Edward Elgar Publishing Ltd Public Health and Plain Packaging of Cigarettes: Legal Issues
Tobacco use represents a critical global health challenge. The World Health Organization estimates that tobacco kills nearly 6 million people a year, with the toll expected to rise to 8 million annually over the next two decades. The book offers an in-depth exploration of relevant domestic and international legal questions in fields such as intellectual property, constitutional law, health, trade and investment. The authors' analysis sheds light on broader questions relating to the capacity of governments to regulate tobacco products and the tobacco industry, and to regulate in the interests of public health more generally. The answers to these questions are of vital interest not only to Australia but also to the international community, with states' regulatory sovereignty increasingly being challenged in local and international courts and tribunals. This insightful book portrays in detail everyday work in three news agencies: Swedish TT, Italian ANSA and the worldwide Reuters. Edward Elgar Publishing Ltd Legal Origin Theory
In this volume, Professor Deakin and Professor Pistor include those key articles which highlight the major contributions to, but also the inherent limits of, the legal origin literature. They consider the merits of this approach in the context of three fields of inquiry: the study of comparative law; the analysis of the relation between law and markets; and the understanding of the role of legal systems in social ordering. In their thought-provoking new introduction, the editors discuss the modifications to the original legal origin hypothesis over time and point the way for the future development of this influential, yet controversial, theory.

Edward Elgar Publishing Ltd A Handbook of Globalisation and Environmental Policy, Second Edition: National Government Interventions in a Global Arena
'The Handbook of Globalisation and Environmental Policy is a very important book. More than 40 experienced authors, including some of the most important international thought leaders of our time, have confronted a crucial question: How can and should national governments come to grips with the need for global action on a wide range of increasingly urgent environmental challenges that exceed their authority and capability? Through close examination of numerous case studies, a balanced perspective that takes government, business and civil society into account, and fresh interdisciplinary thinking about a range of policy tools, the Handbook offers a treasure-trove of new concepts and new perspectives. The authors conclude that by acknowledging the ongoing erosion of national sovereignty and accepting the growing need to work together in supranational forums, national governments can, in fact, increase their capacity to shape their own destiny.'- Lawrence Susskind, Massachusetts Institute of Technology, US 'In an increasingly interdependent world, global forces affect both the design and effectiveness of environmental policy. This Handbook provides an unusually creative and comprehensive guide, not only to the nature of these forces and their impacts, but also to how a better understanding of these forces can provide a foundation for improving the effectiveness of environmental policy.' - Tom Tietenberg, Colby College, US In the current era of globalization, national governments are increasingly exposed to international influences that present new constraints and opportunities for domestic environmental policies. This comprehensive, revised Handbook pushes the frontiers of theoretical and empirical knowledge, and provides a state-of-the-art examination of the multifaceted effects of globalization on environmental governance. Including substantially revised as well as new contributions from leading authorities, the Handbook offers an insightful overview of recent developments at the intersection of globalization and national environmental policy. It covers themes including national regimes, trade rules, types of goods, federalism, innovation, standards, citizen-consumers, developing countries, policy networks, partnerships, and carbon trading. The Handbook's depth and scope will appeal to a broad and varied readership, across academics, students, and policy makers interested in public and private governance, environmental economics, international relations, environmental politics and law, sociology, and political science. Edward Elgar Publishing Ltd The Transaction Cost Economics Project: The Theory and Practice of the Governance of Contractual Relations
The presence of transaction costs greatly modifies the traditional picture of the allocation of resources through the market. It gives rise to many phenomena inexplicable in the simple market view and to problems of government policy. Oliver Williamson has been a leading figure in this analysis. His interpretations of corporate governance and of the complementarity between internal controls and the market have been the most profound in the literature. It is good that his leading essays are now available in collected form.'- Kenneth J. Arrow, Stanford University, US'Oliver Williamson's contributions to economics are certainly among the most important of the past several decades, and their importance will be increasingly recognized as economists come to grips with all that he has accomplished. This collection provides an unparalleled view of those contributions, and it belongs on the bookshelf of everyone who wants to understand complex economic transactions.'- David Kreps, Stanford University, US'This book provides a terrific opportunity to have a collection of Oliver Williamson's best papers on transaction cost economics all in one convenient volume.'- Paul L. Joskow, Alfred P. Sloan Foundation and MIT'Williamson's work on transaction cost economics has shaped the thinking of all social scientists about organizations and institutions. This volume reprints many of his seminal papers on the subject, and is valuable both as commemoration and for reference.'- Avinash Dixit, Princeton University, USTransaction cost economics has and continues to be a fruitful area of research. There is still much to be done in the field with past research being used in conjunction with the vast number of contractual phenomena that have yet to be investigated in transaction cost economics terms. New challenges are posed by the need to move beyond the design of new contractual instruments (such as financial derivatives) to include an examination of the lurking hazards that attend contract implementation. This important collection brings together Professor Williamson's key papers on transaction cost economics. It will be of benefit to academics, scholars and practitioners with an interest in this progressive subject.

