Armed interventions in Libya, Haiti, Iraq, Vietnam, and Korea challenged the US president and Congress with a core question of constitutional interpretation: does the president, or Congress, have constitutional authority to take the country to war? War Powers argues that the Constitution doesn't offer a single legal answer to that question. But its structure and values indicate a vision of a well-functioning constitutional politics, one that enables the branches of government themselves to generate good answers to this question for the circumstances of their own times. After The Tale of Genji (c. 1000), the greatest work of classical Japanese literature is the historical narrative The Tale of the Heike (13th-14th centuries). In addition to opening up fresh perspectives on the Heike narratives, this study also draws attention to a range of problems centered on the interrelationship between narrative, ritual space, and Japan's changing views of China as they bear on depictions of the emperor's authority, warriors, and marginal population going all the way back to the Nara period. By situating the Heike in this long temporal framework, the author sheds light on a hidden history of royal authority that was entangled in Daoist and yin-yang ideas in the Nara period, practices centered on defilement in the Heian period, and Buddhist doctrines pertaining to original enlightenment in the medieval period, all of which resurface and combine in Heike's narrative world. In introducing for the first time the full range of Heike narrative to students and scholars of Japanese literature, the author argues that we must also reexamine our understanding of the literature, ritual, and culture of the Heian and Nara periods.

This comment is one of the many recorded in this book, a study of how women's views of television and the media relate to their personal stance on abortion. Over four years, Andrea Press and Elizabeth Cole watched television with women, visiting city houses, suburban subdivisions, modern condominiums, and public housing projects. They found that television depicts abortion as a problem for the poor and the working classes, and that viewers invariably referred to class when discussing abortion. Pro-life women from various classes were unified in their rejection of materialist values. Like the woman who identified with Donna Reed minus the pearls, this group strongly believed that a reduced family income was worth the sacrifice in order to stay home with children. Pro-life women also shared a general suspicion of the media as a source of information, turning to science instead to validate their biblically derived worldview. Pro-choice women's beliefs, however, were divided along class lines. Working-class women defended choice because they viewed themselves as a group whose interests are continually threatened by legal authorities. In contrast, middle-class women argued for individual rights and thought abortion necessary for those who aren't financially ready. Many middle-class pro-choice women, the authors argue, share the same point of view as displayed on television. This book seeks to clarify the rhetoric surrounding the abortion debate and allows the reader to hear how ordinary women discuss one of America's most volatile issues.

This is the first full-length study in English of Peng Zhen (1902-97), a revolutionary comrade of Mao Zedong and Deng Xiaoping, and an influential legal policymaker in China during both men’s regimes. As one of the chief architects of PRC law and legal institutions during the 1950s and again in the 1980s, Peng left an indelible mark on the present legal system of China. This book analyzes the evolution of Peng’s legal views from his days as a revolutionary in the 1930s and 1940s, through his participation in Communist rule during the 1950s, to his conflicts with Mao and his purge in 1966, and finally to his rehabilitation and resumption of legal reform activities in the 1980s and 1990s. Initially, Peng embraced Leninist notions of law and political authority. These ideas gradually evolved so that in the 1980s Peng advocated increased reliance on formal rules and procedures as mechanisms of governance.

