Edward Elgar Publishing Ltd Judicial Interpretation of Tax Treaties: The Use of the OECD Commentary
Judicial Interpretation of Tax Treaties is a detailed, comprehensive analytical guide to the interpretation of tax treaties at the national level. The book focuses on how domestic courts interpret and apply the OECD Commentary to the OECD Model Tax Convention on Income and on Capital. Adopting a global perspective, the book gives a systematic presentation of the main interpretive proposals put forward by the OECD Commentary, and analyses selected cases decided in domestic tax systems in order to assess whether and how such solutions are adopted through national judicial process, and indeed which of these are of most practical value. The book operates on two levels: Firstly it sets out a clear and comprehensive framework of tax treaty law, which will be an important tool for any tax practitioner. Secondly, the book provides crucial guidance on issues of tax treaty law as applied at domestic level, such as investment or business income, dispute resolution and administrative cooperation. Key features:- A detailed and structured introduction to the main issues of tax treaties- Ideal for practitioners requiring a grounding in the functioning of tax treaty law- Concise summaries of the relevant issues, cases, and problems for each discrete chapter- Offers a basic 'globalized' handbook that is missing in the current literature about judicial application of tax treaties. This comprehensive treatment of tax treaty law is a ready reference for tax practitioners, and an essential introduction for non-specialists. Edward Elgar Publishing Ltd EU Economic Law in a Time of Crisis
This book will be of interest to all those concerned with the EU, whether from the perspective of political science, law or economics. Under the shadow of the financial crisis, studies with a broad research perspective and contributors from diverse backgrounds are important.'- Paul Craig, St John s College, Oxford'The European Union is re-emerging from the most serious economic crisis in its history. The agenda of the European Commission was highly influenced by the decisions to handle the debt, euro, banking and financial crises. The Union and its single currency have become much stronger. Economic law and governance in the Union are now rather different. By reading this book you will see where and how.'- Siim Kallas, Former Vice President of the European Commission 2004-2014How has the EU's economic crisis affected the development of economic law in the Union? This book contributes to the debate by examining EU economic law from a contextual and policy-oriented perspective. The expert authors explore areas such as the EMU and the internal market, and emphasize the important fields of public procurement, taxation, and intellectual property rights. The investigation proceeds along themes such as harmonization, institutional interplay, non-economic values, and international actions. The authors conclude that, during the crisis, the attention of the Barroso Commission focused quite narrowly on the most urgent problems, failing to consider longer-term issues to spark off bold policy endeavours, and break inter-institutional blockages. This book is targeted at scholars, policy-makers and other practitioners, as well as students, interested in EU economic law, integration, and the economic crisis.Contributors: J. Edward Elgar Publishing Ltd Crisis and the Failure of Economic Theory: The Responsibility of Economists for the Great Recession
Economists have rightly been criticized for not having foreseen the crisis that exploded in 2007-2008. As Giancarlo Bertocco eloquently argues, responsibility does indeed rest heavily on their shoulders. By developing a theory which excluded the possibility that a catastrophic crisis could ever happen, the economics profession has justified decisions and behaviours that caused the Great Recession. This book presents an alternative theoretical approach built on the lessons of Marx, Keynes, Schumpeter, Kalecki, Kaldor and Minsky, which highlights the structural instability of a capitalist economy and the endogenous nature of the current crisis. This fascinating book has several distinctive features. It begins by highlighting the limits of traditional economic theory and reveals the contradictions found in mainstream explanations as to the origins of the crisis. The author goes on to argue that economists not only failed to foresee the crisis but actually ignored the warning signs of instability that emerged during the Great Moderation. Bertocco presents an original interpretation of Keynes's argument that underlines the importance of Schumpeter's theory of credit in order to explain the relationship between money and crisis which characterizes a Keynesian monetary theory of production. Finally, he demonstrates that the nature of the crisis has important policy consequences and proposes a specific set of measures that take into account its structural nature. The comprehensive analysis and enlightening theoretical approaches will make this book vital reading for economists, policymakers and students seeking a clear understanding of the nature of the current crisis and the structure of the neoliberal economic system in which we live.