Edward Elgar Publishing Ltd Law and the Limits of Government: Temporary versus Permanent Legislation
Why do legislatures pass laws that automatically expire? Why are so many tax cuts sunset? In this first book-length treatment of those questions, the author explains that legislatures pass laws temporarily in order to reduce opposition from the citizenry, to increase the level of information revealed by lobbies, and to externalize the political costs of changing the tax code on to future legislatures. This book provides a careful analysis which does not normatively prescribe either permanent or temporary legislation in every instance, but rather specifies the conditions for which either permanent or temporary legislation would maximize social welfare.Containing comprehensive, theoretical and empirical analysis of temporary lawmaking, Law and the Limits of Government will appeal to academics in law, economic and political science, lawmakers and policy advocates.Contents: Foreword by Francesco Parisi Part I: Theory 1. Edward Elgar Publishing Ltd Learning and Knowing in Practice-based Studies

The book addresses the principal features of practice-based theorizing and its key concepts, then concludes with methodological reflections on the practice-based approach.Written for a university public already in possession of basic notions in organizational studies and intending to conduct analysis of organizing as a social practice, it will also prove essential for master and PhD students as well as organizational scholars designing research within Practice-Based Studies. Students and specialists alike can gorge themselves on the many fascinating analyses of core issues and latest debates in the field. Highly recommended for anyone with an appetite to learn more about global money and finance.'- Eric Helleiner, University of Waterloo, CanadaThis extensive Handbook provides an in-depth exploration of the political economy dynamics associated with the international monetary and financial systems. Leading experts offer a fresh take on research into the interaction between system structure, the self-interest of private firms, the political institutions within which governments make policy, and the ideas that influence beliefs about appropriate policy responses. Crucially they also assess how these factors have shaped the political economy of various facets of monetary and financial systems.Organized into four comprehensive sections, the Handbook begins with a focus on the international system and explores how the distribution of power in the system shapes its structure and dynamics. The next section then considers the politics of exchange rate regime choice before analyzing current research on financial crises and financial regulation. Key questions are asked, such as: what drives financial crises and why do some economies suffer banking and currency crises while others do not? How does politics shape the central characteristics of the IMF s approach to crisis management? And how does change in the distribution of power in the international system change the structure of the global monetary and financial systems? The Handbook addresses these concerns and concludes with an examination of international governance, including the IMF and institutional reform in the post-crisis eurozone. This detailed Handbook brings together original contributions from some of the leading authorities in the field, making it an invaluable resource to academics and students of international relations, governance, and political economy.Contributors: L.E. Edward Elgar Publishing Ltd European Cities and Global Competitiveness: Strategies for Improving Performance
Europe is in a troubled state. The macroeconomic situation looks grim, national governments are close to dysfunction, and Europeans are facing austerity and relative decline. The one bright spot on the horizon is the potential for positive action at the level of the city and urban regions. In this book, the editors have assembled a collection of original contributions by scholars from Europe, North America and Asia who offer insights as to how local authorities in Europe might be able to chart a course for their city or urban region during this period of extraordinary difficulty. The volume begins with an Introduction, followed by a set of three papers in Part Two examining European urban competitiveness from the standpoints of measurement and policy. This section also provides a case study of the cities of one country - Italy - from which the reader can gain an understanding of the current position of European cities as well as what might be possible going forward. Experience has shown that perhaps the most crucial element in competitiveness enhancement is good and effective governance. To that end, Part Three examines structural aspects of urban government, including polycentric regions, wide metropolitan cooperation, the role of social actors and territorial aggregation. Part Four treats issues of innovation from two perspectives and provides a case study from Eindhoven, while also covering social issues such as demographics, participation, social exclusion and mobility. This set of scholarly reflections will be of considerable benefit to urban practitioners, researchers and students of public policy. Contributors: P. Canonico, C. Donolo, G. Hirsch, M.P. Iacono, D. Edward Elgar Publishing Ltd Emotions and Consumption Behaviour
