Financial law: general Books
Edward Elgar Publishing Ltd Secured Credit and the Harmonisation of Law: The
Book SynopsisThis is a discerning analysis of international harmonization efforts for secured credit law and examines the role of globalization and finance capital in shaping such efforts.Gerard McCormack reveals how an 'efficient' law is often seen to increase the availability, and lower the cost, of credit, thereby contributing to international development. He considers whether the most comprehensive international standard the United Nations Commission on International Trade Law (UNCITRAL) Legislative Guide (2008) is actually suitable for adoption at the national level. In particular, he examines the hypothesis that American law and lawyers have shaped the content of the guide to the extent that it is not suitable for translation into other laws. This book will be of great interest to practitioners, policy makers and academics, as well as students, particularly postgraduate students, of law and business throughout the world.Contents: Preface 1. Edward Elgar Publishing Ltd Virtual Economies and Financial Crime: Money
Book SynopsisVirtual economies and financial crime are ever-growing, increasingly significant facets to banking, finance and anti-money laundering regulations on an international scale. In this pathbreaking and timely book, these two important issues are explored together for the first time in the same place. Clare Chambers-Jones examines the jurisprudential elements of cyber law in the context of virtual economic crime and explains how virtual economic crime can take place in virtual worlds. She looks at the multi-layered and interconnected issues association with the increasing trend of global and virtual banking via the 'Second Life' MMOG (Massively Multiplayer Online Game). Through this fascinating case study, the author illustrates how virtual worlds have created a second virtual economy which transgresses into the real, creating economic, political and social issues. Loopholes used by criminals to launder money through virtual worlds (given the lack of jurisdictional consensus on detection and prosecution) are also highlighted. The importance of providing legal clarity over jurisdictional matters in cyberspace is an increasing concern for policy makers and regulators, and this book provides a wealth of information on new aspects of cyber law and virtual economics. As such, it will prove essential reading for academics, students, researchers and policy makers across the fields of law generally, and more specifically, financial law and regulation, finance, money and banking, and economic crime.Table of ContentsContents: 1. Edward Elgar Publishing Ltd Fiscal Reforms in the Least Developed Countries
Book SynopsisFiscal reforms have been an integral and essential component of the structural adjustment programmes implemented in the least developed countries (LDCs) since the 1980s. The need for fiscal reform in the LDCs was motivated by the accumulation of unsustainable fiscal deficits, constraints on the availability of external finance, the adverse impact of distortionary tax systems on economic efficiency and deficiencies in public administration. Fiscal reform in the LDCs encompassed deficit reduction, the restructuring of the tax system, and the reform of public administration and public expenditures. The empirical research in this volume provides an analysis of the experience of the fiscal reforms carried out since the early 1980s in four different LDCs - Bangladesh, The Gambia, Malawi and the United Republic of Tanzania. The case studies examine the nature and budgetary impact of the fiscal reforms in these countries, assess the extent to which reforms have achieved their objectives and discuss the major obstacles to the success of fiscal reform. The empirical studies are supplemented by a chapter outlining the contribution which economic theory can make to the design of optimal tax and expenditure systems in developing countries and to the implementation of fiscal reforms. An overview chapter, which also serves as an introduction to the volume, discusses the reasons why LDCs have embarked on fiscal reforms, summarizes the salient findings of the country case studies and assesses the lessons which can be learnt from these empirical studies.Trade Review'This book provides a sound analysis of the experiences of the selected countries. It underscores the developmental debate on the necessity of supporting fiscal policy reforms by promoting administration and human capacity-building. The analysis also delivers important suggestions for the focal points of future development cooperation.' -- Susanne Giwer, Development and CooperationTable of ContentsContents: Preface 1. West Academic Publishing Regulation of Cryptoassets
Book SynopsisThe materials in this book are designed to look at cryptoassets and the expanding world of cryptotransactions to examine the regulatory regimes surrounding these assets and markets and how those regimes are developing. Because the technology behind and legal reaction to crypto are evolving so rapidly and are still in the early stages, it is not possible to create a traditional casebook that focuses only on settled judicial opinions to illustrate relevant legal issues and rules. These materials therefore look at various statutes, rules, and regulatory structures that predate the advent of crypto along with mission and informational statements promulgated by the agencies most closely involved with regulation of cryptoassets and cryptotransactions. The book also covers recent administrative and judicial decisions addressing crypto-related issues and involving cryptoasset and fintech firms, as well as a range of other materials such as pleadings, briefs, agency guidelines and proposed regulations, and academic commentary. The book examines a broad range of regulatory regimes, and although it focuses primarily on U.S. federal law, it also introduces applicable state law, international law, and European Union law.

JCB Mohr (Paul Siebeck) Regulation between Legal Norms and Economic
Book SynopsisCurrently, the terms regulation and deregulation are on everyone's lips. However, historical attempts to solve the problem of natural monopolies ranged between two extremes. On the one hand there was the government regulation of private companies in the U.S., and on the other hand there was government provision or nationalization of companies in Germany and most of continental Europe. At the interface between legal and economic history, this volume, the result of a German-American conference, focuses on the regulation of natural monopolies in network industries such as railways, energy or telecommunications. It analyzes constitutional and legal frameworks and investigates the development of markets and the political influence exerted by market participants. All historical moments lead to broader questions about regulation in its cultural-historical context, including the general principles underlying public regulatory policy in law, economics and society - as well as existing path dependences. Hence, the volume provides a transnational and intercultural dialogue about the different characteristics and cultural interpretations of markets and market economies as well as their roles in society.

JCB Mohr (Paul Siebeck) Lauterkeitsrechtliche Grenzen kommunikativer
