Edward Elgar Publishing Ltd Trade in Water Under International Law: Bulk Fresh Water, Irrigation Subsidies and Virtual Water
Freshwater is an increasingly scarce resource globally, and effective sustainable management will be absolutely crucial in the future. This timely book sets out future scenarios of international trade in both 'real' and 'virtual' water, examining the relationship between climate change, water scarcity, the human right to water and World Trade Organization law. Trade in Water Under International Law addresses questions of global importance such as: how can international trade in bulk water contribute to the advancement of the human right to water? Are 'green-boxed' irrigation subsidies disturbing the markets? Should water-footprint process and production methods allow for a different treatment of otherwise 'like' products? From examining the impact of water law on small-scale farmers in developing countries, to the broader issue of global environmental responsibility, Fitzgerald Temmerman explores the options available for fair resource allocation through international law arrangements such as the General Agreement on Tariffs and Trade, and the Agreement on Technical Barriers to Trade. By taking a wide-reaching and non-technical approach, this book will capture the attention not only of international trade law professionals, but of all stakeholders in the field. With such relevance to contemporary environmental issues, this book will also be of interest to non-legally qualified individuals who want to comprehend the future possibilities of fair water trade.

Edward Elgar Publishing Ltd International Investment Law and the Global Financial Architecture
The global crises of the early 21st century have tested the international financial architecture. In seeking to ensure stability, governments have regulated financial and capital markets. This in turn has implicated international investment law, which investors have invoked as a shield against debt restructuring, bail-ins or bail-outs. This book explores whether investment law should protect against such regulatory measures, including where these have the support of multilateral institutions. It considers where the line should be drawn between legitimate regulation and undue interference with investor rights and, equally importantly, who draws it. Across the diverse chapters herein, expert international scholars assess the key challenges facing decision makers, analyze arbitral and treaty practice and evaluate ways towards a balanced system of investment protection in the financial sector. In doing so, they offer a detailed analysis of the interaction between investment protection and financial regulation in fields such as sovereign debt restructuring and bank rescue measures. Combining high-level analysis with a detailed assessment of controversial legal issues, this book will provide guidance for both academics and legal practitioners working in international economic law, international arbitration, investment law, international banking and financial law.Contributors include: A. Edward Elgar Publishing Ltd Origins of Organizing
The origins of organizing are conventionally seen as emerging from the historiographical works of Western social scientists in the early 20th century. Here, the authors address a gap in current literature by exploring previously unrecognized or marginalized global origins in both modern and ancient history. This innovative collection of original, research-based work covers a variety of historical epochs and theoretical streams from ancient civilizations to modern movements in philosophy and the social sciences. Among other topics, the chapters evaluate ideas of organizing by Quakers, 16th-century Jesuits and communities in the Roman Empire and ancient China. The authors creatively and insightfully engage with the historiography and philosophy of organizing, presenting alternatives to the dominant Western-focused development of organizational theory and practice. Origins of Organizing is significant in expanding the field of organizational theory to incorporate key examples that move away from mainstream and traditional perspectives. Edward Elgar Publishing Ltd Rethinking Contract Law and Contract Design
In this volume, Victor Goldberg reassesses a collection of key contract law doctrines, largely through original economic analyses of well-known cases involving sophisticated parties. The results are thoughtful and provocative. They leave the impression that the law might produce more efficient consequences if contractual liability were more restrictive. Contracts teachers may well teach these and other cases differently after reading Goldberg's chapters.'- Steven J. Burton, The University of Iowa, US'This book offers valuable insights and new perspectives on the often thorny problems of contract law as it can - and does - affect 'sophisticated parties'. Lawyers as well as academics on both sides of the Atlantic will welcome the important contribution made here to the ongoing debates which rage continually within this core area of the law.'- Phillip Taylor MBE and Elizabeth Taylor, The Barrister MagazineContract law allows parties to set their own rules within constraints. It provides a set of default rules and if the parties do not like them, they can change them. Rethinking Contract Law and Contract Design explores various long-standing contract doctrines, casting them in a new and compelling light by focusing on the economics of contractual relations.Building upon and extending the arguments set forth in his acclaimed book Framing Contract Law, Goldberg revisits many of the seminal contract cases and places those decisions under close scrutiny, challenging readers, by means of forensic exploration of records, briefs, and other materials, to reconsider their conclusions. Split into four parts, the author examines direct damages, consequential damages, the excuses doctrines (including impossibility, impracticability and frustration), and offer and acceptance.Asking the questions that often go unasked, and challenging the assumptions silently accepted by the majority, one of Goldberg's many insightful observations, and an underlying thread to the book, is that achieving an economic understanding of contract design will illuminate both contract doctrine and contract interpretation.Written with clarity and poise, Rethinking Contract Law and Contract Design is set to ignite plenty of debate amongst contract scholars and contract drafters, and provides the anvil upon which future generations of contract thinking can be forged. Contract scholars and students interested in exploring new perspectives on the topic will find this to be an essential read, as will contract lawyers and judges.