Literally and metaphorically, this long-overdue book is full of emotions. While illustrating the role and implications of human emotions on consumption behaviour, the author does it passionately. She comments on the evidence that consumers desire much more than functional utility and material possession of goods. Positive, negative, and mixed emotions are better predictors of the way consumers elaborate meanings of their possessions as well as sounder explanations of the way consumption is used in order to navigate social relations.'- Luca M. Visconti, ESCP Europe, FranceThis stimulating book scrutinizes how emotions function in consumers, from both a psychological and a managerial perspective. It demonstrates how gratitude, happiness, guilt, anger, pride and sadness determine different post-consumption behaviours such as positive and negative word of mouth, repurchase intention and complaint behavior. The emotional side of consumption seems to play an essential role in explaining choices made and actions taken by consumers. Isabella Soscia explores the cognitive antecedents and the action tendencies of happiness and unhappiness and social emotions such as guilt and pride, anger and gratitude are analyzed. The book will equip managers with conceptual tools and managerial guidance either to prevent certain emotions from arising in consumers or to generate desired emotions in consumers and so to inhibit or promote appropriate actions. Using empirical examples, Isabella Soscia demonstrates that different emotions predict specific different types of post-consumption behaviors and that cognitive antecedents specified in the psychology literature elicit them.Emotions and Consumption Behaviour will prove invaluable for consumer behavior scholars and marketing scholars. Students will find the examples and short case-study descriptions that clarify the theoretical content illuminating. As each of the emotions analysed has different managerial implications, marketing managers, and brand and product managers as well as advertising managers will find that this book helps them to design marketing strategy.Contents: Preface 1. Edward Elgar Publishing Ltd The Ecological Footprint: New Developments in Policy and Practice
Andrea Collins and Andrew Flynn provide a fascinating review of a concept in action. Having engaged with all sides of the debate and carefully followed the development of a new approach for measuring human demand on nature, they provide an insightful account of what worked, what did not, and why. While it may be obvious to many that humanity needs to live within the means of nature, it still is surprisingly unclear how to make this insight truly relevant and practical for policy. How can we overcome this looming gap? Collins and Flynn show ways how we might succeed with this challenge. Get this book and help design the next generation of sustainability policy that can bridge this gap.'- Mathis Wackernagel, President, Global Footprint NetworkThe ecological footprint is one of the most prominent tools used to measure environmental sustainability, and its rise in academic and policy debates since the early 1990s has been remarkable. Drawing upon research and examples from around the world, the authors critically examine the claims made of the Ecological Footprint and how it has been applied in practice.Offering an up-to-date account, this book provides a unique insight into the ways in which environmental knowledge is used within organizations, and how it is able to carry authority in policy making processes. It further discusses the changing status of the Ecological Footprint and the growth of other footprint tools, such as the Carbon Footprint. This book will be of interest to undergraduate and postgraduate students studying human geography, ecology, environmental science and urban studies. Edward Elgar Publishing Ltd Branded Lives: The Production and Consumption of Meaning at Work

Edward Elgar Publishing Ltd The New Limits of Education Policy: Avoiding a Tragedy of the Commons
Using a political economy framework to analyze the current problems facing US post-secondary education, The New Limits of Education Policy tackles the questions surrounding the future of higher education. This study provides an explanation as to why improvement of teaching and learning is not a high priority for the stakeholders involved. Roger Benjamin explains why heightened recognition by the State of the importance of human capital in the knowledge economy will create the external conditions that will, in turn, create the need for an altered incentive system for these stakeholders. He goes on to make a case for additional positive incentives that would reward behavior that improves teaching and learning. The political economy framework used here suggests that post-secondary education is a common pool problem (CPP) that may soon become a permanent crisis - a tragedy of the commons. The popular consensus that the post-secondary education sector, the venue for enhancing human capital, is not doing a good enough job is now combined with the prospect of continued rising costs and declining resources for colleges and universities. Anticipating a national debate about the CPP, Roger Benjamin emphasizes the need for evidence-based decision making to assist leaders in improving quality and reducing costs. The New Limits of Education Policy is an eye-opening, critical read for anyone with a vested interest in the future of higher education, including policy makers, administrators, and students and scholars of economics and public policy.