Edward Elgar Publishing Ltd Financial Crises, 1929 to the Present, Second Edition
This fascinating volume offers a comprehensive synthesis of the events, causes and outcomes of the major financial crises from 1929 to the present day. Beginning with an overview of the global financial system, Sara Hsu presents both theoretical and empirical evidence to explain the roots of financial crises and financial instability in general. She then provides a thorough breakdown of a number of major crises of the past century, both in the United States and around the world. Hsu's thorough and ambitious survey begins with the Great Depression of 1929, the first crisis created within the institutions of our current financial system, and moves through the aftermath of the Depression in the 1930s and 1940s, the inter-crisis period of the 1950s through the 1970s, and the emerging market debt default crisis of the 1980s. From there, she tackles major crises in specific countries from the 1990s on, including those in Mexico, Asia (Thailand, Indonesia, South Korea and Malaysia), Russia, Brazil and Argentina, as well as the Great Recession of 2008. The book concludes with a chapter detailing insightful policy recommendations for preventing future crises. Students and professors of economic history, financial and regulatory economics and banking will find this an invaluable resource, both for its comprehensive historical approach and its thoughtful look toward the future of the global economy.

Edward Elgar Publishing Ltd Heat, Greed and Human Need: Climate Change, Capitalism and Sustainable Wellbeing
'There are few scholarly books about climate change that take the issue of the distribution of its costs, and of the costs and benefits of its mitigation, as seriously as their absolute value. This is probably the best of those books that I have come across. Rigorously rooted in Gough's earlier work on theories of human need, the book is relentless in its pursuit of equity in respect of climate change and responses to it. Not everyone will agree with all its conclusions - for example that ''green capitalism merits the term contradiction'' - but they are unfailingly thought-provoking, as all good scholarship should be. Highly recommended.'- Paul Ekins, UCL Institute for Sustainable Resources, UK 'Gough applies his trademark scholarship on universal human needs to the urgent question of social policy for the transition to a de-carbonised world. Based on a clear-eyed analysis of a wide swathe of the social science literature, and an eco-social political economy perspective, his approach is both pragmatic and deeply rooted in ethics and social justice. Highly recommended and suitable for teaching at all levels.'- Juliet B. Schor, Boston CollegeThis exceptional book considers how far catastrophic global warming can be averted in an economic system that is greedy for growth, without worsening deprivation and inequality. The satisfaction of human needs - as opposed to wants - is the only viable measure for negotiating trade-offs between climate change, capitalism and human wellbeing, now and in the future. The author critically examines the political economy of capitalism and offers a long-term, interdisciplinary analysis of the prospects for keeping the rise in global temperatures below two degrees, while also improving equity and social justice. A three-stage transition is proposed with useful practical policies. First, 'green growth': cut carbon emissions from production across the world. Second, 'recompose' patterns of consumption in the rich world, cutting high-energy luxuries in favour of low-energy routes to meeting basic needs. Third, because the first two are perilously insufficient, move towards an economy that flourishes without growth. Heat, Greed and Human Need is vital for researchers and students of the environment, public and social policy, economics, political theory and development studies. For those advocating political, social and environmental reform this book presents excellent practical eco-social policies to achieve both sustainable consumption and social justice.

Edward Elgar Publishing Ltd Corporate Governance, The Firm and Investor Capitalism: Legal-Political and Economic Views
The shift from managerial capitalism to investor capitalism, dominated by the finance industry and finance capital accumulation, is jointly caused by a variety of institutional, legal, political, and ideological changes, beginning with the 1970s' down-turn of the global economy. This book traces how the incorporation of businesses within the realm of the state leads to both certain benefits, characteristic of competitive capitalism, and to the emergence of new corporate governance problems. Contrasting economic, legal, and managerial views of corporate governance practices in contemporary capitalism, the author examines how corporate governance has been understood and advocated differently during the New Deal era, the post-World War II economic boom, and after 1980 in the era of free-market advocacy. Covering the theory of the firm from the New Deal era until the post-2008 financial crisis, the book connects contemporary theories with their original legal roots, demonstrating inconsistencies in contemporary understanding. It also points at the differences between legal theory and neoclassical economic theory regarding the theory of the firm. The book examines how the entrenchment of shareholder welfare governance turns a blind eye to legal theory and corporate law, leading to theoretical inconsistencies and practical concerns, and criticises the agency theory argument in favour of unrestricted shareholder welfare governance. A comprehensive review of the literature on corporate governance, both in legal theory and in economics and management studies is included. This enlightening and informative book is essential reading for corporate governance scholars, management studies researchers, legal theorists and business historians.

