Unter Rückgriff auf Argumentations- und Verfassungstheorie entwickelt er Anforderungen an die Verwendung des Arguments und rationalisiert so den Umgang mit Abschreckungseffekten. Die hieraus entwickelten grundrechtsdogmatischen Regeln finden Niederschlag auf den einzelnen Stufen der Grundrechtsprüfung, bei materiell-rechtlichen Verfassungsgeboten und hinsichtlich der verfassungsgerichtlichen Kontrolldichte.
