In the context of the current financial crisis, and at a time of deep global change, growing attention is paid to the global norms and ethical values that could underpin future global policy. Water is a key global resource. At the 3rd Marcelino Botin Foundation Water Workshop, held in Santander, Spain, June 12-14, 2007, the role of ethics in the deep roots, values, and the potential commonalities of the global water policy were discussed. In recent years new political actors, drawing on innovative sources of power and legitimacy, have become increasingly influential in world politics. Traditional international politics is being supplemented by non-state actors, organizations, and networks. The World Economic Forum and Transnational Networking presents an informative investigation of the WEF as a political actor and important part of transnational civil society. Drawing upon extensive original research, Friesen analyzes the surprising role the WEF has played in international processes such as the campaign for the cancellation of third world debt, a campaign which culminated in the adoption of the Multilateral Debt Relief Initiative at the G8 in 2005. Her findings provoke even wider questions about the role and influence of other non-state organizations and about transnational politics, questions that are particularly pressing at a time when the norms and formal institutional structures of the liberal international order appear to be eroding. Situé en Byzacène, à 12 km au sud-est de Thysdrus/El Jem, le municipe de Bararus/Henchir Rougga est connu pour ses grandes citernes d’époque romaine signalées depuis le XVIIIe s. et pour la découverte en 1972 d’un trésor de monnaies d’or byzantines publié en 1982 dans le volume III de la monographie générale du site. Ce volume I, rédigé pour l’essentiel au début des années 90, rend compte du résultat global des fouilles menées à l’emplacement du forum, de 1971 à 1974, par la mission tuniso-française sous la direction de Maurice Euzennat† et Hédi Slim†. L’ouvrage comprend trois parties : tout d’abord, une présentation générale du site par les deux chefs de mission et Pol Trousset ; ensuite, une description de la stratigraphie du forum et du mobilier qui en provient, par Roger Guéry† avec la collaboration de divers spécialistes ; enfin, une étude architecturale extrêmement précise des différents éléments qui composent le centre monumental de la cité : citernes, platea et portiques, xyste et temples, par Gilbert Hallier†. Ces travaux permettent de mieux appréhender la place du municipe de Bararus au centre d’une riche région agricole qui a laissé les traces de cadastration parmi les mieux conservées d’Afrique. Ils mettent en évidence sa longue durée d’occupation, du IIIe s. av. J.-C. (avec quelques traces antérieures remontant à la Préhistoire) jusqu’au XIe s., et l’originalité des partis architecturaux qui ont présidé à la construction de son centre monumental à l’époque flavienne, ses transformations au IIe s. et son abandon à l’époque byzantine.

In Discreet Power, Christina Garsten and Adrienne Sörbom undertake an ethnographic study of the World Economic Forum (WEF). Accessing one of the primary agenda-setting organizations of our day, they draw on interviews and participant observation to examine how the WEF wields its influence. They situate the WEF within an emerging system of "discretionary governance," in which actors craft ideas and entice formal authorities and top leaders in order to garner significant sway. Yet in spite of its image as a powerful, exclusive brain trust, the WEF has no formal mandate to implement its positions. It must convince others to advance chosen causes and enact suggestions, rendering its position quite fragile. Garsten and Sörbom argue that the WEF must be viewed relationally as a brokering organization that lives between the market and political spheres and that extends its reach through associated individuals and groups.They place the WEF in the context of a broader shift, arguing that while this type of governance opens up novel ways of dealing with urgent global problems, it challenges core democratic values.

Einflussnahmen auf die internationale gerichtliche Zuständigkeit (forum shopping) durch Schuldner erfreuen sich im Rahmen der Europäischen Insolvenzverordnung (EuInsVO) reger Beliebtheit. Nicht selten ist bei diesen Manövern aber fraglich, ob dem Ziel der EuInsVO, ein für die von der Insolvenz des Schuldners betroffenen Dritten feststell- und vorhersehbares Anknüpfungssystem zu schaffen, noch entsprochen wird. Es lohnt daher, die Zulässigkeit von forum shopping im Rahmen der EuInsVO mit Blick auf einen reibungslos funktionierenden Binnenmarkt zu beleuchten und zu hinterfragen, wie binnenmarktschädlichen Gestaltungen erfolgreich begegnet werden kann. Dies unternimmt Philipp Reuß und stellt dabei das unionsrechtliche allgemeine Rechtsmissbrauchsverbot in den Fokus seiner Betrachtung. Er bereitet das seit jeher kontrovers diskutierte Rechtsmissbrauchsverbot nicht nur rechtstheoretisch auf, sondern entwickelt auch dessen höchst umstrittene Geltung und konkrete Ausgestaltung im Recht der Europäischen Union, insbesondere im unionalen Insolvenzrecht.
