This book analyzes U.S. federal cases on the copyright protection of computer software programs, to examine the role of communication in legal decision making process. It is the first to apply Anthony Giddens' theory of structuration to analyze law in a systematic and empirical way. Previous studies considered law to be independent, objective and neutral, and even those that considered social structures and actors focused on economic and political factors. Employing the framework of the author, the work, and the use, this study attempts to show how relationships and struggles of the parties are actually manifested through communication, and how the strategic communication of the parties influences the structural environment of copyright law. There has been a long-running debate over whether and how the copyright law, evolved from the era of the print technology, should be applied to computer programs, a new work of authorship. Contrary to some cautionary arguments that modern copyright law tends to protect copyright holders while disregarding authors' rights, the struggle between developers and non-developers, rather than between copyright holders and non-copyright holders, was clearly manifested in legal arguments. The construct of authorship has been modified, yet remained central in copyright discourse. On the other hand, the concept of the use, despite the significance of users in copyright regime, has yet to be developed to play an important role in the legal arguments. Moreover, the factor of whether the party was a developing entity, was found to be a single most important factor influencing the courts' decisions. But only when the party could successfully present itself as the one involved with developing activities, the court was more likely to accept its argument than the other party's. Therefore, it was the legitimacy gained by communicating the nature of the party, rather than the nature of the party itself, that made the difference in the ways the courts made decisions. This book presents how, in this process of strategic communication, the structure of copyright law was reproduced and transformed.

2 books & a CD. This study provides a comprehensive description of the rich song culture of the people in the Thule area in Greenland, the Inughuit. In 1937 the archaeologist and folklorist Erik Holtved recorded 134 traditional songs in Thule. Transcriptions and scientific processing of this collection constitute the nucleus of the work. Another collection of Inughuit songs was recorded in 1962 for The Danish Folklore Archives by Bent Jensen and the author. The songs from both collections are presented and notated in full length and also with analyses of a representative stanza from each song. Descriptions are given of performing habits, singing methods, drum construction and handling, as well as historical and recent data. Searching for resemblances among other Inuit groups produced transcriptions and analyses of many traditional Inuit Songs from different localities in Canada. It was discovered that characteristic traits of the form and melody types of the Inughuit are linked to Canadian Inuit groups in southern Baffin Island and among the Copper Inuit in northern Canada, documenting particular areas of origin, and also giving information about migration routes. The division between the scholar-gentry class and the “people” was an enduring theme of the traditional Chinese agrarian-bureaucratic state. Twentieth-century elites recast this as a division between intellectuals and peasants and made the confrontation between the writing/intellectual self and the peasant “other” a central concern of literature. The author argues that, in the process, they created the “peasantry,” the downtrodden rural masses represented as proper objects of political action and shifting ideological agendas. Throughout this transition, language or discourse has been not only a weapon of struggle but the center of controversy and contention. Because of this primacy of language, the author’s main approach is the close reading or, rather, re-reading of significant narrative fictions from four literary generations to demonstrate how historical, ideological, and cultural issues are absorbed, articulated, and debated within the text. Three chapters each focus on one representative author. The fiction of Lu Xun (1881-1936), which initiated the literary preoccupation with the victimized peasant, is also about the identity crisis of the intellectual. Zhao Shuli (1906-1970), upheld by the Communist Party as a model “peasant writer,” tragically exemplifies in his career the inherent contradictions of such an assigned role. In the post-Mao era, Gao Xiaosheng (1928—) uses the ironic play of language to present a more ambiguous peasant while deflating intellectual pretensions. The chapter on the last of the four “generations” examines several texts by Mo Yan (1956—), Han Shaogong (1952—), and Wang Anyi (1954—) as examples of “root-searching” fiction from the mid-1980’s. While reaching back into the past, this fiction is paradoxically also experimental in technique: the encounter with the peasant leads to questions about the self-construction of the intellectual and the nature of narrative representation itself. Throughout, the focus is on texts in which some sort of representation or stand-in of the writer/intellectual self is present—as character, as witness, as center of consciousness, or as first-person or obtrusive narrator. Each story catches the writer in a self-reflective mode, the confrontation with the peasant “other” providing a theater for acting out varying dramas of identity, power, ideology, political engagement, and self-representation.

It also describes how the peasants, due to their dissatisfaction with the rural regime, spontaneously organized and collectively dismantled the collective system. A closer examination suggests a much different and more nuanced story. By combining historical archives, field work, and critical statistical examinations, From Commune to Capitalism argues that the decollectivization campaign was neither a bottom-up, spontaneous peasant movement, nor necessarily efficiency-improving. Zhun Xu answers that the problems of the communes contributed to the passiveness of the peasantry; that decollectivization, by depoliticizing the peasantry and freeing massive rural labor to compete with the urban workers, served as both the political and economic basis for consequent Chinese neoliberal reforms and a massive increase in all forms of economic, political, and social inequality.
