Launched in 1993, The Common Core of European Private law is the oldest ongoing collective comparative law efort in Europe. Putting cases at their heart, each book in this series analyses a selected legal topic on the basis of real and fctional facts across diferent European and other jurisdictions. The likely outcome of the decision and its underlying legal rules are clearly set out case by case and jurisdiction by jurisdiction. In addition, the national reporters put the respective legal rules into the relevant cultural context. In this way, the collaborative efort brings not only the inner structures of national laws in Europe to the fore, but also the diferent cultural sensitivities forging their development in the frst place. It allows a reliable map of what is diferent and what is common in the various private laws across Europe to be drawn, without any specifc agenda for or against the further harmonisation of private law in Europe. The series comprises more than 20 volumes of work of more than 300 academics and is an invaluable tool to understand private law across Europe. In this book, which is part of the Common Core of European Private Law series, reporters consider legal institutions - such as the well-known acquisitive prescription and adverse possession - that allow squatters and other persons who have occupied the private or public land of others to acquire that land through mere long-term use. Rules permitting such acquisition have existed since Roman times and are said to promote legal certainty as regards ownership of land. The reporters investigate how these rules work in their legal systems today and whether this justifcation still holds water, especially given that land is now registered in most countries. Registration seems to obviate the necessity for rules permitting acquisition of land through mere long-term use, as land registration systems create clarity as to who owns the land. The continued existence of these rules also comprises a human-rights dimension. Landowners enjoy constitutional property protection under many constitutions and other legal instruments. The loss of protected ownership draws the constitutional validity of rules on long-term use into question. Yet, the rights to housing and human dignity are also relevant, especially where such users have lived on the land for extended periods and regard it as their home or where they are vulnerable to landlessness. As such, these rights must be balanced against each other. The reporters represent 19 jurisdictions from all over the world, including civil law, common law and mixed legal systems, and are from both the global north and the global south. A comparison between these legal systems and their experience with their rules on long-term use reveals a common core and guidelines against which these rules may be measured in other countries. As such, this book will be valuable to practitioners dealing with both private and public law, academic lawyers and government ofcials tasked with land use planning. Radiant and energetic abstractions of the human figure in the latest works from acclaimed painter Loie Hollowell New York-based painter Loie Hollowell (born 1983) has evolved a dynamic vocabulary of dimensionality, color and geometric shape. Abstracting the human figure, Hollowell’s paintings explore the dualities of light, and volume and scale, blurring the lines between the illusory and the real. In particular, her latest body of work explores her relationship to different stages of her pregnancy from conception to birth to motherhood. Nonetheless, subject matter in Hollowell’s work often emerges through phenomenological encounter rather than narrative content, tapping the depth of the artist’s embodied experience. This catalog for Hollowell's exhibition Plumb Line, an inaugural show at Pace Gallery's new headquarters in New York, features nine large-scale paintings, as well as installation shots, and deploys die-cut colored pages as a compositional element. An essay by Emma Enderby and a conversation between the artist and Elissa Auther contextualize the work, and are complemented by poetry by Iris Cushing.

The Modern Woodmen Ballpark in Davenport Iowa doesn’t let a small matter like the Mississippi flooding stop play. After building perimeter flood barriers and walkways to the stadium, the ballpark has become an accessible island. Perhaps there is no more touching a story than the Gail S. Halvorsen Ballpark opened in Berlin in 2019. Lieutenant Halversen took part in the Berlin Airlift from 1948 to 1949 and became known as the ‘Candy Bomber’ after dropping candy attached to parachutes for children gathered to watch the planes land. At age 98 he was invited back to the city for the naming of a baseball park in his name. A remarkable man and his ballpark.