In the twelfth century these introductions were anthologised, referred to now as Accessus ad auctores. They served as the first handbooks of literary criticism. The earliest and most comprehensive example, Bayerische Staatsbibliothek, Clm 19475, saec. XII,is presented here for the first time in a faithful critical edition, with a new translation and explanatory notes addressing different aspects of the text. Despite its pervasive reputation as a place of religious extremes and war, Afghanistan has a complex and varied religious landscape where elements from a broad spectrum of religious belief vie for a place in society. It is also one of the birthplaces of a widely practiced variant of Islam: Sufism. Contemporary analysts suggest that Sufism is on the decline due to war and the ideological hardening that results from societies in conflict. However, in Sufi Civilities, Annika Schmeding argues that this is far from a truthful depiction. Members of Sufi communities have worked as resistance fighters, aid workers, business people, actors, professors, and daily workers in creative and ingenious ways to keep and renew their networks of community support. Based on long-term ethnographic field research among multiple Sufi communities in different urban areas of Afghanistan, the book examines navigational strategies employed by Sufi leaders over the past four decades to weather periods of instability and persecution, showing how they adapted to changing conditions in novel ways that crafted Sufism as a force in the civil sphere. In this study of motives and arguments in Jesus' halakic conflicts, Thomas Kazen suggests a way out of the present methodological impasse in the use of traditional criteria of authenticity in historical Jesus research, at least when it comes to those Jesus traditions that relate to halakic issues. Kazen employs results from recent research on the development of halakah during the Second Temple period, in particular from Aharon Shemesh's discussion of two models (developmental and reflective) for explaining halakic development within and between various Jewish movements, and three areas of tension for analyzing dissenting views (revelation vs. interpretation, Scripture vs. tradition, and nominalism vs. realism). Kazen revisits the Synoptic conflict narratives about Sabbath observance, purity rules and divorce practices, and discusses motives and arguments ascribed to Jesus, whether implicitly or explicitly, by the texts themselves, or by modern interpreters. By combining analyses of halakic development with tradition and redaction criticism, Kazen disentangles theological motives from reasonable historical explanations and suggests relative dates and contexts for motives and arguments often ascribed to Jesus. He questions interpretations which focus on unique individual or halakic authority and suggests that the earliest Jesus tradition appeals to the priority of human need and to creational intent, viewing revelation as based on plain reading and a realistic understanding of Scripture. Jesus' stance is best explained within the framework of prophetic criticism and a traditional Israelite understanding of Torah. With this work the author contributes as much to our understanding of halakic development during the Second Temple and Tannitic periods as he does to our understanding of the historical Jesus and his relationship to contemporary movements.

They have shelled residential areas and committed extrajudcial executions. Palestinian armed groups and individuals have deliberately killed Israeli civilians by placing bombs in crowded places and in drive-by shootings.Amnesty International has repeatedly called on Israeli authorities to abide by international human rights standards and urged the Palestinian Authority and armed groups to act in accordance with humanitarian law. It has also called on the international community to take action necessary to ensure respect for human rights in the region.

In Collaborative Learning, Kenneth Bruffee advocates a far-reaching change in the relations we assume between college and university professors and their students, between the learned and the learning. He argues that the nature and source of the authority of college and university professors is the central issue in college and university education in our time, and that if college and university professors continue to teach exclusively in the stand-up-and-tell-'em way, their students will miss the opportunity to learn mature, effective interdependence-and this, Bruffee maintains, is the most important lesson we should expect students to learn. The book makes three related points. First, we should begin thinking about colleges and universities, and they should begin thinking about themselves, not as stores of information but as institutions of reacculturation. Second, we should think of college and university professors not as purveyors of information but as agents of cultural change who foster reacculturation by marshaling interdependence among student pers. And third, colleges and universities should revise longstanding assumptions about the nature and authority of knowledge and about classroom authority. To accomplish this, the author maintains, both college students and their professors must learn collaboratively. Describing the practical value of the activities encouraged by a collaborative approach-students working in consensus groups and research teams, tutoring peers, and helping each other with editing and revision-Bruffee concludes that, in the short run, collaborative learning helps students learn better-more thoroughly, more deeply, more efficiently-than learning alone. In the long run, collaborative learning is the best possible preparation for the real world, as students look beyond the authority of teachers, practice the craft of interdependence, and construct knowledge in the very way that academic disciplines and the professions do. With no loss of respect for the value of expertise, students learn to depend on one another, rather than depending exclusively on the authority of experts and teachers. In the second edition of this widely respected work, the argument is sharply focused on the need to change college and university education top to bottom, and the need to understand knowledge differently in order to accomplish that change. ON THE SOCIAL CONSTRUCTION OF KNOWLEDGE: Remember the time Aunty Molly sat on the Thanksgiving turkey? Tell such a story at a family party and family members follow the story easily and get the point, because they are all members of the same small knowledge community. They know the people and the situation thoroughly, and they understand the family's private references. But try to tell the same story to neighbors or colleagues. For them to follow the story and get the point, you have to explain a lot of obscure details about family events and personalities that they're not familiar with. That is, when a smaller community sets out to integrate itsuelf into a larger one, the level of discourse has to change. The story changes and even its meaning changes as it becomes a constituting narrative of a larger and more complex community. The main purpose of college or university education is to help older adolescents and adults renegotiate their membership in that encompassing common culture. The foundational knowledge that shapes us as children sooner or later circumscribes our lives. We never entirely outgrow the local, foundational knowledge communities into which we are born. But for most people, the need to cope to one degree or another with the diversity and complexity of human life beyond the local and familiar does outgrow knowledge that is familiar and (locally) foundational. ON POSTGRADUATE EDUCATION: The problem is not that graduate professors do not know what they need to know. The problem is that most of them have learned what they know entirely under the traditional social conditions of academic alienation and aggression. Indeed, the problem is that mmbers of current graduate faculties were selected into the profession in part because they evidenced those traits. As a result, their fine education and superb reputations as scholars and critics may in some cased actually subvert their ability to understand knowledge as a social construct, learinng as an adult social process, and teaching as a role of leadership among adults.

