Eleven International Publishing The Position of Dutch Works Councils in Multinational Corporations
This book sets out to answer two main questions: what is the status quo of the position of Dutch works councils in multinational corporations? And which tools within the Dutch legal framework can be utilised in order to secure the successful involvement of the works council in the decision-making process in light of the increasingly globalised economy? The findings show that many participation rights are frequently used in practice, but not always. The inventory of good practices further revealed that a multitude of potential solutions are applied in practice. They show that, through negotiation and long-term experiences with participation mechanisms, tailor-made employee participation processes can be achieved. Overall, the position of the examined Dutch works councils is solid. However, works councils, management and supervisory boards and other stakeholders need to work on several aspects in order to improve the position of works councils and to safeguard their statutory rights - a theme that is emphasised throughout this study. Marcus Meyer's primary research focus is on employee participation issues in multinational corporations, both under national and EU law. His research is primarily of an empirical nature and focuses both on quantitative as well as qualitative legal research. Having participated in a number of research projects on cross-border mergers and corporate mobility, he also has a strong interest in corporate governance issues.

Eleven International Publishing Stability and Differentiation in the European Union: Search for a Balance
This book analyses how the European Union should react to the threats and challenges it faces today. Europe’s external problems concern first of all the geopolitical threats at its external borders, such as the Russia/Ukraine crisis, the ongoing conflicts in the Middle East, the anti-democratic developments in Turkey and the unrest in Northern Africa; and secondly the challenges of refugee flows, terrorism, climate change and the changing relationship with the United States. Internally, the Union has to deal with the aftereffects of the economic crisis, the impact of migration on national societies, the rise of populism and `Brexit’. These threats and challenges can only be countered effectively through concerted action by the Member States. However, EU cooperation is essentially a voluntary process, while the abovementioned problems are politically highly sensitive issues. Moreover, for every step forward in the integration process consensus is required between all Member States. Yet such a consensus becomes more and more difficult to attain, due to the growing number of Member States and their increased heterogeneity. The author therefore presents several concrete proposals for more flexible and differentiated EU integration, such as new models of enhanced cooperation, the establishment of an EU Security Council, and the simplification of the ordinary treaty amendment procedure.

In this farewell speech on the occasion of his retirement as Professor of Comparative Constitutional Law at Maastricht University, given in March 2022, Aalt Willem Heringa discusses the too often ignored role of courts as interpreters of statutes. The courts, by checking the (constitutional) quality of statutes, contribute to the rule of law and parliamentary democracy. Independent courts may add to the confidence in a constitutional and parliamentary system as a whole, by being in a position to decide cases on contentious issues as an authoritative third branch of government. Moreover, courts can also make it visible to all that not only are citizens bound by the law, but that rules and fundamental principles also apply to politicians. Being subject to legal rules is not an indication of weakness, as politicians often want us to believe. On the contrary, it is an expression of strength: the strength of the safeguards for the proper functioning of our political system, which is embedded in the law. Furthermore, Heringa puts forward proposals on how to embed this essential role and function of courts into the Dutch constitutional order. He also shows how courts are an essential feature that builds trust in the constitutional system, allows for the protection of individual rights and fundamental values and even leads to a strengthening of parliamentary democracy.