Edward Elgar Publishing Ltd International Claims Commissions: Righting Wrongs after Conflict
International claims commissions have, over the last few decades, established themselves as important and permanent fixtures in international adjudication. This book provides a comprehensive review and analysis of the workings and mechanics of claims commissions to assess their success and predict their utility in the future. The book examines the legal framework of an international claims commission and the basic elements its processing procedure, as well as exploring the difficulties and challenges associated with operating costs, remedies and compliance with judgments. International claims commissions are created ad hoc to consider large numbers of complex legal claims resulting from an international upheaval, making them important international dispute resolution mechanisms. By focusing in large part on the examples set by the United Nations Claims Commissions, the Iran US Claims Tribunal, and the Eritrea Ethiopia Claims Commission, the authors assess the reasons to establish a claims commission by discussing their legal and operating structures, issues related to evidence and costs and the challenges and successes of creating them. The book concludes with a detailed analysis of lessons learnt to guide policy makers in the creation of future claims commissions. Written by two academics and a former practitioner this book is a practical resource for international law academics; counsel and judges in international courts and tribunals; policy makers in international organizations and foreign ministries, and diplomats.

Edward Elgar Publishing Ltd What’s Wrong with Keynesian Economic Theory?
One of the most striking phenomena in all of economics is the absence of a deep tradition of criticism focused on Keynesian economic theory. There have been critics but they are few and far between, even though Keynesian demand management has been at the centre of some of the worst economic outcomes in history, from the great stagflation of the 1970s to the twenty-year 'lost decade' in Japan that has been ongoing since the 1990s, and now, once again, the dismal recoveries that have followed the Global Financial Crisis. This book brings together some of the most vocal critics of Keynesian economics of the present time. Each author attempts to explain what is wrong with Keynesian theory for those seeking guidance on where to turn for a more accurate explanation of the business cycle and what to do when recessions occur. The contributions are by scholars from a wide number of schools of economics, include but are not restricted to Austrian, monetarist and classical perspectives. Written not just for economists, this accessible book is one of the few anti-Keynesian texts available and explains the inability of public spending and lower interest rates to have restored robust economic growth and full employment after the GFC. The collection offers an antidote to contemporary macroeconomic theory. It is an essential text for anyone wishing to understand why no stimulus has been able to bring recovery to any economy in which it has been tried.Contributors include: P.Boettke, P.L. Bylund, T. Edward Elgar Publishing Ltd Entrepreneurial Identity: The Process of Becoming an Entrepreneur
'Entrepreneurial identities permeate virtually every facet of the venturing process, but the study of these identities has received surprisingly little attention among scholars. Thomas Duening and Matthew Metzger address this problem with this insightful and timely edited volume. They have compiled an impressive array of research that covers both macro- and micro-level explorations of entrepreneurial identities. Most importantly, these chapters provide numerous examples of tangible advice to interested educators about how to foster the entrepreneurial spirit and build the entrepreneurial identity within their own students. This book is a must-read for anyone interested in entrepreneurial identities.'- Charles Murnieks, Oregon State University, US Entrepreneurship is an academic discipline that, despite decades of growth in research and teaching activity lacks a traditionally distinct or common pedagogy. In this book, editors Thomas N. Duening and Matthew L. Metzger explore entrepreneurial identity as a new basis upon which curricula can be constructed for aspiring entrepreneurs. Critically, this perspective is based on the insight that there is a fundamental difference between venture development and entrepreneur development. Unfortunately, most current interventions for aspiring entrepreneurs focus on the former at the expense of the latter. The editors have collected work from an international team of authors with diverse views on how identity theory applies to entrepreneur development. Chapters focus