Edward Elgar Publishing Ltd Proportionality, Reasonableness and Standards of Review in International Investment Law and Arbitration
International investment law is one of the most dynamic fields of international law, and yet it has been criticised for failing to strike a fair balance between private and public interests. In this valuable contribution to the current debate, Valentina Vadi examines the merits and pitfalls of arbitral tribunals? use of the concepts of proportionality and reasonableness to review the compatibility of a state?s regulatory actions with its obligations under international investment law. Investment law scholars have hitherto given greater attention to the concept of proportionality than to reasonableness; this pivotal book combats this trajectory by examining both concepts in such a way that it does not advocate one over the other, but instead enables the reader to make informed choices. The author also explores the intensity of review as one of the main tools to calibrate the different interests underlying investor-state arbitrations. This timely book offers a useful conceptual framework for reconciling the opposing interests at stake, making it a valuable resource for international law scholars and practitioners and other interested readers.

Edward Elgar Publishing Ltd Law’s Political Foundations: Rivers, Rifles, Rice, and Religion
Law's Political Foundations: Rivers, Rifles, Rice and Religion explains the development of the two basic systems of public and private law and their historical transformations. Examining the historical development of law in China, Japan, Western Europe, and Hispanic America, Haley argues that law is a product, rather than a constitutive element, of political systems.Four narrative chapters commence with the development of Chinese legal tradition as a public law order in which regulatory and penal rules were central, compared to the primacy of private law in Western Europe. China was not only among the earliest but also historically the most enduring example of public law order. The European Legal Tradition, in contrast, became the source of the private law structures of legal systems worldwide. The Japanese and Hispanic American experiences are explored as pivotal links that help to identify foundational factors that underpin the historical development of public and private law orders. Also explained in both contexts is the endurance of private ordering both within and beyond the law. These vivid comparisons and analyses in these stories of rivers, rifles, rice, and religion will serve as an excellent critical resource for scholars and academics of comparative law and legal theory.

Edward Elgar Publishing Ltd Social Innovation and Democratic Leadership: Communities and Social Change from Below
While liberal-representative democracies tend to conform to a consensus-based post-political paradigm where there is no space for alternatives and dissensus; new forms of democracy in practice are emerging from below. This book explores new socially innovative initiatives that have appeared following the 2011 global uprisings. Initiatives that flourish not only as alternative responses to current social needs but also as new forms of democracy, a democracy that comes from below, by and for the 'have-nots'. Combining theories of social innovation and collective leadership, this book analyses how disadvantaged communities have addressed the effects of economic recession in two global cities: Barcelona and New York. It draws upon several socially innovative initiatives in four neighbourhoods, and offers new knowledge, ideas and tools, both to better understand how social needs could be effectively and democratically satisfied, and to foster social change initiatives at the community level. Civic capacity and democratic leadership practices emerge as crucial factors to make social change happen. Edward Elgar Publishing Ltd Reforming the Common Fisheries Policy
This timely book provides a critical examination of the policies and laws governing EU marine fisheries and the shortcomings of the 2013 Common Fisheries Policy (CFP) reform. In particular it considers how reform is impeded by Treaty-guaranteed concessions, exemptions from general environmental legislation and the Court of the Justice's interpretation of principles unique to the sector. The author discusses how the damaging effects of fishing could be ameliorated if the Court were to align fishery values with general principles of the law, and considers the institutional and regulatory frameworks needed to encourage prudent resource use.The limited development of the CFP beyond the minimal requirements of international law is considered together with the role of the Court in sidelining scientific advice. The book provides a unique exploration of how these barriers to sustainability are compounded by regulatory capture and the public interest in fish resources being unrecognized. Ultimately, the author proposes that the incoherence of the management regime be redressed through market-based reforms and the application of the user-pays principle. This book will be of keen interest to lawyers, environmentalists, policy-makers and marine scientists who are interested in marine fishery management, marine environmental protection, and marine sector economic sustainability. It will also appeal to those involved in developing trans-disciplinary platforms to promote marine resource sustainability.