Edward Elgar Publishing Ltd Reshaping Regional Policy
Originally initiated by the Presidential Committee on Regional Development in South Korea, this wide-ranging volume investigates the new directions in regional development policy taking shape around the world. In addition to contributions with individual emphasis on regional policy in Korea, the book compares, contrasts and extends regional policy thought in the European Union and other Asian countries. The book first examines some radical new directions in Korea's regional policies instigated by the newly established permanent Presidential Commission of Regional Development. The existing nine provinces and seven 'Special Cities' (i.e. metropolitan areas), will yield considerable power and budget authority to seven new mega-regions. Many of the ideas behind the new policies (such as territorial cohesion, regional innovation and regional competitiveness) were inspired from abroad, especially Europe. There are also changes at the lower urban scale to modify Korea's traditional top-down strategies. Previous policies, named 'balanced national development', were targeted at undermining Seoul by redistributing activities, including government, to other parts of the country under the zero sum game assumption. The new policies aim to benefit both the Capital Region and other mega-regions under a 'win-win' assumption. The book evaluates these approaches. Original contributions from some of the field's foremost scholars - including Sang-Chuel Choe, Sir Peter Hall, Andreas Faludi, Michael Storper, Takashi Onishi, Maryann Feldman and Sam Ock Park - identify priorities for territorial integration, develop ideas for cross-border cooperation, discuss EU policy and policies for overall regional competitiveness, examine the construction of regional entrepreneurial advantage and consider fiscal policy and decision-making. Professors, students and public policy officials in the fields of regional studies, planning and regional economics, economic geography and political science will all find this book very current and enlightening.Contributors: C.-H.C. From the foreword by Richard A. Epstein, New York University, US: 'Chang reviews the various standards and concludes that the proper measure, which is most invulnerable to political manipulation, calls for compensation at the fair market level of the property at its highest and best use, not just its current value.'This innovative volume offers a thorough breakdown of the issues surrounding takings compensation - payments made as reimbursement for government takeover of private property. Using examples from New York City and Taiwan, Yun-chien Chang discusses the advantages and disadvantages of different methods of compensation and offers insightful suggestions for future implementation. In an effort to fill the gaps in the current literature, the author identifies the five previously recognized types of compensation - zero, current value, fair market value, economic value and project value compensation - and uses a combination of previous research and new data to determine which is the most economically efficient. In doing so, he sets out a concrete methodology for the evaluation of takings compensation strategies that should prove vital to future policy decisions.Students and professors of law, economics and public policy will find much of interest in the author's careful analysis, as will policymakers and other government officials working on similar land use issues.Contents: Foreword by Richard Epstein; Introduction; Part I: Theoretical Framework; 1. National debts incurred by illegitimate regimes against the best interests of the citizens is a serious problem of international economics and politics. These sovereign debts, often referred to as odious debts, deplete the public purse and create an ongoing financial liability that serves to constrain investment and economic growth, and conspires to keep millions in poverty. This important and timely book explains the legal principles and politics involved in the issue of odious debts, and sovereign debt arrangements more generally. The author goes beyond abstract arguments and proposes legal rules and international regulation that should be put in place to create the right incentives to stop the transmission of odious debts. 