primarily on macro-level identity issues (that is, how do these entrepreneurial archetypes form, persist, and sometimes change) or micro-level identity issues (that is, how can educators and resource providers identify, communicate, and incentivize identity construction among aspiring entrepreneurs). This book provides a general theoretical background and offers numerous suggestions for application and further research. One example of this is the 'For Further Reading' feature at the end of each chapter which is perfect for assisting those who want to delve deeper into various topics. This essential resource will be of interest to researchers, resource providers and students alike.Contributors include: D. Boje, A. Donnellon, T.N. Duening, R. Gill, B. Mathias, M.L. Metzger, R. Edward Elgar Publishing Ltd Handbook of Research on Nonprofit Economics and Management: Second Edition
Nonprofit organizations are arguably the fastest growing and most dynamic part of modern market economies in democratic countries. This Handbook explores the frontiers of knowledge at the intersection of economics and the management of these entities. Top researchers in the field review the role, structure, and behavior of private, nonprofit organizations as economic units and their participation in markets and systems of public service delivery, assess the implications of this knowledge for the efficient management of nonprofit organizations and the formulation of effective public policy, and identify cutting-edge questions for future research.Building on the success of the first edition, this thoroughly revised and expanded edition explores: (1) areas of general agreement from previous research; (2) areas of conflicting results and unexplored questions; (3) the relative roles of theory, data availability, and empirical analysis in explaining gaps in our knowledge; and (4) what must be done to improve our knowledge and extend the literature. Selected original chapters addressing especially challenging topics include: the value of risk management to nonprofit decision-making; nonprofit wages theory and evidence; the valuation of volunteer labor; property tax exemption for non-profits; when is competition good for the third sector; product diversification and social enterprise; international perspectives; the application of experimental research; and the macroeconomic effects of the nonprofit sector. This book is a valuable resource for academics, but the concerns of nonprofit sector managers and decision-makers are also addressed, making it a useful reference for practitioners as well.Contributors include: S. Edward Elgar Publishing Ltd The Present and Future of European Family Law
As Britain's leading comparative Family Law scholar, Jens Scherpe demonstrates his considerable knowledge and expertise in this, the final book, in the series on European Family Law. Drawing on the three earlier works in the series (of which he is the editor) Scherpe starts by convincingly arguing that there is such a thing as European Family Law and then examines the concept from different perspectives, namely, institutional and organic, and horizontal, vertical and individual European Family Law. He ends by speculating about future developments. Written in an easy-to-read yet not unchallenging style The Present and Future of European Family Law is a 'must read' for all those interested in Family Law particularly as the subject can no longer be sensibly studied purely from a domestic angle.'- N.V. Lowe, Cardiff University, UKThe Present and Future of European Family Law explores the essence of European family law - and what its future may be. It compares and analyzes existing laws and court decisions, identifies trends in legislation and jurisprudence, and also forecasts (and in some cases proposes) future developments. It establishes that while there is, at present, no comprehensive European family law, elements of an 'institutional European family law' have been created through decisions by the European Court on Human Rights and by the Court of Justice of the European Union as well as other EU instruments. At the same time an 'organic European family law' is beginning to emerge. The laws in many European jurisdictions have developed similarly and have 'grown together', not only as a result of the aforementioned institutional pressures, but also as a result of societal developments, and comparable reactions to medical and societal advances and changes. Hence there already is a body of institutional and organic European family law, and it will continue to grow. This book, and the others in the set, will serve as an invaluable resource for anyone interested in family law. It will be of particular use to students and scholars of comparative and international family law, as well as family law practitioners.