Setting Aside All Authority is an important account and analysis of seventeenth-century scientific arguments against the Copernican system. Christopher M. Graney challenges the long-standing ideas that opponents of the heliocentric ideas of Copernicus and Galileo were primarily motivated by religion or devotion to an outdated intellectual tradition, and that they were in continual retreat in the face of telescopic discoveries. Graney calls on newly translated works by anti-Copernican writers of the time to demonstrate that science, not religion, played an important, and arguably predominant, role in the opposition to the Copernican system. Anti-Copernicans, building on the work of the Danish astronomer Tycho Brahe, were in fact able to build an increasingly strong scientific case against the heliocentric system at least through the middle of the seventeenth century, several decades after the advent of the telescope. The scientific case reached its apogee, Graney argues, in the 1651 New Almagest of the Italian Jesuit astronomer Giovanni Battista Riccioli, who used detailed telescopic observations of stars to construct a powerful scientific argument against Copernicus. Setting Aside All Authority includes the first English translation of Monsignor Francesco Ingoli’s essay to Galileo (disputing the Copernican system on the eve of the Inquisition’s condemnation of it in 1616) and excerpts from Riccioli's reports regarding his experiments with falling bodies.

That standard analysis would utterly fail to recognize and understand the grassroots realities of Suphanburi that Nishizaki has captured in his study. This compassionate, well-grounded analysis challenges simplistic perceptions of rural Thai voters and raises vital questions about contemporary democracy in Thailand.

Combining literary and philosophical analysis, this study defends an utterly innovative reading of the early history of poetics. It is the first to argue that there is a distinctively Socratic view of poetry and the first to connect the Socratic view of poetry with earlier literary tradition. Literary theory is usually said to begin with Plato's famous critique of poetry in the Republic. Grace Ledbetter challenges this entrenched assumption by arguing that Plato's earlier dialogues Ion, Protagoras, and Apology introduce a distinctively Socratic theory of poetry that responds polemically to traditional poets as rival theorists. Ledbetter tracks the sources of this Socratic response by introducing separate readings of the poetics implicit in the poetry of Homer, Hesiod, and Pindar. Examining these poets' theories from a new angle that uncovers their literary, rhetorical, and political aims, she demonstrates their decisive influence on Socratic thinking about poetry. The Socratic poetics Ledbetter elucidates focuses not on censorship, but on the interpretation of poetry as a source of moral wisdom. This philosophical approach to interpreting poetry stands at odds with the poets' own theories--and with the Sophists' treatment of poetry.