Edward Elgar Publishing Ltd Operating Law in a Global Context: Comparing, Combining and Prioritising
Lawyers have to adapt their reasoning to the increasingly global nature of the situations they deal with. Often, rules formulated in a national, international or European environment must all be jointly applied to a given case. This book seeks to make explicit the analysis the lawyer engages in every time he or she is confronted by the operation of several laws in different contexts. This reasoning is organised according to a basic three-step approach, consisting of the comparison (Part 1), combination (Part 2) and, finally, ordering or 'prioritization' (Part 3) of the methods and solutions of national, international and European law to be used to solve the case. The book conveys in detail how the law is operated through a wide range of concrete examples cutting across domains including criminal law, contract law, fundamental rights, internal market, international trade and procedure. This book focuses on the needs of a global lawyer who must reach conclusions in a pluralistic context. Illustrations from the domestic case law of the UK, Germany, Belgium, Italy, Spain, France and the US are used to demonstrate how lawyers can combine different contexts to improve their legal reasoning. Operating Law in a Global Context will appeal to lawyers in these jurisdictions and beyond, as well as to students training to practice in a global environment.

Edward Elgar Publishing Ltd Critical Studies of Innovation: Alternative Approaches to the Pro-Innovation Bias
Different theories, models and narratives of innovation compete for both legitimacy and authority. However, despite the variations, they all offer a consistent pro-innovation bias, dismissing resistance as irrational, and overlooking the value of non-users and collateral impacts. This book asks, what has been left out? It offers a reflexive view and invites researchers to consider new avenues of research, through a critique of current representations of innovation. The chapters provide a different viewpoint on innovation by exploring what has been omitted from traditional innovation studies. The book examines imitation, non-innovative roles, resistance to innovation, slow innovation, the rationale of non-users, failure, withdrawal, collateral impacts and alternative models. Calling for new definitions and frameworks, the editors have created a critical program for innovation studies with new avenues for future research. Offering state-of-the-art discussion of theories, models, narratives and ideologies of innovation and alternative approaches, this book will be an essential resource for scholars in technology and innovation, management, engineering, political and social sciences. It will also appeal to policy-makers in the science and technology sector.Contributors include: C. Bagattolli, M.W. Bauer, L. Becerra, K. Berglund, T. Brandão, C. Cañibano, M.I. Encinar, G. Edward Elgar Publishing Ltd A History of American State and Local Economic Development: As Two Ships Pass in the Night
A History of American State and Local Economic Development presents the history of American local and state economic development from 1790 to 2000. This multi-variable, multi-disciplinary history employs a bottom-up policy-making systems approach through three eras of American state and local economic development. The history offers insight into why the practice and profession evolved as it has and comments on its present day complexity. It stresses mainstream economic and community development as an output of jurisdictional policy systems driven by political culture and three key forces of change-industry/sector profit cycle, population mobility and three competitive urban hierarchies-which continue to impact policy-making. With several chapters on each major US region, this book observes two macro political cultures, Privatism and Progressivism, that have persisted since the Early Republic and have inspired two often conflicting approaches to confront urban growth and decline. This history of American state and local economic development will be of main interest to the academic community and economic development professionals, particularly those in political science, public policy, history, economics, planning, urban sociology and geography. Research, policy institutes and NGOs will also find value in the comprehensive history.