Edward Elgar Publishing Ltd European Family Law Volume I: The Impact of Institutions and Organisations on European Family Law
The Impact of Institutions and Organisations on European Family Law looks at the impact that institutions and organisations have had, and continue to have, on European family law. In many ways the chapters in this volume provide the easiest explanation for the existence of a European family law. While there is no European body that could actually legislate definitively on family law even the European Union has no such mandate there are still some obvious institutions that have a very direct impact on European family law. These can be divided into two groups; namely those that have a direct impact, such as the European Court of Human Rights and the European Union, and those that have an indirect impact, such as the Commission on European Family Law (CEFL), the Council of Europe and the International Commission on Civil Status (ICCL/CIEC) as well as the private international law instruments of the Hague Conference (HCCH) and the EU. Together, with religion, all of these institutions are contributing to the creation of a European family law. This book, and the others in the set, will serve as an invaluable resource for anyone interested in family law. It will be of particular use to students and scholars of comparative and international family law, as well as family law practitioners.Contributors: H. Baker, K. Boele-Woelki, D. Coester-Waltjen, G. Edward Elgar Publishing Ltd International Trade and Food Security: Exploring Collective Food Security in Asia
If you care about food security in Asia and particularly rice and world trade, buy this book. The best authors in the business (legal, academic and private sector) have contributed to its success with 12 treatises on core issues. I complement the editors of this compendium, Michael Ewing-Chow and Melanie Vilarasau Slade, for their intellectual courage in bringing these experts to contribute to one book. The technical side of these issues have been kept at a minimum wherever possible for the general reader. Each chapter relates to the others and guides us to some conclusions and a call to action.'- Milo Hamilton, Firstgrain, US'This is a complete recipe for global food security as the most credible way forward in a world of continuously uncertain food supplies. Today the overall intact agricultural production potential appears mainly threatened by location-specific climate change challenges and by both national and international food policy governance failures. Hence, the role of trade and of trade rules is all the more important, as credibly emphasised by the authors' consequent advocacy for a removal of food trade barriers as part of a more coherent poverty strategy and towards collective food security.'- Christian Häberli, Bern University, Switzerland'Food security is one of the key challenges the world faces. The demand for food will increase as our population goes up from 7 billion to 9 billion. Global warming and an increasingly erratic weather pattern will have an impact on food production. It is in this context that I welcome this important book. The editors have rightly invited us to refocus our minds from self-sufficiency to collective food security.'- Tommy Koh, Chairman of the Governing Board Centre for International Law, National University of SingaporeFood security is one of the greatest challenges of our time. The food price crisis of 2008 exposed the vulnerabilities of the global food system. Governments across Asia acerbated the crisis by imposing export restrictions based on a policy of self-sufficiency.This book assesses whether self-sufficiency is an adequate response to the food security challenges we face. Pricing volatility drives isolationism at a time when climate change and increasingly uncertain weather patterns make it difficult for any single nation to guarantee adequate food production for itself.Through a collection of commissioned studies which draw upon the experience of leading experts and scholars in trade, investment, law, economics, and food policy, this book analyses the impact of this trend on the most essential crop in the Asian region rice.It suggests that food security policy should be reconceptualised: from the national to the regional and even the global level. It also provides its own proposals as to how this new paradigm of collective food security should be understood and developed. The book calls for a new conversation in the region, acknowledging that the challenges we face are global and the solutions must be found in collective action. This state-of-the-art study will appeal to lawyers, economists and political scientists, as well as trade and food security specialists by providing expert analyses and enlightening solutions for the future.Contributors: C. Edward Elgar Publishing Ltd Hybridization of Food Governance: Trends, Types and Results
Modern food governance is increasingly hybrid, involving not only government, but also industry and civil society actors. This book deftly analyzes the unfolding interplay between public and private actors in global and local food governance. Split into three parts, chapters focus on the legitimacy and integrity of private food governance, the hybridization of EU Food Law and hybridization in transnational food governance. Within these key areas, food scholars from diverse disciplinary fields present a fascinating array of original empirical case studies, showing hybrid governance arrangements in China, Europe and North America. Through these practical examples, they consider in detail how the responsibilities and risks inherent in these arrangements are allocated, how their legitimacy is ensured and the effect that they have on industry and government practice. Timely and discerning, this book will appeal to legal students and scholars focusing on regulation and governance and, in particular, those considering its relation to food. It will also provide guidance to policymakers on how to shape and direct the trends, types and outcomes of hybrid food governance.Contributors include: D. Casey, E. Fagotto, M. Faure, A. Fearne, M. Edward Elgar Publishing Ltd The Disappearing Product: Marketing and Markets in the Creative Industries
'Chris Bilton pursues a critical issue for everyone in arts and entertainment. The giants of the internet age have disintermediated IP owners. How can creators of content reclaim their relationship with their audiences?'- Peter Bazalgette, Chair of ITV and previously Chair of Arts Council England 2012-2016 The Disappearing Product combines analysis of developments in the creative economy with practical guidance for marketing in the creative industries. Edward Elgar Publishing Ltd The Rise of the Hybrid Domain: Collaborative Governance for Social Innovation
By conceptualizing the rise of the hybrid domain as an emerging institutional form that overlaps public and private interests, this book explores how corporations, states, and civil society organizations develop common agendas, despite the differences in their primary objectives. Using evidence from India, it examines various cases of social innovation in education, energy, health, and finance, which offer solutions for some of the most pressing social challenges of the twenty-first century. Yuko Aoyama and Balaji Parthasarathy position social innovation at the intersection of changing state-market relations, institutional design, and technological innovation. By demonstrating how corporations, social entrepreneurs, and social finance increasingly cross borders to devise local solutions with global technologies, this book illustrates how collaborative governance can serve as a useful alternative to blend economic and social objectives by overriding organizational boundaries which were previously considered ideologically incompatible and, therefore, unbridgeable. Engaging with the question of collective capacity building, this book will be of interest to a broad and multi-disciplinary audience, from those studying innovation, science and technology policy, and entrepreneurship, to those working in international governance and development.

