Indes ist im Einzelnen ungeklärt, welche Ausschüttungssperren bei Bestehen eines Gewinnabführungsvertrages zugleich Auswirkungen auf den Höchstbetrag der Gewinnabführung und ggf. auch die Verlustausgleichspflicht zeitigen. Julian M. Egelhof widmet sich dieser Frage und untersucht daraufhin die Steuerrechtsfolgen insoweit fehlerhafter Ergebnisabführung.
