In "Electing Judges", leading judicial politics scholar James L. Gibson responds to the growing chorus of critics who fear that the politics of running for office undermine judicial independence. While many people have opinions on the topic, few have supported them with actual empirical evidence. Gibson rectifies this situation, offering the most systematic and comprehensive study to date of the impact of campaigns on public perceptions of fairness, impartiality, and the legitimacy of elected state courts - and his findings are both counterintuitive and controversial. Gibson finds that ordinary Americans do not conclude from campaign promises that judges are incapable of making impartial decisions. Instead, he shows, they understand the process of deciding cases to be an exercise in policymaking, rather than of simply applying laws to individual cases - and consequently think it's important for candidates to reveal where they stand on important issues. Negative advertising also turns out to have a limited effect on perceptions of judicial legitimacy, though the same cannot be said for widely hated campaign contributions. Taking both the good and bad into consideration, Gibson argues that elections are ultimately beneficial in boosting the legitimacy of courts, despite the slight negative effects of some campaign activities. "Electing Judges" will initiate a lively debate inside both the halls of justice and the academy.

Corporate governance has been much in the news in recent years and lawyers are devoting increasing amount of attention to it. The passage of major federal legislation in 2002 (the Sarbanes-Oxley Act a.k.a. SOX) and 2010 (the Dodd-Frank Act) were particularly important developments, generating much new law and, as a result, much new legal work. Curiously, however, the law school casebook market has largely ignored these trends.Corporate governance is regulated by many of the same laws covered in the basic Business Associations course, but increasingly is also regulated by laws—such as SOX and Dodd-Frank—that get short shrift in the typical Business Associations casebook and course. In contrast, those laws are the core focus of the text.In addition to the pertinent laws, the book brings into play sources such as stock exchange listing standards and the rules issued by the Public Company Accounting Oversight Board and similar quasi-governmental bodies. Importantly, however, lawyers practicing in the corporate governance space must be knowledgeable not only about the law but also best practice. Since the end of World War II, runaway fears of Soviet imperialism, global terrorism, and anarchy have tended to drive American foreign policy toward an imperial agenda. At the same time, uncurbed appetites have wasted the environment and driven the country's market economy into the ditch. How can we best sustain our identity as a people and resist the distortions of our current anxieties and appetites? Ethicist William F. May draws on America's religious and political history and examines two concepts at play in the founding of the country - contractual and covenantal. He contends that the biblical idea of a covenant offers a more promising way than the language of contract, grounded in self-interest alone, to contain our runaway anxieties and appetites. A covenantal sensibility affirms, "We the people (not simply, We the individuals, or We the interest groups) of the United States". It presupposes a history of mutual giving and receiving and of bearing with one another that undergirds all the traffic in buying and selling, arguing and negotiating, that obtain in the rough terrain of politics. May closes with an account of the covenantal agenda ahead, and concludes with the vexing issue of immigrants and undocumented workers that has singularly tested the covenant of this immigrant nation.