Edward Elgar Publishing Ltd Should Britain Leave the EU?: An Economic Analysis of a Troubled Relationship, Second Edition
The policy framework advocated by Minford et al. . . . is grounded in economic theory and an incisive empirical analysis of the costs of UK's membership of the EU. Their thesis that the EU is a political union practising economic protectionism in the guise of gradualism towards free trade makes sense. . . . Minford and his associates' analysis suggests that the EU's policy framework of free trade for members but restrictions on trade of non-members with the EU countries is a second best policy adopted to promote political rather than economic objectives.'- V.N. Balasubramanyam, Lancaster University, UK'The EU got the Nobel Prize for Peace in 2012, but such an award is not forthcoming for economics. In fact, the EU faces a stern public discontent throughout Europe. For years EU leaders have been unable to agree on almost anything. The eurozone's toxic monetary embrace is a colossal failure that has provoked misery in most of the participating countries and, worst of all, suffocated the hopes of prosperity for many years to come. The EU is no longer a venture that inspires people to run on barricades to defend it. Should Britain be a part of the crumbling EU project? This book provides a timely and documented answer. It is highly recommended reading.'- Miroslav N. Jovanovi , University of Geneva, Switzerland'Much too much of the debate about the UK's relationship with the European Union relies upon general declarations unsupported by facts and assertions and claims not substantiated by evidence. This is why we need so badly the careful quantitative analysis provided by Patrick Minford and his colleagues. The UK electorate will have a momentous decision to take when the EU referendum takes place. History and emotions will be important, but getting the facts straight is even more vital.'- John Mills, Founder and Chairman of JML and Co-Chairman of Business for Britain'Patrick Minford and his team have performed a hugely valuable service by quantifying the costs of Britain's EU membership. In particular, they show that Britain pays too much for too high a proportion of its imports. The EU's protectionism in its trade with the rest of the world costs Britain a significant slice of its national output. Their demonstration of this vital point is thought-provoking and sophisticated, and greatly strengthens the case for the UK to leave the EU.'- Tim Congdon, CBE, International Monetary Research LtdPlaced in the context of the upcoming referendum, this second edition brings up to date a thorough review of all economic aspects of the UK's membership of the EU. It notes the intention of the EU to move to 'ever closer union' and the nature of the regulatory and general economic philosophy of its dominant members, whose position is enforced by qualified majority voting. The book highlights the UK s dilemma that, while extending free markets to its local region is attractive, this European philosophy and closer union are substantially at odds with the UK's traditions of free markets and freedom under the common law. This comprehensive examination of the economic costs and benefits of membership uses state-of-the-art modeling methods and includes estimates of its net costs as a percentage of GDP. The book explains how the decision to leave would follow from a judgement on the political economy of the EU as compared with that of the UK. It details the misconceptions involved in much of the debate about trade with the EU, and argues that the key issue is not access to markets but rather the prices at which trade takes place. Covered in careful detail is the economics of the UK's trade with the EU in the key sectors of agriculture, manufacturing, and services.

