Elizabeth I consciously and determinedly provided a Government mediation and arbitration scheme. A wealth of primary sources show that she had a special concern for women, the poor and anyone disadvantaged by the costs and delays of the law. Her Privy Council arranged arbitrations with no fees and with free legal aid for those who needed it. The archives are voluminous, not only in the Acts of the Privy Council but in the National Archives and local collections. Her arbitration scheme dominates this book, but the background was private arbitration, arranged by the parties. In Elizabethan England arbitration was the ordinary way to settle a dispute the parties could not end themselves. Each side chose one or more arbitrators and that even number would try to mediate a settlement. If they failed, they would at least try to get the parties to agree on whom they would appoint to decide for them. The arbitrators include well-known personalities: Cecil and Walsingham, Raleigh and Hawkins, Coke and Bacon. Women are shown participating at all levels, as claimants and defendants, in matters of title to land, commerce and all kinds of family squabbles. They could even act as arbitrator or mediator. Elizabeth I herself did both. Many of the disputes were between foreign merchants and some were submitted to their arbitration. What law there was on arbitration, as the courts developed it over the 45 years of the reign, had little impact on practice. But the most important revelation is the Queen's concern for the poor: 'If the phrases "legal aid" and even "welfare state" had been coined by then, it may be unwise to assume that Elizabeth I's Government would have used them as terms of abuse.'

Odd Tribes challenges theories of whiteness and critical race studies by examining the tangles of privilege, debasement, power, and stigma that constitute white identity. Considering the relation of phantasmatic cultural forms such as the racial stereotype “white trash” to the actual social conditions of poor whites, John Hartigan Jr. generates new insights into the ways that race, class, and gender are fundamentally interconnected. By tracing the historical interplay of stereotypes, popular cultural representations, and the social sciences’ objectifications of poverty, Hartigan demonstrates how constructions of whiteness continually depend on the vigilant maintenance of class and gender decorums. Odd Tribes engages debates in history, anthropology, sociology, and cultural studies over how race matters. Hartigan tracks the spread of “white trash” from an epithet used only in the South prior to the Civil War to one invoked throughout the country by the early twentieth century. He also recounts how the cultural figure of “white trash” influenced academic and popular writings on the urban poor from the 1880s through the 1990s. Hartigan’s critical reading of the historical uses of degrading images of poor whites to ratify lines of color in this country culminates in an analysis of how contemporary performers such as Eminem and Roseanne Barr challenge stereotypical representations of “white trash” by claiming the identity as their own. Slipping Backward: A History of the Nebraska Supreme Court, written by one of the state’s leading legal minds, is the first history of the Nebraska Supreme Court and the first book-length study of a Great Plains supreme court. James W. Hewitt draws on his intimate knowledge of the subject matter gleaned from years as a lawyer in Nebraska and applies a historian’s objectivity to the analysis. Hewitt explores the court through the work of the four men who greatly influenced and led it: Robert G. Simmons (1938–63, the first modern chief justice), Paul W. White (1963–78), Norman Krivosha (1978–87), and William C. Hastings (1987–95). During these four eras, respect for the court declined in the eyes of the bar and the public. Hewitt examines every case decided by the court from 1938 through 1995, analyzes many of the leading decisions, and assesses the abilities and performances of the judges who served. He shows why the court fell far behind in its workload during the 1960s, 1970s, and 1980s, and delineates the steps it took to alleviate the backlog. He also reviews the changes in the nature of cases coming before the court and the exponential growth of criminal appeals necessitated by decisions of the U.S. Supreme Court. While Slipping Backward is critical of the court’s shortcomings, it finds the court to be composed of decent men trying to do a decent job. The increased ability of clandestine groups to operate with little regard for borders or geography is often taken to be one of the dark consequences of a brave new globalized world. Yet even for terrorists and smugglers, the world is not flat; states exert formidable control over the technologies of globalization, and difficult terrain poses many of the same problems today as it has throughout human history. In No Man's Land, Justin V. Hastings examines the complex relationship that illicit groups have with modern technology—and how and when geography still matters. Based on often difficult fieldwork in Southeast Asia, Hastings traces the logistics networks, command and control structures, and training programs of three distinct clandestine organizations: the terrorist group Jemaah Islamiyah, the insurgent Free Aceh Movement, and organized criminals in the form of smugglers and maritime pirates. Hastings also compares the experiences of these groups to others outside Southeast Asia, including al-Qaeda, the Tamil Tigers, and the Somali pirates. Through reportage, memoirs, government archives, interrogation documents, and interviews with people on both sides of the law, he finds that despite their differences, these organizations are constrained and shaped by territory and technology in similar ways. In remote or hostile environments, where access to the infrastructure of globalization is limited, clandestine groups must set up their own costly alternatives. Even when successful, Hastings concludes, criminal, insurgent and terrorist organizations are not nearly as mobile as pessimistic views of the sinister side of globalization might suggest.

