team of expert contributors from Lamb Building. -- Julian Phillips (Designated Judge and Training Judge of the First-tier Tribunal (Immigration and Asylum Chamber) * Tribunals *It is not really possible for a lawyer to give a book higher praise than to say that it is genuinely useful and provides new insight, which is what I have found… Eric's excellent preface is full of very quotable text… I think the book is going to have a significant impact on jurisprudential thinking. -- Colin Yeo * Free Movement Blog *It is a clear and comprehensive everyday guide for practitioners, and offers an invaluable insight into likely developments in this dynamic area of public law. -- ImmigrationProf Blog * Kevin R Johnson *Table of ContentsPart A: Background 1. • Brill The External Dimension of the EU’s Migration

    Out of stock

Book SynopsisIn recent years the EU has been active in developing a common European immigration policy in cooperation with third countries and in building an “external dimension” of such an EU policy. The linkages between the EU’s external relations and migration policies have influenced the distinct legal positions of third-country nationals (non-EU nationals). This book critically discusses whether the EU’s objective of creating a common EU migration policy can be achieved against the backdrop of a highly fragmented EU framework for migration law and policy, and it argues that it is difficult to speak of one single, unitary group of third-country nationals forming the counterpart to EU citizens.Table of ContentsPart I: Introduction; Part II: EU External Relations and Migration Policy – The Historical Development of the External Dimensions; Part III: The Human Rights of Migrants: Legal Bases and Sources for EU Migration Law and Policy; Part IV: The Basis for Differential Treatment among Third-Country Nationals: EU Association Agreements and Cooperation Frameworks; Part V: The Legal Position of Third-Country Nationals: Entry, Employment and Residence Rights; Part VI: The Legal Position of Third-Country Nationas: Social Security Rights; Part VII: The Legal Position of Third-Country Nationals: Other Economic and Social Rights; Part VIII: Conclusions; Part IX: Schematic Overview of the Legal Position of Third-Country Nationals; Part X: Samenvatting; Part XI: Zusammenfassung; Part XII: Bibliography; Part XIII: EU Official Documents, Table of Cases and Index.

  • Border Deaths: Causes, Dynamics and Consequences

Amsterdam University Press Border Deaths: Causes, Dynamics and Consequences

    Out of stock

Book SynopsisBorder deaths are a result of dynamics involving diverse actors, and can be interpreted and represented in various ways. Critical voices from civil society (including academia) hold states responsible for making safe journeys impossible for large parts of the world population. Meanwhile, policy-makers argue that border deaths demonstrate the need for restrictive border policies. Statistics are widely (mis)used to support different readings of border deaths. However, the way data is collected, analysed, and disseminated remains largely unquestioned. Similarly, little is known about how bodies are treated, and about the different ways in which the dead - also including the missing and the unidentified - are mourned by familiars and strangers. New concepts and perspectives contribute to highlighting the political nature of border deaths and finding ways to move forward. The chapters of this collection, co-authored by researchers and practitioners, provide the first interdisciplinary overview of this contested field.Table of ContentsAcknowledgements Preface.