Edward Elgar Publishing Ltd Balancing the Regulation and Taxation of Banking
Given the critical role played by banks and their behaviour during the global financial and sovereign debt crises, this excellent book on Balancing the Regulation and Taxation of Banking by Sajid M. Chaudhry, Andrew W. Mullineux and Natasha Agarwal could not be more timely. It provides an excellent in-depth analysis of how banks are taxed and regulated in various countries - including financial transaction taxes, VAT and other fiscal treatments. It also provides thought provoking recommendations on how tax and fairness of treatment of banks should be balanced.'- Philip Molyneux, Bangor University, UKThis concise book gives a unique overview of bank taxation as an alternative or a compliment to prudential regulation or non-revenue taxation. Existing bank taxation is reviewed with a view to eliminating distortions in the tax system, which have incentivized banks to engage in risky activities in the past. The authors analyse the taxation of financial instruments trading, as well as the taxation of banking products and services to gauge whether this could finance resolution mechanisms and also help to ensure the stability of banks. In this respect, the authors put forward several arguments. Firstly, they contend that a financial transaction tax is economically inefficient, potentially costly for the economy, but if set at an appropriately low rate may be used to assure banks make a 'true and fair contribution' to their implicit insurance by taxpayers. Secondly, they show that a bank levy used to finance deposit guarantee and bank resolution mechanisms is potentially useful for financial stability, but that it poses the threat of double taxation, together with the proposed Basel III liquidity ratios. Thirdly, the authors argue in favour of the elimination of exemption from value added tax (VAT) for financial services in order to provide banks with a level playing field, whilst retaining exemption for basic payment services that are infrastructural. This is expected to improve efficiency by reducing the wasteful use of financial services. This book is an invaluable resource to students, academics and researchers in the fields of banking regulation and taxation. Policymakers and those with a wider interest in the issues will find it both topical and enlightening.

Edward Elgar Publishing Ltd The Search for Environmental Justice
This thoughtful book provides an overview of the major developments in the theory and practice of 'environmental justice'. It illustrates the direction of the evolution of rights of nature and exposes the diverse meanings and practical uses of the concept of environmental justice in different jurisdictions, and their implications for the law, society and the environment. The term 'environmental justice' has different meanings to different scholars and is applied in many different contexts. For some, the focus is on equal distribution of the earth's benefits, with concern for the interests of the less wealthy, disadvantaged minorities, or indigenous peoples. For others, the focus is on the interests of the earth and nature itself. Additionally, for some, environmental justice is a framework for discourse, whilst for others it connotes specific legal principles and procedures. The application of these interpretations through the law involves diverse approaches and rules. In this timely book, expert contributors identify the meanings and the practical translations of environmental justice, reflecting the perspectives of academic, judicial and indigenous people from many countries. Among the issues considered are the rights of nature and its application through judicial practice, and approaches to respecting the laws, cultures and the rights of Indigenous peoples. This integrated exploration of the topic will provide an excellent resource for scholars, judicial officers and practitioners interested in environmental and social justice issues.Contributors: J. Edward Elgar Publishing Ltd Anti-Corruption Strategies in Fragile States: Theory and Practice in Aid Agencies
Aid agencies increasingly consider anti-corruption activities important for economic development and poverty reduction in developing countries. In the first major comparative study of work by the World Bank, the European Commission and the UNDP to help governments in fragile states counter corruption, Jesper Johnson finds significant variance in strategic direction and common failures in implementation. In a refreshing departure from existing literature on corruption, Anti-Corruption Strategies in Fragile States takes a public administration perspective, studying the role of organisational factors in the success of anti-corruption strategies. It is widely acknowledged that governance and anti-corruption interventions play a crucial role in reducing fragility and building legitimate and resilient institutions. Policy makers have re-framed development goals for fragile states to achieve stability by addressing their special characteristics: weak institutions and governance; low capacity and legitimacy in government; and vulnerability to violence. This book shows how anti-corruption and state-building policies are often disconnected or incoherent, and how executional challenges prevent strategies from translating into results. This book will be of interest to researchers and students studying (anti-)corruption, aid, international organisations or fragile states. It will be an invaluable resource for staff in aid agencies and NGOs in the fields of governance, accountability and transparency.