Government wrongdoing or negligence harms people worldwide, but not all victims are equally effective at obtaining redress. In Accidental Activists, Celeste L. Arrington examines the interactive dynamics of the politics of redress to understand why not. Relatively powerless groups like redress claimants depend on support from political elites, active groups in society, the media, experts, lawyers, and the interested public to capture democratic policymakers' attention and sway their decisions. Focusing on when and how such third-party support matters, Arrington finds that elite allies may raise awareness about the victims’ cause or sponsor special legislation, but their activities also tend to deter the mobilization of fellow claimants and public sympathy. By contrast, claimants who gain elite allies only after the difficult and potentially risky process of mobilizing societal support tend to achieve more redress, which can include official inquiries, apologies, compensation, and structural reforms.Arrington draws on her extensive fieldwork to illustrate these dynamics through comparisons of the parallel Japanese and South Korean movements of victims of harsh leprosy control policies, blood products tainted by hepatitis C, and North Korean abductions. Her book thereby highlights how citizens in Northeast Asia—a region grappling with how to address Japan’s past wrongs—are leveraging similar processes to hold their own governments accountable for more recent harms. Accidental Activists also reveals the growing power of litigation to promote policy change and greater accountability from decision makers.

Metaphysics for Adorno is defined by a central tension between concepts and immediate facts. Adorno traces this dualism back to Aristotle, whom he sees as the founder of metaphysics. In Aristotle it appears as an unresolved tension between form and matter. This basic split, in Adorno's interpretation, runs right through the history of metaphysics. Perhaps not surprisingly, Adorno finds this tension resolved in the Hegelian dialectic. Underlying this dualism is a further dichotomy, which Adorno sees as essential to metaphysics: while it dissolves belief in transcendental worlds by thought, at the same time it seeks to rescue belief in a reality beyond the empirical, again by thought. It is to this profound ambiguity, for Adorno, that the metaphysical tradition owes its greatness. The major part of these lectures, given by Adorno late in his life, is devoted to a critical exposition of Aristotle's thought, focusing on its central ambiguities. In the last lectures, Adorno's attention switches to the question of the relevance of metaphysics today, particularly after the Holocaust. He finds in 'metaphysical experiences', which transcend rational discourse without lapsing into irrationalism, a last precarious refuge of the humane truth to which his own thought always aspired. This volume will be essential reading for anyone interested in Adorno's work and will be a valuable text for students and scholars of philosophy and social theory.

A social theory of grand corruption from antiquity to the twenty-first century.In contemporary policy discourse, the notion of corruption is highly constricted, understood just as the pursuit of private gain while fulfilling a public duty. Its paradigmatic manifestations are bribery and extortion, placing the onus on individuals, typically bureaucrats. Sudhir Chella Rajan argues that this understanding ignores the true depths of corruption, which is properly seen as a foundation of social structures. Not just bribes but also caste, gender relations, and the reproduction of class are forms of corruption.Using South Asia as a case study, Rajan argues that syndromes of corruption can be identified by paying attention to social orders and the elites they support. From the breakup of the Harappan civilization in the second millennium BCE to the anticolonial movement in the late nineteenth and early twentieth centuries, elites and their descendants made off with substantial material and symbolic gains for hundreds of years before their schemes unraveled.Rajan makes clear that this grander form of corruption is not limited to India or the annals of global history. Societal corruption is endemic, as tax cheats and complicit bankers squirrel away public money in offshore accounts, corporate titans buy political influence, and the rich ensure that their children live lavishly no matter how little they contribute.