Edward Elgar Publishing Ltd EU Economic Law in a Time of Crisis
This book will be of interest to all those concerned with the EU, whether from the perspective of political science, law or economics. Under the shadow of the financial crisis, studies with a broad research perspective and contributors from diverse backgrounds are important.'- Paul Craig, St John s College, Oxford'The European Union is re-emerging from the most serious economic crisis in its history. The agenda of the European Commission was highly influenced by the decisions to handle the debt, euro, banking and financial crises. The Union and its single currency have become much stronger. Economic law and governance in the Union are now rather different. By reading this book you will see where and how.'- Siim Kallas, Former Vice President of the European Commission 2004-2014How has the EU's economic crisis affected the development of economic law in the Union? This book contributes to the debate by examining EU economic law from a contextual and policy-oriented perspective. The expert authors explore areas such as the EMU and the internal market, and emphasize the important fields of public procurement, taxation, and intellectual property rights. The investigation proceeds along themes such as harmonization, institutional interplay, non-economic values, and international actions. The authors conclude that, during the crisis, the attention of the Barroso Commission focused quite narrowly on the most urgent problems, failing to consider longer-term issues to spark off bold policy endeavours, and break inter-institutional blockages. This book is targeted at scholars, policy-makers and other practitioners, as well as students, interested in EU economic law, integration, and the economic crisis.Contributors: J. Edward Elgar Publishing Ltd Crisis and the Failure of Economic Theory: The Responsibility of Economists for the Great Recession
Economists have rightly been criticized for not having foreseen the crisis that exploded in 2007-2008. As Giancarlo Bertocco eloquently argues, responsibility does indeed rest heavily on their shoulders. By developing a theory which excluded the possibility that a catastrophic crisis could ever happen, the economics profession has justified decisions and behaviours that caused the Great Recession. This book presents an alternative theoretical approach built on the lessons of Marx, Keynes, Schumpeter, Kalecki, Kaldor and Minsky, which highlights the structural instability of a capitalist economy and the endogenous nature of the current crisis. This fascinating book has several distinctive features. It begins by highlighting the limits of traditional economic theory and reveals the contradictions found in mainstream explanations as to the origins of the crisis. The author goes on to argue that economists not only failed to foresee the crisis but actually ignored the warning signs of instability that emerged during the Great Moderation. Bertocco presents an original interpretation of Keynes's argument that underlines the importance of Schumpeter's theory of credit in order to explain the relationship between money and crisis which characterizes a Keynesian monetary theory of production. Finally, he demonstrates that the nature of the crisis has important policy consequences and proposes a specific set of measures that take into account its structural nature. The comprehensive analysis and enlightening theoretical approaches will make this book vital reading for economists, policymakers and students seeking a clear understanding of the nature of the current crisis and the structure of the neoliberal economic system in which we live.

Edward Elgar Publishing Ltd Financial Crises, 1929 to the Present, Second Edition
This fascinating volume offers a comprehensive synthesis of the events, causes and outcomes of the major financial crises from 1929 to the present day. Beginning with an overview of the global financial system, Sara Hsu presents both theoretical and empirical evidence to explain the roots of financial crises and financial instability in general. She then provides a thorough breakdown of a number of major crises of the past century, both in the United States and around the world. Hsu's thorough and ambitious survey begins with the Great Depression of 1929, the first crisis created within the institutions of our current financial system, and moves through the aftermath of the Depression in the 1930s and 1940s, the inter-crisis period of the 1950s through the 1970s, and the emerging market debt default crisis of the 1980s. From there, she tackles major crises in specific countries from the 1990s on, including those in Mexico, Asia (Thailand, Indonesia, South Korea and Malaysia), Russia, Brazil and Argentina, as well as the Great Recession of 2008. The book concludes with a chapter detailing insightful policy recommendations for preventing future crises. Students and professors of economic history, financial and regulatory economics and banking will find this an invaluable resource, both for its comprehensive historical approach and its thoughtful look toward the future of the global economy.