A translation of three works from the second half of the 13th century: Rutebeuf's Renart le Bestourné, the anonymous Le Couronnement de Renart and Jacquemart Gielée's Renart le Nouvel. These savage and highly entertaining satires are in a league of their own, and Renart le Nouvel contains important music which is reproduced in the text. Rarely can a medieval work have resonated with the mood of the present as uncannily as do these three satires. Acerbic, raging and finally apocalyptic, these poems from the second half of the thirteenth century, richly entertaining and wickedly comic though they are, express a vision of the world and its descent into corruption and disaster which mirrors our own state of rampant alarm. The animal tales of the 12th- and 13th-century Roman de Renart - the Romance of Reynard the Fox - were immensely popular. Any satire in those original tales was generally light of touch, but the characters created in them, fox and wolf and ass and lion to name but four, were an open invitation to anyone of a more scathing satirical bent. The poet Rutebeuf, in his short but startling Renart le Bestourné ('Reynard Transformed'), deploys the beasts to make a venomous attack on the mendicant orders and on 'Saint' Louis IX of France. The anonymous Le Couronnement de Renart ('Reynard Crowned') then has the Fox crowned king, establishing a reign of every vice. And most ambitiously of all, Jacquemart Gielée in his Renart le Nouvel ('The New Reynard'), gripped by an increasingly pervasive sense of apocalypse, ends his poem with the Fox, the epitome of deceit and lying, not merely crowned king, but seated in permanent, malign control of the world atop a chocked, unturning Fortune's Wheel. The New Reynard is of special interest not only to students of medieval literature but also to musicologists. Music, in the form of numerous songs, plays an important part in Renart le Nouvel's satirical and apocalyptic message, and the poem is renowned as the most abundant source of late medieval refrains. Sooner or later every Asian American must deal with the question \u0022Where do you come from?\u0022 It is probably the most familiar if least aggressive form of racism. It is a tip-off to the persistent notion that people of Asian ancestry are not real Americans, that \u0022Orientals\u0022 never really stop being loyal to their foreign homeland, no matter how long they or their families have been in this country. Confronting the cultural stereotypes that have been attached to Asian Americans over the last 150 years, Robert G. Lee seizes the label \u0022Oriental\u0022 and asks where it came from. The idea of Asians as mysterious strangers who could not be assimilated into the cultural mainstream was percolating to the surface of American popular culture in the mid-nineteenth century, when Chinese immigrant laborers began to arrive in this country in large numbers. Lee shows how the bewildering array of racialized images first proffered by music hall songsters and social commentators have evolved and become generalized to all Asian Americans, coalescing in particular stereotypes. Whether represented as Pollutant, Coolie, Deviant, Yellow Peril, Model Minority, or Gook, the Oriental is portrayed as alien and a threat to the American family -- the nation writ small. Refusing to balance positive and negative stereotypes, Lee connects these stereotypes to particular historical moments, each marked by shifting class relations and cultural crises. Seen as products of history and racial politics, the images that have prevailed in songs, fiction, films, and nonfiction polemics are contradictory and complex. Lee probes into clashing images of Asians as (for instance) seductively exotic or devious despoilers of (white) racial purity, admirably industrious or an insidious threat to native laborers. When Lee dissects the ridiculous, villainous, or pathetic characters that amused or alarmed the American public, he finds nothing generated by the real Asian American experience; whether they come from the Gold Rush camps or Hollywood films or the cover of Newsweek, these inhuman images are manufactured to play out America's racial myths. Today we view evil as a matter of human cruelty, and Auschwitz as its extreme incarnation. Examining our understanding of evil from the Inquisition to contemporary terrorism, Susan Neiman explores who we have become in the three centuries that separate us from the early Enlightenment. In the process, she rewrites the history of modern thought and points philosophy back to the questions that originally animated it. Whether expressed in theological or secular terms, evil poses a problem about the world's intelligibility. Wayne Thiebaud: 1958-1968 examines Thiebaud's ongoing impact on contemporary art through in-depth analysis of the paintings and drawings made at the launch of his career, at a seminal moment when the art world was moving beyond Abstract Expressionism and redefining itself. By questioning Thiebaud's relationship to Pop art, his self-imposed distance from the movement, and the popular urge to affiliate him with it, Teagle explores the role of his painting in the traffic of images at the end of the twentieth century. Organized in close cooperation with the artist, this is the first study of the emergence of Thiebaud's mature style and the only museum exhibition to date to delve into a specific period of his production, a time that coincides with the start of his teaching career at University of California at Davis. After inquisitorial procedure was introduced at the Fourth Lateran Council in Rome in 1215 (the same year as England's first Magna Carta), virtually all court trials initiated by bishops and their subordinates were inquisitions. That meant that accusers were no longer needed. Rather, the judges themselves leveled charges against persons when they were publicly suspected of specific offenses--like fornication, or witchcraft, or simony. Secret crimes were off limits, including sins of thought (like holding a heretical belief). Defendants were allowed full defenses if they denied charges. These canonical rules were systematically violated by heresy inquisitors in France and elsewhere, especially by forcing self-incrimination. But in England, due process was generally honored and the rights of defendants preserved, though with notable exceptions.In this book, Henry Ansgar Kelly, a noted forensic historian, describes the reception and application of inquisition in England from the thirteenth century onwards and analyzes all levels of trial proceedings, both minor and major, from accusations of sexual offenses and cheating on tithes to matters of religious dissent. He covers the trials of the Knights Templar early in the fourteenth century and the prosecutions of followers of John Wyclif at the end of the century. He details how the alleged crimes of ""criminous clerics"" were handled, and demonstrates that the judicial actions concerning Henry VIII's marriages were inquisitions in which the king himself and his queens were defendants. Trials of Alice Kyteler, Margery Kempe, Eleanor Cobham, and Anne Askew are explained, as are the unjust trials condemning Bishop Reginald Pecock of error and heresy (1457-59) and Richard Hunne for defending English Bibles (1514). He deals with the trials of Lutheran dissidents at the time of Thomas More's chancellorship, and trials of bishops under Edward VI and Queen Mary, including those against Stephen Gardiner and Thomas Cranmer. Under Queen Elizabeth, Kelly shows, there was a return to the letter of papal canon law (which was not true of the papal curia). In his conclusion he responds to the strictures of Sir John Baker against inquisitorial procedure, and argues that it compares favorably to the common-law trial by jury.
