In this book I argue for an approach that conceives human rights as both moral and legal rights. The merit of such an approach is its capacity to understand human rights more in terms of the kind of world free and reasonable beings would like to live in rather than simply in terms of what each individual is legally entitled to. While I acknowledge that every human being has the moral entitlement to be granted living conditions that are conducive to a dignified life, I maintain, at the same time, that the moral and legal aspects of human rights are complementary and should be given equal weight. The legal aspect compensates for the limitations of moral human rights the observance of which depends on the conscience of the individual, and the moral aspect tempers the mechanical and inhumane application of the law. Unlike the traditional or orthodox approach, which conceives human rights as rights that individuals have by virtue of their humanity, and the political or practical approach, which understands human rights as legal rights that are meant to limit the sovereignty of the state, the moral-legal approach reconciles law and morality in human rights discourse and underlines the importance of a legal framework that compensates for the deficiencies in the implementation of moral human rights. It not only challenges the exclusively negative approach to fundamental liberties but also emphasizes the necessity of an enforcement mechanism that helps those who are not morally motivated to refrain from violating the rights of others. Without the legal mechanism of enforcement, the understanding of human rights would be reduced to simply framing moral claims against injustices. From the moral-legal approach, the protection of human rights is understood as a common and shared responsibility. Such a responsibility goes beyond the boundaries of nation-states and requires the establishment of a cosmopolitan human rights regime based on the conviction that all human beings are members of a community of fate and that they share common values which transcend the limits of their individual states. In a cosmopolitan human rights regime, people are protected as persons and not as citizens of a particular state.

'Street capital' introduces the worlds of young black men dealing cannabis at a drug scene called The River in Oslo, Norway. The lives of these men are structured by a huge and complex cannabis economy and they are involved in fights, robberies and substance abuse. They lack jobs and education, and many of them do not have family or close friends, yet they do have 'street capital': the knowledge, skills and competence necessary to manage life on the streets. Centred on this concept of 'street capital', this unique book presents a new theoretical framework - inspired by and expanding on the work of Pierre Bourdieu, the French sociologist - for understanding street cultures. It is based on extensive fieldwork and repeated in-depth interviews with dealers aged between 15 and 30, which explore themes including marginalisation, discrimination, cannabis dealing and drug use, violence, masculinity, hip-hop culture, experiences with the welfare system, and issues of immigration and racism. With great immediacy, the diaries of Willy Cohn, a Jew and a Social Democrat, show how the process of marginalization under the Nazis unfolded within the vibrant Jewish community of Breslau—until that community was destroyed in 1941. Cohn documents how difficult it was to understand precisely what was happening, even as people were harassed, beaten, and taken off to concentration camps. He chronicles the efforts of the community to maintain some semblance of normal life at the same time as many made plans to emigrate or to get their children out. Cohn and his wife Gertrud were able to get their three oldest children out of Germany before it was too late. However, burying himself in his work chronicling the history of the Jews in Germany, his diaries, and his memoirs, Cohn missed his own chance to escape. In late 1941, he, Gertrud, and their two young daughters were deported to Lithuania, where they were shot. Willy Cohn was a complex individual: an Orthodox Jew and a socialist; an ardent Zionist and a staunch German patriot; a realist but also an idealist often unable to cope with reality; a democrat and an admirer of certain Nazi policies and of their resoluteness. He established his reputation with The Sleepwalkers, a trilogy of political and philosophical novels. His best-known work is The Death of Virgil, a long, challenging work in a lyrical, exuberant, and sometimes nearly incomprehensible style, akind of cerebral stream-of-consciousness of the dying Virgil. Broch also wrote extensively about modern art and architecture, Hofmannsthal, and mass psychology. He has a special connection to Yale, as he lived the last years of his life there after having escaped Austria in 1938. The participants in the Yale Symposium of April 2001 are among the world's most prominent Broch scholars. Fourteen of their presentations have been extensively revised for this volume, which focuses on Broch as critic and as novelist and dramatist. Topics include Broch's views on kitsch and art, and on drama; his cultural criticism; his cooperation with Borgese and Arendt; his theory of mass psychology; history in his works, Ernst Kretschmer's influence on him; Virgil and Celan's Atemwende; Jean Starr Untermeyer's translation of Virgil; guilt and the fall in Those without Guilt; and Broch reception in Japan. This book focuses on relatively neglected areas of simulation and gaming (S&G), i.e., cultural aspects and ethical issues, in addition to giving readers a basic knowledge of S&G. Although the educational effects of S&G, and related methods such as gamification, as well as serious games have been studied and are gaining recognition, their downsides are often overlooked. For example, there is always a risk of manipulation by games if maliciously designed and facilitated. Ethical codes of game designers, facilitators, and educators must be established on the basis of academic research. Considerations of the ethics of games are essential not only for S&G researchers and educators but also for the general public, because games have sometimes been used for propaganda purposes in the past and could be again, in the present and future. Looking at the cultural aspect, as the S&G community has accumulated research over 50 years, the book includes the knowledge of the pioneers, i.e., archival interview data. This is the first book that includes extensive interviews of researchers and commercial game designers and critics. It also contains diverse topics from the perspective of gender and Japanese culture. Japan has been attracting attention in the field of board games as there are many independent game designers and an expanding market. Although women in S&G have gained some recognition, the topic has been rather ignored and was first officially discussed in 2019 at the international conference of the International Simulation and Gaming Association held in Warsaw. In summary, by focusing on comparatively overlooked or neglected aspects of S&G, this book expands future opportunities in the field for researchers and educators, with increased awareness by the general public.
