In 1990, a year before the Zapatistas’ armed revolt, Wendy Ewald was invited to conduct photography classes for Mayan, Ladino, and Tzotzil children living in Chiapas, the southernmost province of Mexico. The sponsoring organization was the Mayan writers’ cooperative, Sna Jtz-ibajom (The House of the Writers). While cameras and camcorders were hardly novelties in Chiapas, they were generally used by tourists whose picture-taking reinforced their own cultural biases. Ewald did not take pictures; instead she guided her students in taking their own pictures of their daily lives, dreams, desires, and fantasies. These briefs resonated with the importances held by dreams in Mayan culture, which considers them as real as waking life. The resulting project, The Devil is leaving his Cave, is a unique insight into the everyday realities of life in Mayan communities just before the devastation of the Zapatista uprising. This book brings together Ewald’s original project with new work made in collaboration with fifteen young Mexican Americans living in Chicago, coordinated with the help of Centro Romero, an immigrant service organisation. These images respond to many of the same subjects as those by Ewald’s 1990s students, with an emphasis now on capturing inner lives and dreams as a way of reckoning with the unvoiced experiences of immigration. The themes of restriction and self-reflection that emerged from this new work were intensified by being made in part under COVID lockdown. Together, the Chiapas and Chicago projects trace the differences between growing up in different Mexican geographies with diverse histories, while holding on to the universal joys and sorrows of childhood.

From the seventeenth century into the nineteenth, thousands of Madagascar’s people were brought to American ports as slaves. In Memories of Madagascar and Slavery in the Black Atlantic, Wendy Wilson-Fall shows that the descendants of these Malagasy slaves in the United States maintained an ethnic identity in ways that those from the areas more commonly feeding the Atlantic slave trade did not. Generations later, hundreds, if not thousands, of African Americans maintain strong identities as Malagasy descendants, yet the histories of Malagasy slaves, sailors, and their descendants have been little explored. Wilson-Fall examines how and why the stories that underlie this identity have been handed down through families—and what this says about broader issues of ethnicity and meaning-making for those whose family origins, if documented at all, have been willfully obscured by history. By analyzing contemporary oral histories as well as historical records and examining the conflicts between the two, Wilson-Fall carefully probes the tensions between the official and the personal, the written and the lived. She suggests that historically, the black community has been a melting pot to which generations of immigrants—enslaved and free—have been socially assigned, often in spite of their wish to retain far more complex identities. Innovative in its methodology and poetic in its articulation, this book bridges history and ethnography to take studies of diaspora, ethnicity, and identity into new territory.

From 1789 to 1913, U.S. senators were not directly elected by the people--instead the Constitution mandated that they be chosen by state legislators. This radically changed in 1913, when the Seventeenth Amendment to the Constitution was ratified, giving the public a direct vote. Electing the Senate investigates the electoral connections among constituents, state legislators, political parties, and U.S. senators during the age of indirect elections. Wendy Schiller and Charles Stewart find that even though parties controlled the partisan affiliation of the winning candidate for Senate, they had much less control over the universe of candidates who competed for votes in Senate elections and the parties did not always succeed in resolving internal conflict among their rank and file. Party politics, money, and personal ambition dominated the election process, in a system originally designed to insulate the Senate from public pressure. Electing the Senate uses an original data set of all the roll call votes cast by state legislators for U.S. senators from 1871 to 1913 and all state legislators who served during this time. Newspaper and biographical accounts uncover vivid stories of the political maneuvering, corruption, and partisanship--played out by elite political actors, from elected officials, to party machine bosses, to wealthy business owners--that dominated the indirect Senate elections process. This book focuses on Michel Foucault's late work on rights in order to address broader questions about the politics of rights in the contemporary era. As several commentators have observed, something quite remarkable happens in this late work. In his early career, Foucault had been a great critic of the liberal discourse of rights. Suddenly, from about 1976 onward, he makes increasing appeals to rights in his philosophical writings, political statements, interviews, and journalism. He not only defends their importance; he argues for rights new and as-yet-unrecognized. Does Foucault simply revise his former positions and endorse a liberal politics of rights? Ben Golder proposes an answer to this puzzle, which is that Foucault approaches rights in a spirit of creative and critical appropriation. He uses rights strategically for a range of political purposes that cannot be reduced to a simple endorsement of political liberalism. Kellogg examines the early diaries, reading, and writings of Justice Oliver Wendell Holmes, Jr. (1841-1935) to assess his contribution to both legal logic and general logical theory. Through discussions with his mentor Chauncey Wright and others, Holmes derived his theory from Francis Bacon's empiricism, influenced by recent English debates over logic and scientific method, and Holmes's critical response to John Stuart Mill's 1843 A System of Logic. Conventional legal logic tends to focus on the role of judges in deciding cases. Holmes recognized input from outside the law--the importance of the social dimension of legal and logical induction: how opposing views of "many minds" may converge. Drawing on analogies from the natural sciences, Holmes came to understand law as an extended process of inquiry into recurring problems. Rather than vagueness or contradiction in the meaning or application of rules, Holmes focused on the relation of novel or unanticipated facts to an underlying and emergent social problem. Where the meaning and extension of legal terms are disputed by opposing views and practices, it is not strictly a legal uncertainty, and it is a mistake to expect that judges alone can immediately resolve the larger issue.