This book explores the idea of privacy at sea, from early sixteenth-century maritime expansions to nineteenth-century naval developments. In this period, the sea became a focal point of political and economic ambition as technological and cultural shifts enabled a more extensive exploration of maritime spaces and global coexistence at sea. The exploration of the sea and the conflicts arising from establishing control over maritime routes demanded a more nuanced distinction and negotiation between State and private efforts. Privateering, for example, became a bridge between the private enterprises and the State’s warfares or trade struggles, demonstrating that the sea required public control at the same time as it enabled private endeavours. Although this tension between private and public interests has been explored in military and economic studies, questions of how the private appeared in maritime history have been discussed only through a particularly merchantile lens. This volume adds a new dimension to this discussion by focusing on how privacy and the private were perceived and created by the historical agents at sea. Mythologies is a masterpiece of analysis and interpretation. At its heart, Barthes’s collection of essays about the “mythologies” of modern life treats everyday objects and ideas – from professional wrestling, to the Tour de France, to Greta Garbo’s face – as though they are silently putting forward arguments. Those arguments are for modernity itself, the way the world is, from its class structures, to its ideologies, to its customs. In Barthes’s view, the mythologies of the modern world all tend towards one aim: making us think that the way things are, the status quo, is how they should naturally be. For Barthes, this should not be taken for granted; instead, he suggests, it is a kind of mystification, preventing us from seeing things differently or believing they might be otherwise. His analyses do what all good analytical thinking does: he unpicks the features of the arguments silently presented by his subjects, reveals their (and our) implicit assumptions, and shows how they point us towards certain ideas and conclusions. While in exile on St Helena, Napoleon dictated a commentary on the wars of Julius Caesar, later published in 1836. In each chapter he summarized the events of one campaign, then added comments from the standpoint of his own military knowledge. Over the nearly two millennia between Caesar and Napoleon some aspects of warfare had changed, notably the introduction of firearms. But much remained the same: the rate of movement of armies (at the foot pace of horse or man); human muscle power as the main source of energy for construction work; some military techniques, notably bridge construction; as well as the actual territory fought over by Caesar and later by Napoleon. Napoleon's commentary thus provides a fascinating and highly authoritative insight into Caesar's wars, as well as providing a window into Napoleon's own thinking and attitudes. Napoleon in places detects mistakes on the part of Caesar and his enemies, and says what they should have done differently. Remarkably, this is thought to be the first full English translation of Napoleon's work. Napoleon Bonaparte was born to an obscure Corsican family but rose through the ranks of the French army to become Emperor of France, conqueror of most of Europe and acknowledged military genius. One of the ways in which topology has influenced other branches of mathematics in the past few decades is by putting the study of continuity and convergence into a general setting. This new edition of Wilson Sutherland's classic text introduces metric and topological spaces by describing some of that influence. The aim is to move gradually from familiar real analysis to abstract topological spaces, using metric spaces as a bridge between the two. The language of metric and topological spaces is established with continuity as the motivating concept. Several concepts are introduced, first in metric spaces and then repeated for topological spaces, to help convey familiarity. The discussion develops to cover connectedness, compactness and completeness, a trio widely used in the rest of mathematics. Topology also has a more geometric aspect which is familiar in popular expositions of the subject as `rubber-sheet geometry', with pictures of Möbius bands, doughnuts, Klein bottles and the like; this geometric aspect is illustrated by describing some standard surfaces, and it is shown how all this fits into the same story as the more analytic developments. The book is primarily aimed at second- or third-year mathematics students. There are numerous exercises, many of the more challenging ones accompanied by hints, as well as a companion website, with further explanations and examples as well as material supplementary to that in the book.

An investigation into three of the best-known cases tried under the Court of Chivalry reveals much about gentry military society. The highest and most sovereign things a knight ought to guard in defence of his estate are his troth and his arms. So declared Richard, Lord Scrope of Bolton, before the Court of Chivalry, eloquently encapsulating the fundamental role heraldic identity played in the lives of the late medieval English gentry. The Court of Chivalry was England's senior military court during the age of the Hundred Years War (1337-1453), but unfortunately its medieval registers are now lost and only a bare few cases survive. This book explores three of the best preserved of those cases: Scrope v. Grosvenor (1385-91), Lovel v. Morley (1386-7) and Grey v. Hastings (1407-10), disputes in which competing knightly families claimed rightful possession of the same coat-of-arms. Hundreds of witnesses gave evidence in each of these cases, in the process providing vivid insights into the military, social, and cultural history of late medieval England. This study asks a number of important questions. How did the plaintiffs and defendants choose their witnesses? What motives and constraints shaped their choices? How did they gain access to the various gentry networks that spoke in their defence? To what extent did lordly influence impact upon the composition of each witness list? How well did the witnesses themselves know each other? What role did bonds of regional