'Carrera and Dunleavy provide a crystal clear and comprehensive account of the complex issues involved in how best to improve the productivity of government services. They offer a nuanced but powerful explanation of productivity puzzles, conundrums and dilemmas in the public sector. But they also offer solutions to many of these problems. Finally, I have found a text on public economics that makes sense, gives genuine management insights and offers real suggestions to practitioners as to what to do next.'- Barry Quirk, Chief Executive, London Borough of Lewisham, UK'This book presents a welcome and sobering analysis of productivity performance in UK central government - a subject that has received remarkably little serious academic attention up to now, in spite of decades of general commentary on managerialism.'- Christopher Hood, All Souls College, UK'Leandro Carrera and Patrick Dunleavy have performed an amazing feat in this book through their rigorous examination of a thorny topic that has dogged pundits and academics alike. Just how efficient is government and how well does it do its job? As a result of an impressive - but accessible - set of data analyses, the authors make an authoritative attack on the proponents of the New Public Management, and offer some clear recommendations for reform based on better use of new technology.'- Peter John, University College London, UKProductivity is essentially the ratio of an organization's outputs divided by its inputs. For many years it was treated as always being static in government agencies. In fact productivity in government services should be rising rapidly as a result of digital changes and new management approaches, and it has done so in some agencies. However, Dunleavy and Carrera show for the first time how complex are the factors affecting productivity growth in government organizations - especially management practices, use of IT, organizational culture, strategic mis-decisions and political and policy churn. With government budgets under stress in many countries, this pioneering book shows academics, analysts and officials how to measure outputs and productivity in detail; how to cope with problems of quality variations; and how to achieve year-on-year, sustainable improvements in the efficiency of government services.

Edward Elgar Publishing Ltd Financial Instability and Economic Security after the Great Recession
'A failing orthodoxy calls out for powerful alternatives. Neoclassical economics is that failed orthodoxy; Whalen and his contributors are the critical alternative. In this finely orchestrated edited volume, the contributors take turns wielding a sledgehammer to demolish the weakened edifice of neoclassical theory. Then, each adds a brick to a new theoretical foundation as they work together to expand upon the Post-Keynesian Institutionalist approach, especially the ideas laid down by Hyman Minsky. Their critique is clear and the alternative theory and policies they present are critical for anyone trying to understand the nature and operation of market-based economies.' - Dorene Isenberg, University of Redlands 'A convergence of Post Keynesian and Institutional economics, which have much in common, offers a sound and practical way forward after the Great Recession. By drawing inspiration from Hyman Minsky and tracing similarities in the economics of Veblen, Commons and Keynes, this book pursues such a convergence in an original and thought-provoking manner. The result is a new way of thinking about economics, one based on serious economic theory and rooted firmly in economic reality.' - Philip Arestis, University of Cambridge, UK This timely book rethinks economic theory and policy by addressing the problem of economic instability and the need to secure broadly shared prosperity. It stresses that advancing economics in the wake of the Great Recession requires an evolutionary standpoint, greater attention to uncertainty and expectations, and the integration of finance into macroeconomics. The result is a broader array of policy options - and challenges - than conventional economics presents. Building on the pioneering work of Thorstein Veblen, John R. Commons and John Maynard Keynes, the authors synthesize key insights from Institutional and Post Keynesian economics into Post-Keynesian Institutionalism. Then they use that framework to explore an array of economic problems confronting the United States and the world. Inspired by the work of Hyman Minsky, the authors place financial relations at the center of their analysis of how economies operate and change over time. Students and scholars of macroeconomics and public policy will find this book of interest, as will a wider audience of financial analysts, policy makers and citizens interested in understanding economic booms and downturns.

