The definitive book on judicial review in Athens from the 5th through the 4th centuries BCE.The power of the court to overturn a law or decree—called judicial review—is a critical feature of modern democracies. Contemporary American judges, for example, determine what is consistent with the Constitution, though this practice is often criticized for giving unelected officials the power to strike down laws enacted by the people's representatives. This principle was actually developed more than two thousand years ago in the ancient democracy at Athens. In Control of the Laws in the Ancient Democracy at Athens, Edwin Carawan reassesses the accumulated evidence to construct a new model of how Athenians made law in the time of Plato and Aristotle, while examining how the courts controlled that process. Athenian juries, Carawan explains, were manned by many hundreds of ordinary citizens rather than a judicial elite. Nonetheless, in the 1890s, American apologists found vindication for judicial review in the ancient precedent. They believed that Athenian judges decided the fate of laws and decrees legalistically, focusing on fundamental text, because the speeches that survive from antiquity often involve close scrutiny of statutes attributed to lawgivers such as Solon, much as a modern appellate judge might resort to the wording of the Framers. Carawan argues that inscriptions, speeches, and fragments of lost histories make clear that text-based constitutionalism was not so compelling as the ethos of the community. Carawan explores how the judicial review process changed over time. From the restoration of democracy down to its last decades, the Athenians made significant reforms in their method of legislation, first to expedite a cumbersome process, then to revive the more rigorous safeguards. Jury selection adapted accordingly: the procedure was recast to better represent the polis, and packing the court was thwarted by a complicated lottery. But even as the system evolved, the debate remained much the same: laws and decrees were measured by a standard crafted in the image of the people. Edward Bawden had already established a growing reputation as a printmaker, designer and book illustrator when at the age of 36 he was appointed one of the original five Official War Artists for the Second World War. Between 1940 and 1944, during his two tours of duty in the Middle East, he produced some acclaimed watercolours, which immediately gave him an entirely new standing among contemporary artists. Deprived of access to the linocuts and engraving that he had already mastered, and without the demand for the humorous advertisements that had endeared him to Shell and London Transport, he devoted himself for the first time to portraiture as well as to his already well-developed interest in topography. Travelling extensively throughout Iraq, Iran and Saudi Arabia he developed new techniques, perfected his eye, relaxed his approach and produced some of his most memorable watercolours. After being evacuated from Dunkirk in 1940, Bawden spent the greater part of his appointment in the Middle East where he weathered extremes of climate, three bouts of malaria, walked some 300 miles with a regiment engaged in freeing Ethiopia, and spent five days in an open boat awaiting rescue. He was particularly keen to spend time with the people of the Middle East, who seemed to live in such markedly different times, and eagerly recorded the indigenous Marsh Arabs' way of life. Bawden's paintings depict not only the Middle East during wartime, but also a Middle East that no longer exists. Within 15 years of Bawden's departure in 1944, Iraq's monarchy had been swept away and the country's transformation into a radicalised Arab state was underway. This book brings together forty-five of Bawden's watercolours from this period, now housed in the Imperial War Museum collection and many published here for the first time, to produce a fascinating insight into Bawden's view of the Middle East. Alongside these evocative images the text traces Bawden's life and career, in particular his time as an Official War Artist; a chapter by Robin O'Neill sets the political context in which the allied forces and Bawden found themselves during the war and sketches the drastically changed political scenery since then. Roman Catholic Modernism, in France, was prominently represented by scholars whose interests were, in significant measure, historical. Notable examples are Louis Duchesne, Alfred Loisy, and Albert Houtin. Where philosophy was concerned, Maurice Blondel, together with his collaborator Lucien Laberthonniere, grappled with the legacy of Kant and the problem of the subjectivity of human knowing. Marcel Hebert (1851–1916) stands at the confluence of these two tendencies. Hebert’s appreciation of the exegesis of scripture and its subsequent development in church tradition was importantly shaped by both Loisy and Duchesne. And like Blondel and Laberthonniere, he felt the insufficiency of scholasticism to speak to minds formed by modernity, to formulate an adequate response to the philosophical legacy of Kant. He acknowledged his debt to Duchesne and Loisy in history, but regarded himself, though an autodidact, their superior in philosophy.This volume, the first to be published in English about Hebert, is essential for a full understanding of Catholic Modernism. The novel, according to standard scholarly narratives, depicts an individual's path to maturity. Scholarship on the rise of the novel in Germany and in Europe more broadly, from Watt to Moretti, has essentially collapsed the genreinto the individualist Bildungsroman, exemplified by a narrow canon. This study challenges and nuances these narratives, first by expanding the focus from the individual to the family, second by broadening the field of novels treated to include not only canonical works but also so-called trivial literature, and third, by reading novels alongside contemporary biological, legal, and pedagogical texts. This perspective reveals that the novel and the family around 1800 were mutually constitutive and that the two together were instrumental in the development of conceptions of individuality, kinship, and society that are still relevant today. This book explodes the myth of a monolithic liberal Judaism. Michael Staub tells the story of the many fierce battles that raged in postwar America over what the authentically Jewish position ought to be on issues ranging from desegregation to Zionism, from Vietnam to gender relations, sexuality, and family life. Throughout the three decades after 1945, Michael Staub shows, American Jews debated the ways in which the political commitments of Jewish individuals and groups could or should be shaped by their Jewishness. Staub shows that, contrary to conventional wisdom, the liberal position was never the obvious winner in the contest. By the late 1960s left-wing Jews were often accused by their conservative counterparts of self-hatred or of being inadequately or improperly Jewish. They, in turn, insisted that right-wing Jews were deaf to the moral imperatives of both the Jewish prophetic tradition and Jewish historical experience, which obliged Jews to pursue social justice for the oppressed and the marginalized. Starting off with the first Jesuit to reach the New World—he was promptly murdered on the Florida coast—Schroth focuses on the key periods of the Jesuit experience in the Americas, beginning with the era of European explorers, many of whom were accompanied by Jesuits and some of whom were Jesuits themselves. Suppressed around the time of the American Revolution, the Society experienced resurgence in the nineteenth century, arriving in the U.S. along with waves of Catholic immigrants and establishing a network of high schools and universities. In the mid-twentieth century, the Society transformed itself to serve an urbanizing nation. Schroth is not blind to the Society’s shortcomings and not all of his story reflects well on the Jesuits. However, as he reminds readers, Jesuits are not gods and they don’t dwell in mountaintop monasteries. Rather, they are imperfect men who work in a messy world to “find God in all things” and to help their fellow men and women do the same.