solidarity play before the Court? Perhaps most significantly, what does the testimony itself reveal about the chivalric culture of the age? The United States' commitment to separation of church and state has defined the nation, from the structure of the schools and the welfare system to the nature of American politics and society. Yet, from the days of the early republic, the separation of church and state came about slowly, amid contentious legal, intellectual, and religious debates. In this timely study, Mark McGarvie documents America's transition from Christian communitarianism with its government-sponsored religious institutions to liberal republicanism with its insistence that church and government not interfere with one another. Surprisingly, for a half-century after the ratification of the Constitution, many early state governments continued to support religious organizations. Disestablishment nonetheless proceeded, gaining ever greater momentum as churches lost tax support and found that they could not enforce mandatory attendance laws. No longer public institutions with strong state backing, churches were reconstructed as private, voluntary associations. At the same time, the state took responsibility for poor relief, community record keeping, and a variety of other public services formerly left to the churches. Slavery fascinated Thackeray. For him, the essence of slavery consisted of treating people like things. Thomas examines relationships in Thackeray’s fiction in which people have been reduced to objects and power is an end. These relationships include not only actual slaves and blacks, but also servants, dependents of all races, upper-class women sold into marriage, and children struggling to escape parental domination. Thomas also clarifies Thackeray’s view of black slavery. Many of his remarks about black men and women reflect an attitude that we could today call racist. He regarded blacks of the American South (where he traveled on lecture tours in 1852-53 and 1855-56) as inherently different from whites. At the same time, he viewed slavery as inherently wrong and condemned its exploitive aspects. Nonetheless, in some of his letters from America, he observed that the slaves he had seen appeared better treated, on the whole, than many domestic servants and industrial workers in England. It was characteristic of Thackeray to try to see both sides of a complex issue. However, modern students of Thackeray often seem to be so uncomfortable with his effort to present what he considered a balanced picture that they overlook his basic awareness of the vils of slavery and the way in which the idea of slavery repeatedly occurs in his writing. The prominence of this idea in his fiction has important implications for anyone studying nineteenth-century literature and culture. For Thackeray, as for most of his nineteenth-century British contemporaries, the major form of slavery was that to be found in the New World. However, ideas regarding galley (penal) slavery and Western concepts of “Oriental” slavery also contributed to his thinking about human bondage. Prior to his visits to the United States, the image of slavery had a powerful creative effect on Thackeray’s writing. In contrast, after his exposure to the reality of slavery in the American South, this image waned in creative power in his fiction. In the early morning of March 19, 1915, Lt. Colonel S. N. Miasoedov, a former gendarme officer on active duty with the Russian army in World War I, was hanged after a two-hour trial in Warsaw for treason. Nearly forty years ago, Sir Lewis Namier's studies showed that there were no organized national political parties in England during the middle of the eighteenth century, and historians have assumed that much the same statement could be made about het period from 1780's to the 1830's. Professor Ginter questions that assumption, and demonstrates that the origins of modern British electoral organization and political parties can be dated at about the end of the American War. The papers of William Adam at Blair Adam reveal that the tone and techniques of opposition politics began to undergo a fundamental change during the 1780's. In these years the Whig Opposition was unified under the leadership of the Duke of Portland and Chales James Fox, and it developed a surprisingly extensive political orientation. The party broke out of the restrictive parliamentary orientation that had heretofore characterize opposition politics and turned ot the country a large for support of its program and personnel. By 1790 British general elections were no longer contested exclusively by individuals and ad hoc committees, Adam, the party's political manager, in collaboration with the Duke of Portland, directed the general election campaign of 1790 from offices in Burlington House, and sent party agents and funds into those constituencies in which candidates had decided to stand a contest, but also expended funds in an effort to secure new seats for party members unable to find a likely constituency through their own efforts. The present volume, a selection from the family papers at Blair Adam, fully demonstrates the extent and quality fo the electoral organization of the Whig Opposition. Despite the many formal methods available most decisions are made intuitively?that is, without apparent reasoning and almost instinctively. The most creative moments of African American culture have always emanated from a lower class or "ghetto" perspective. In contemporary society, this ghetto aesthetic has informed a large segment of the popular marketplace from the incendiary nature of gangsta rap, through the choreographed violence of films like Menace II Society, to recurrent debates around the use of the word "nigga," and even the assertion of this perspective in professional basketball. In each case, most of the discussion around these cultural circumstances tends to be dismissive, if not completely uninformed.In analyzing the ranges of images from the O. J. Simpson trial to Snoop Doggy Dogg, Am I Black Enough for You looks at the way in which the nuances of ghetto life get translated into the politics of popular culture, and especially the way these politics have become such a profitable venture, for both the entertainment industry and the actual producers of these topical narratives.
