Tens of thousands of Indian children filed through the gates of government schools to be trained as United States citizens. Part of a late-nineteenth-century campaign to eradicate Native cultures and communities, these institutions became arenas where whites debated the terms of Indian citizenship, but also where Native peoples resisted the power of white schooling and claimed new skills to protect and redefine tribal and Indian identities. In White Man’s Club, schools for Native children are examined within the broad framework of race relations in the United States for the first time. Jacqueline Fear-Segal analyzes multiple schools and their differing agendas and engages with the conflicting white discourses of race that underlay their pedagogies. She argues that federal schools established to Americanize Native children did not achieve their purpose; instead they progressively racialized American Indians. Alexander Schuessler has done what many deemed impossible: he has wedded rational choice theory and the concerns of social theory and anthropology to explain why people vote. The "paradox of participation"--why individuals cast ballots when they have virtually no effect on electoral outcomes--has long puzzled social scientists. And it has particularly troubled rational choice theorists, who like to describe political activity in terms of incentives. Schuessler's ingenious solution is a "logic of expressive choice." He argues in incentive-based (or "economic") terms that individuals vote not because of how they believe their vote matters in the final tally but rather to express their preferences, allegiances, and thus themselves. Through a comparative history of marketing and campaigning, Schuessler generates a "jukebox model" of participation and shows that expressive choice has become a target for those eliciting mass participation and public support. Political advisers, for example, have learned to target voters' desire to express--to themselves and to others--who they are. Candidates, using tactics such as claiming popularity, invoking lifestyle, using ambiguous campaign themes, and shielding supporters from one another can get out their vote even when it is clear that an election is already lost or won. In 1950, the University of Pennsylvania Museum of Archaeology and Anthropology began excavations at the ancient Phrygian capital of Gordion in central Turkey. The Museum's Gordion Project continues today, with researchers from many disciplines and with many specializations contributing to a growing—and sometimes changing—body of information and understanding about this complex and multifaceted site, inhabited by peoples and diverse civilizations for millennia. In this volume of Gordion Special Studies, Lynn E. Roller focuses on a series of stone blocks with incised figural and abstract drawings recovered from early Phrygian structures at Gordion. The great majority of the incised stones come from a single structure within the Early Phrygian citadel at Gordion known as Megaron 2, a stone building with several remarkable features and a likely candidate for the citadel's temple. The volume begins with a description of the excavation of the stones and a discussion of Megaron 2. Next is an analysis of the subject matter of the drawings by type, describing scenes of human figures, animals, architectural drawings, geometric patterns, and formless marks. A discussion follows of the sources from which the drawings could have been taken and of parallels with similar scenes and designs on objects in other media from Gordion and other contemporary sites in Anatolia. The fourth section proposes an explanatory hypothesis on the origin of the drawings, and considers who could have made them and why. Parallels with comparable drawings from Anatolia and the Near East are discussed here. In 1886 Paul Cezanne let Paris permanently to settle in his native Aix-en-Provence. Nina M. Athanassoglou-Kallmyer argues that, far from an escapist venture like Gaugin's stay in Brittany or Monet's visits to Normandy, Cezanne's departure from Paris was a deliberate abandonment intimately connected with late-19th-century French regionalist politics. Like many of his childhood friends, Cezanne detested the homogenizing effects of modernism and bourgeois capitalism on the culture, people and landscapes of his beloved Provence. After inquisitorial procedure was introduced at the Fourth Lateran Council in Rome in 1215 (the same year as England's first Magna Carta), virtually all court trials initiated by bishops and their subordinates were inquisitions. That meant that accusers were no longer needed. Rather, the judges themselves leveled charges against persons when they were publicly suspected of specific offenses--like fornication, or witchcraft, or simony. Secret crimes were off limits, including sins of thought (like holding a heretical belief). Defendants were allowed full defenses if they denied charges. These canonical rules were systematically violated by heresy inquisitors in France and elsewhere, especially by forcing self-incrimination. But in England, due process was generally honored and the rights of defendants preserved, though with notable exceptions.In this book, Henry Ansgar Kelly, a noted forensic historian, describes the reception and application of inquisition in England from the thirteenth century onwards and analyzes all levels of trial proceedings, both minor and major, from accusations of sexual offenses and cheating on tithes to matters of religious dissent. He covers the trials of the Knights Templar early in the fourteenth century and the prosecutions of followers of John Wyclif at the end of the century. He details how the alleged crimes of ""criminous clerics"" were handled, and demonstrates that the judicial actions concerning Henry VIII's marriages were inquisitions in which the king himself and his queens were defendants. Trials of Alice Kyteler, Margery Kempe, Eleanor Cobham, and Anne Askew are explained, as are the unjust trials condemning Bishop Reginald Pecock of error and heresy (1457-59) and Richard Hunne for defending English Bibles (1514). He deals with the trials of Lutheran dissidents at the time of Thomas More's chancellorship, and trials of bishops under Edward VI and Queen Mary, including those against Stephen Gardiner and Thomas Cranmer. Under Queen Elizabeth, Kelly shows, there was a return to the letter of papal canon law (which was not true of the papal curia). In his conclusion he responds to the strictures of Sir John Baker against inquisitorial procedure, and argues that it compares favorably to the common-law trial by jury.