Edward Elgar Publishing Ltd Madness and Leadership: From Antiquity to the New Common Era
Why have multitudes of followers throughout history become attracted to leaders who demand sacrifice, campaigns of war or other adventures with unpredictable outcomes? Why do they command such powerful control over their followers? Madness and Leadership studies leaders and followers from social, cultural, and biological perspectives and explores aspects of their personalities that induce them to assume their respective roles. It proposes that leadership and followership are evolutionary adaptations, developed to enhance survival and group cohesion; that leaders possess certain biologically derived personality traits which set them apart and alert followers, consciously or unconsciously, of their status. Important factors that enhance leader emergence have been linked through evolution and are constituents of all societies, past and present. Within political theories and historical examples, this book carries the discussion on leadership into a new direction by suggesting that mild psychopathology is one of its central components. This pioneering multidisciplinary exploration of mental illness and leadership will give readers a better understanding of leadership phenomena, with a critical approach explaining why time and again followers choose leaders with psychological shortcomings. Papacostas's biopsychosocial perspective will appeal to social scientists, linguists, neuroscientists, historians, and scholars and academics of leadership studies.

Edward Elgar Publishing Ltd Understanding the Nature of Law: A Case for Constructive Conceptual Explanation
Understanding the Nature of Law explores methodological questions about how best to explain law. Among these questions, one is central: is there something about law which determines how it should be theorized?Michael Giudice presents the problem: several methods suggest themselves as suitable to understanding law; however, each method claims unique importance with no need of others. A solution is offered in two key claims. First, many conceptual theories of law are best understood not as the result of conceptual analysis, but as constructive conceptual explanations, emphasizing a crucial role for revision and expansion of ordinary concepts, in ways responsive to new problems and new phenomena. Second, conceptual theories of law can and ought to identify necessary as well as contingent features in the construction of conceptual explanations of law. This novel book explains the importance of conceptual explanation by situating its methods and goals in relation to, rather than in competition with, social scientific and moral theories of law.The book will be of primary interest to both students and academics in legal, political, and moral philosophy. It will also be of interest to students and academics working in the social sciences who are interested in questions about the distinctive character of law.

Edward Elgar Publishing Ltd Accessibility, Equity and Efficiency: Challenges for Transport and Public Services
This book uses the powerful lens of accessibility analysis to answer questions in spatial development, travel behavior, facilities planning, locational efficiency, metropolitan resilience, and more. Its pragmatic and empirical approach - and its bringing together of leading accessibility scholars into a single volume - make it an invaluable reference for scholars and policymakers in the areas of transportation, land use, and public-service provision.'- Jonathan Levine, University of Michigan, US'Efficiency and equity are key issues in accessibility studies. Infrastructure investment should be as economically efficient as possible while ensuring a basic level of accessibility for all social groups and territories. This book is set within the complex relationship between efficiency and equity, providing a number of contributions that reveal the importance of accessibility on regional growth, access to services, house prices, modal choice and transport policies. The authors of these chapters are leading researchers in different disciplines making high level contributions in the field of accessibility. Without a doubt, this book will be very attractive for readers interested in accessibility and transportation.'- Javier Gutiérrez, Universidad Complutense de Madrid, SpainLeading researchers from around the world show, in this volume, the importance of accessibility in contemporary issues such as rural depopulation, investments in public services and public transport, and transport infrastructure investments in Europe. The trade-offs between accessibility, economic development and equity are comprehensively examined, and a variety of approaches to measuring accessibility and equality presented. The book's interdisciplinary contributions also provide different geographical contexts, from the US to various European and developing countries, and cover ex ante and ex post evaluation of transport investment.Improving transport accessibility is a main objective in transport policy and planning in developed and developing countries all over the world. Investment is motivated by the need to develop and/or reduce spatial or social inequalities. However, the economic and equity implications of investments in transport are not straightforward. The concepts of accessibility and equity can be defined and operationalized in many different ways, influencing outcomes and conclusions. Moreover, equity and efficiency goals are often conflicting. Accessibility models not only help to explain spatial and transport patterns in developed and developing countries but are also powerful tools to explain the equity and efficiency impacts of urban and transport policies and projects. This state-of-the-art overview of the accessibility-economic efficiency-equity relationship will appeal to researchers as well as transport and urban planners interested in accessibility issues and transport/regional developments.Contributors: P.R.