Edward Elgar Publishing Ltd Heat, Greed and Human Need: Climate Change, Capitalism and Sustainable Wellbeing
'There are few scholarly books about climate change that take the issue of the distribution of its costs, and of the costs and benefits of its mitigation, as seriously as their absolute value. This is probably the best of those books that I have come across. Rigorously rooted in Gough's earlier work on theories of human need, the book is relentless in its pursuit of equity in respect of climate change and responses to it. Not everyone will agree with all its conclusions - for example that ''green capitalism merits the term contradiction'' - but they are unfailingly thought-provoking, as all good scholarship should be. Highly recommended.'- Paul Ekins, UCL Institute for Sustainable Resources, UK 'Gough applies his trademark scholarship on universal human needs to the urgent question of social policy for the transition to a de-carbonised world. Based on a clear-eyed analysis of a wide swathe of the social science literature, and an eco-social political economy perspective, his approach is both pragmatic and deeply rooted in ethics and social justice. Highly recommended and suitable for teaching at all levels.'- Juliet B. Schor, Boston CollegeThis exceptional book considers how far catastrophic global warming can be averted in an economic system that is greedy for growth, without worsening deprivation and inequality. The satisfaction of human needs - as opposed to wants - is the only viable measure for negotiating trade-offs between climate change, capitalism and human wellbeing, now and in the future. The author critically examines the political economy of capitalism and offers a long-term, interdisciplinary analysis of the prospects for keeping the rise in global temperatures below two degrees, while also improving equity and social justice. A three-stage transition is proposed with useful practical policies. First, 'green growth': cut carbon emissions from production across the world. Second, 'recompose' patterns of consumption in the rich world, cutting high-energy luxuries in favour of low-energy routes to meeting basic needs. Third, because the first two are perilously insufficient, move towards an economy that flourishes without growth. Heat, Greed and Human Need is vital for researchers and students of the environment, public and social policy, economics, political theory and development studies. For those advocating political, social and environmental reform this book presents excellent practical eco-social policies to achieve both sustainable consumption and social justice.

Edward Elgar Publishing Ltd Corporate Governance, The Firm and Investor Capitalism: Legal-Political and Economic Views
The shift from managerial capitalism to investor capitalism, dominated by the finance industry and finance capital accumulation, is jointly caused by a variety of institutional, legal, political, and ideological changes, beginning with the 1970s' down-turn of the global economy. This book traces how the incorporation of businesses within the realm of the state leads to both certain benefits, characteristic of competitive capitalism, and to the emergence of new corporate governance problems. Contrasting economic, legal, and managerial views of corporate governance practices in contemporary capitalism, the author examines how corporate governance has been understood and advocated differently during the New Deal era, the post-World War II economic boom, and after 1980 in the era of free-market advocacy. Covering the theory of the firm from the New Deal era until the post-2008 financial crisis, the book connects contemporary theories with their original legal roots, demonstrating inconsistencies in contemporary understanding. It also points at the differences between legal theory and neoclassical economic theory regarding the theory of the firm. The book examines how the entrenchment of shareholder welfare governance turns a blind eye to legal theory and corporate law, leading to theoretical inconsistencies and practical concerns, and criticises the agency theory argument in favour of unrestricted shareholder welfare governance. A comprehensive review of the literature on corporate governance, both in legal theory and in economics and management studies is included. This enlightening and informative book is essential reading for corporate governance scholars, management studies researchers, legal theorists and business historians.

Edward Elgar Publishing Ltd International Claims Commissions: Righting Wrongs after Conflict
International claims commissions have, over the last few decades, established themselves as important and permanent fixtures in international adjudication. This book provides a comprehensive review and analysis of the workings and mechanics of claims commissions to assess their success and predict their utility in the future. The book examines the legal framework of an international claims commission and the basic elements its processing procedure, as well as exploring the difficulties and challenges associated with operating costs, remedies and compliance with judgments. International claims commissions are created ad hoc to consider large numbers of complex legal claims resulting from an international upheaval, making them important international dispute resolution mechanisms. By focusing in large part on the examples set by the United Nations Claims Commissions, the Iran US Claims Tribunal, and the Eritrea Ethiopia Claims Commission, the authors assess the reasons to establish a claims commission by discussing their legal and operating structures, issues related to evidence and costs and the challenges and successes of creating them. The book concludes with a detailed analysis of lessons learnt to guide policy makers in the creation of future claims commissions. Written by two academics and a former practitioner this book is a practical resource for international law academics; counsel and judges in international courts and tribunals; policy makers in international organizations and foreign ministries, and diplomats.