Our brains are designed to continually scan our environment, looking for new information, occasionally wandering off in different directions in search of new insights. Of course, we still do need to pay attention to learn. The problem is that we think of learning as a matter of managing distraction, when we should instead think of it as actively cultivating attention. This starts with letting go of technology bans, which are little more than a fig leaf applied to the objective difficulty of paying attention. But it involves more active ways of rethinking classroom conventions too. For example, rather than structuring lessons as 45 or 60-minute blocks of lecturing, teachers could segment their classes into a series of smaller lessons, with regular shifts in focus, appealing to the brain's interest in novelty. According to Judith Baer, feminist legal scholarship today does not effectively address the harsh realities of women's lives. Feminists have marginalized themselves, she argues, by withdrawing from mainstream intellectual discourse. In Our Lives Before the Law, Baer thus presents the framework for a new feminist jurisprudence--one that would return feminism to relevance by connecting it in fresh and creative ways with liberalism. Baer starts from the traditional feminist premise that the legal system has a male bias and must do more to help women combat violence and overcome political, economic, and social disadvantages. She argues, however, that feminist scholarship has over-corrected for this bias. By emphasizing the ways in which the system fails women, feminists have lost sight of how it can be used to promote women's interests and have made it easy for conventional scholars to ignore legitimate feminist concerns. In particular, feminists have wrongly linked the genuine flaws of conventional legal theory to its basis in liberalism, arguing that liberalism focuses too heavily on individual freedom and not enough on individual responsibility. In fact, Baer contends, liberalism rests on a presumption of personal responsibility and can be used as a powerful intellectual foundation for holding men and male institutions more accountable for their actions. The traditional feminist approach, Baer writes, has led to endless debates about such abstract matters as character differences between men and women, and has failed to deal sufficiently with concrete problems with the legal system. She thus constructs a new feminist interpretation of three central components of conventional theory--equality, rights, and responsibility--through analysis of such pressing legal issues as constitutional interpretation, reproductive choice, and fetal protection. Baer concludes by presenting the outline of what she calls "feminist post-liberalism": an approach to jurisprudence that not only values individual freedoms but also recognizes our responsibility for addressing individuals' needs, however different those may be for men and women. Since absolute dating of rock art is limited, relative chronologies remain useful in contextualising interpretations of ancient images. This book advocates the archival capacity of rock art and uses archival perspectives to analyse the chronology of paintings in order to formulate a framework for their historicised interpretations. The Western Cape painting sequence is customarily accepted to include the hunter-gatherer phase from c. 10,000 BP, pastoralism from c. 2,000 BP and finally the historical-cum-colonial period several centuries ago. Painting traditions with distinct depiction manners and content are conventionally linked to these broad periods. This study evaluates this schema in order to refine the diverse hunter-gatherer, herder and colonial era painting contexts and histories. Using superimpositions as one analytical tool, the notion of datum aided the referencing and correlation of layered imagery into a relative sequence. Although broad differences separate painting traditions, and these variations are generally indistinguishable within a single tradition, it is clear that the long-spanning hunter-gatherer segment of painting in this region reflects a hitherto unrecognised sub-tradition. Some painted themes such as elephants, fat-tailed sheep, handprints and possibly finger dots occur within various levels of the sequence, which this study views as shared graphic fragments occurring between and across traditions and sub-traditions. Through the archival concept of respect des fonds such observable complexities were clarified as coherent graphic narratives that run through the entire chronological sequence of the Western Cape rock paintings. Probing archaeological, ethnographic and historical sources revealed that while these themes remained fundamentally consistent throughout the stratigraphic sequence as preferred subject matter, their meanings might have transformed subliminally from earlier to later periods, possibly reflecting layered shifts in the socio-economic, cultural and political circumstances of the region. Fundamentally, the framework of image histories shown by the choice and sustenance of specific themes is understood to mean that their significance and specific graphic contexts throughout the chronological sequence are pivoted and mirrored through the long established hunter-gatherer rock paintings which predate periods of contact with other cultures. The resulting sequence and interpretation of these painted themes is a descriptive and organisational template reflecting the original organic character in the creation of the paintings and ordered cultural continuities in the use of animal/human symbolism. This book’s agenda in part involves reviewing the Western Cape’s changing social and historical landscape to show variation in painting over time and to project possible interpretative transformations. Painting sequences and cultural (dis)continuities are thus intricately entwined and can be disentangled through a recursive analytical relationship between archaeology, ethnography and history. This amalgamated analytical approach produces historicised narratives and contextual meanings for the rock paintings.