Edward Elgar Publishing Ltd Deficits, Debt, and Democracy: Wrestling with Tragedy on the Fiscal Commons
This timely book reveals that the budget deficits and accumulating debts that plague modern democracies reflect a clash between two rationalities of governance: one of private property and one of common property. The clashing of these rationalities at various places in society creates forms of societal tectonics that play out through budgeting. The book demonstrates that while this clash is an inherent feature of democratic political economy, it can nonetheless be limited through embracing once again a constitution of liberty. Not all commons settings have tragic outcomes, of course, but tragic outcomes loom large in democratic processes because they entail conflict between two very different forms of substantive rationality; the political and market rationalities. These are both orders that contain interactions among participants, but the institutional frameworks that govern those interactions differ, generating democratic budgetary tragedies. Those tragedies, moreover, are inherent in the conflict between the different rationalities and so cannot be eliminated. They can, as this book argues, be reduced by restoring a constitution of liberty in place of the constitution of control that has taken shape throughout the west over the past century. Economists interested in public finance, public policy and political economy along with scholars of political science, public administration, law and political philosophy will find this book intriguing. Written in an accessible manner, this book will appeal to economists, economic policy makers and students of economics and public policy who are trying to look at alternative ways of understanding why the Global Financial Crisis (GFC) occurred and what ought to have been the appropriate response. Anyone who is genuinely interested in the causes of the GFC, and why the policies that were adopted failed to bring about the recovery that was intended, will find this book a fascinating read. Edward Elgar Publishing Ltd Caching the Carbon: The Politics and Policy of Carbon Capture and Storage
Over the past decade, carbon capture and storage (CCS) has come to the fore as a way to manage carbon dioxide emissions contributing to climate change. This book examines its introduction into the political scene, different interpretations of its significance as an emerging technology and the policy challenges facing government and international institutions with respect to its development, deployment and regulation. The focus of the book is on the construction of arguments about CCS in the public sphere, the coalitions of actors who have articulated distinctive perspectives on CCS and the varied strategies governments have adopted to integrate it into climate and energy policies. The authors analyse the issues decision-makers now confront in encouraging the uptake of the technology, managing uncertainties and regulating attendant risks. The book includes case studies of the reception of CCS in seven OECD countries: Australia, Canada, Germany, the Netherlands, Norway, the United Kingdom and the United States. Developments in the EU form the subject of an eighth case study. The authors point to the political significance of CCS as a mitigation option offering a way forward for fossil fuels in a carbon constrained world, while also emphasizing the uncertainties that surround its future development and deployment. Students, scholars and researchers from a wide variety of fields who are interested in climate change, energy policy, and the politics and policy of the environment will find this book illuminating, as will officials and policy makers in international organizations and governments.

Edward Elgar Publishing Ltd Handbook of the International Political Economy of Governance
Certainly one of the most inclusive books in international political economy, which successfully combines a strong and very innovative theoretical investigation with a wonderful diversity of case studies. The book is highly pedagogic and particularly meets the expectations of students and educated persons who are short of updated analysis in this field.'- Bertrand Badie, Sciences Po, FranceSince the 1990s many of the assumptions that anchored the study of governance in international political economy (IPE) have been shaken loose. Reflecting on the intriguing and important processes of change that have occurred, and are occurring, Anthony Payne and Nicola Phillips bring together the best research currently being undertaken in the field. They explore the complex ways that the global political economy is presently being governed, and indeed misgoverned. The Handbook is organized into two fresh and original parts. In Part I the authors advance their own distinctive understanding of the international political economy of governance and thus make important contributions to the next phase of scholarship. Considering four key themes, they reflect on the ideological foundations of governance, the levels at which governance is articulated, the actors involved in governance and the ethical questions associated with the subject.Part II addresses the patterns of governance that prevail in particular issue areas. Invited to consider their contributions in the light of the four framing themes set out in Part I, these prominent authors offer key insights into contemporary dynamics in a wide range of issue areas and consider how their insights can be mobilized in refreshing the study of governance.Covering all themes central to the field of politics, this extensive and detailed Handbook will be of great value to students of governance, political economy, international relations and development studies.Contributors: A.