Edward Elgar Publishing Ltd What’s Wrong with Keynesian Economic Theory?
One of the most striking phenomena in all of economics is the absence of a deep tradition of criticism focused on Keynesian economic theory. There have been critics but they are few and far between, even though Keynesian demand management has been at the centre of some of the worst economic outcomes in history, from the great stagflation of the 1970s to the twenty-year 'lost decade' in Japan that has been ongoing since the 1990s, and now, once again, the dismal recoveries that have followed the Global Financial Crisis. This book brings together some of the most vocal critics of Keynesian economics of the present time. Each author attempts to explain what is wrong with Keynesian theory for those seeking guidance on where to turn for a more accurate explanation of the business cycle and what to do when recessions occur. The contributions are by scholars from a wide number of schools of economics, include but are not restricted to Austrian, monetarist and classical perspectives. Written not just for economists, this accessible book is one of the few anti-Keynesian texts available and explains the inability of public spending and lower interest rates to have restored robust economic growth and full employment after the GFC. The collection offers an antidote to contemporary macroeconomic theory. It is an essential text for anyone wishing to understand why no stimulus has been able to bring recovery to any economy in which it has been tried.Contributors include: P.Boettke, P.L. Bylund, T. Edward Elgar Publishing Ltd Entrepreneurial Identity: The Process of Becoming an Entrepreneur
'Entrepreneurial identities permeate virtually every facet of the venturing process, but the study of these identities has received surprisingly little attention among scholars. Thomas Duening and Matthew Metzger address this problem with this insightful and timely edited volume. They have compiled an impressive array of research that covers both macro- and micro-level explorations of entrepreneurial identities. Most importantly, these chapters provide numerous examples of tangible advice to interested educators about how to foster the entrepreneurial spirit and build the entrepreneurial identity within their own students. This book is a must-read for anyone interested in entrepreneurial identities.'- Charles Murnieks, Oregon State University, US Entrepreneurship is an academic discipline that, despite decades of growth in research and teaching activity lacks a traditionally distinct or common pedagogy. In this book, editors Thomas N. Duening and Matthew L. Metzger explore entrepreneurial identity as a new basis upon which curricula can be constructed for aspiring entrepreneurs. Critically, this perspective is based on the insight that there is a fundamental difference between venture development and entrepreneur development. Unfortunately, most current interventions for aspiring entrepreneurs focus on the former at the expense of the latter. The editors have collected work from an international team of authors with diverse views on how identity theory applies to entrepreneur development. Chapters focus primarily on macro-level identity issues (that is, how do these entrepreneurial archetypes form, persist, and sometimes change) or micro-level identity issues (that is, how can educators and resource providers identify, communicate, and incentivize identity construction among aspiring entrepreneurs). Edward Elgar Publishing Ltd Handbook of Research on Nonprofit Economics and Management: Second Edition
Nonprofit organizations are arguably the fastest growing and most dynamic part of modern market economies in democratic countries. This Handbook explores the frontiers of knowledge at the intersection of economics and the management of these entities. Top researchers in the field review the role, structure, and behavior of private, nonprofit organizations as economic units and their participation in markets and systems of public service delivery, assess the implications of this knowledge for the efficient management of nonprofit organizations and the formulation of effective public policy, and identify cutting-edge questions for future research.Building on the success of the first edition, this thoroughly revised and expanded edition explores: (1) areas of general agreement from previous research; (2) areas of conflicting results and unexplored questions; (3) the relative roles of theory, data availability, and empirical analysis in explaining gaps in our knowledge; and (4) what must be done to improve our knowledge and extend the literature. Selected original chapters addressing especially challenging topics include: the value of risk management to nonprofit decision-making; nonprofit wages theory and evidence; the valuation of volunteer labor; property tax exemption for non-profits; when is competition good for the third sector; product diversification and social enterprise; international perspectives; the application of experimental research; and the macroeconomic effects of the nonprofit sector. This book is a valuable resource for academics, but the concerns of nonprofit sector managers and decision-makers are also addressed, making it a useful reference for practitioners as well.Contributors include: S.
