The past is weaponised in culture wars and cynically edited by those who wish to impose their ideology upon the physical spaces around us. Holocaust deniers use details of the ruins of the gas chambers Auschwitz to promote their lies: 'No Holes; No Holocaust'. What was life really like for the band of adventurers who first set foot on the banks of the James River in 1607? Important as the accomplishments of these men and women were, the written records pertaining to them are scarce, ambiguous, and often conflicting. After inquisitorial procedure was introduced at the Fourth Lateran Council in Rome in 1215 (the same year as England's first Magna Carta), virtually all court trials initiated by bishops and their subordinates were inquisitions. That meant that accusers were no longer needed. Rather, the judges themselves leveled charges against persons when they were publicly suspected of specific offenses--like fornication, or witchcraft, or simony. Secret crimes were off limits, including sins of thought (like holding a heretical belief). Defendants were allowed full defenses if they denied charges. These canonical rules were systematically violated by heresy inquisitors in France and elsewhere, especially by forcing self-incrimination. He deals with the trials of Lutheran dissidents at the time of Thomas More's chancellorship, and trials of bishops under Edward VI and Queen Mary, including those against Stephen Gardiner and Thomas Cranmer. Under Queen Elizabeth, Kelly shows, there was a return to the letter of papal canon law (which was not true of the papal curia). In his conclusion he responds to the strictures of Sir John Baker against inquisitorial procedure, and argues that it compares favorably to the common-law trial by jury.

During an armed conflict and in its aftermath, measures must be undertaken in order to ascertain the fate of the missing and to address the emotional distress of families from the lack of news on their relatives. In the same contextual settings, cases of missing persons may involve criminal accountability, thereby triggering actions directed to answer questions like `who is responsible?' and `what are the circumstances of the crime?'. These courses of action respond to two different needs, i.e., the need of families to know the fate and whereabouts of their missing relatives, and the societal and individual need for accountability. The book examines how the international legal framework meets these two distinct, but intertwined, needs. It captures the diversity of international rules concerning the issue of persons reported missing in armed conflict, as well as the complexity of their implementation in the transition from an armed conflict to peace. The book shows that the duty to account for missing persons has a temporal cross-cutting nature, since its implementation requires measures before, during, and after an armed conflict. Dealing with the issue of the missing across phases — i.e., durante bello and post bellum — entails a complex interplay of international norms. Affirming the relevance of the dialectic between International Humanitarian Law (IHL) and International Human Rights Law (IHRL) in the transition from conflict to peace, the book analyzes the simultaneous application of IHL and IHRL rules on missing persons in post-conflict and proposes a set of criteria that should govern their interplay. Measures that respond to the right of families to know the fate of their relatives cannot substitute those that are required to establish responsibility for IHL/IHRL violations and international crimes, and vice-versa. Examining specific examples, the book unveils the role that international law plays in the attempts of the international community to articulate humanitarian and accountability-driven efforts vis-à-vis post-conflict daims for information on the missing. Painting Culture tells the complex story of how, over the past three decades, the acrylic "dot" paintings of central Australia were transformed into objects of international high art, eagerly sought by upscale galleries and collectors. Since the early 1970s, Fred R. Myers has studied—often as a participant-observer—the Pintupi, one of several Aboriginal groups who paint the famous acrylic works. Describing their paintings and the complicated cultural issues they raise, Myers looks at how the paintings represent Aboriginal people and their culture and how their heritage is translated into exchangeable values. When in 1989 Chinese astrophysicist Fang Lizhi sought asylum for months in the U.S. Embassy in Beijing, later escaping to the West, worldwide attention focused on the plight of liberal intellectuals in China. In Science and Dissent in Post-Mao China H. Lyman Miller examines the scientific community in China and prominent members such as Fang and physicist and historian of science Xu Liangying. Drawing on Chinese academic journals, newspapers, interviews, and correspondence with Chinese scientists, he considers the evolution of China's science policy and its impact on China's scientific community. He illuminates the professional and humanistic values that impelled scientific intellectuals on their course toward open, liberal political dissent. It is ironic that scientific dissidence in China arose in opposition to a regime supportive of and initially supported by scientists. In the late 1970s scientists were called upon to help implement reforms orchestrated by Deng Xiaoping's regime, which attached a high priority to science and technology. The regime worked to rebuild China's civilian science community and sought to enhance the standing of scientists while at the same time it continued to oppose political pluralism and suppress dissidence. This study explores how Dante represents violence in the Comedy and reveals the connection between contemporary private and public violence and civic and canon law violations. Although a number of articles have addressed particular aspects of violence in discrete parts of Dante’s oeuvre, a systematic treatment of violence in the Commedia is lacking. This ambitious overview of violence in Dante’s literary works and his world examines cases of violence in the domestic, communal, and cosmic spheres while taking into account medieval legal approaches to rights and human freedom that resonate with the economy of justice developed in the Commedia. Exploring medieval concerns with violence both in the home and in just war theory, as well as the Christian theology of the Incarnation and Redemption, Brenda Deen Schildgen examines violence in connection to the natural rights theory expounded by canon lawyers beginning in the twelfth century. Partially due to the increased attention to its Greco-Roman cultural legacy, the twelfth-century Renaissance produced a number of startling intellectual developments, including the emergence of codified canon law and a renewed interest in civil law based on Justinian’s sixth-century Corpus juris civilis. Schildgen argues that, in addition to “divine justice,” Dante explores how the human system of justice, as exemplified in both canon and civil law and based on natural law and legal concepts of human freedom, was consistently violated in the society of his era. At the same time, the redemptive violence of the Crucifixion, understood by Dante as the free act of God in choosing the Incarnation and death on the cross, provides the model for self-sacrifice for the communal good. This study, primarily focused on Dante’s representation of his contemporary reality, demonstrates that the punishments and rewards in Dante’s heaven and hell, while ostensibly a staging of his vision of eternal justice, may in fact be a direct appeal to his readers to recognize the crimes that pervade their own world. For almost a decade, journalists and pundits have been asking why we don't see successful examples of political satire from conservatives or of opinion talk radio from liberals. This book turns that question on its head to argue that opinion talk is the political satire of the right and political satire is the opinion programming of the left. They look and feel like two different animals because their audiences are literally, two different animals. In Irony and Outrage, political and media psychologist Dannagal Goldthwaite Young explores the aesthetics, underlying logics, and histories of these two seemingly distinct genres, making the case that they should be thought of as the logical extensions of the psychology of the left and right, respectively. One genre is guided by ambiguity, play, deliberation, and openness, while the other is guided by certainty, vigilance, instinct, and boundaries. While the audiences for Sean Hannity and John Oliver come from opposing political ideologies, both are high in political interest, knowledge, and engagement, and both lack faith in many of our core democratic institutions. Young argues that the roles that these two genres play for their viewers are strikingly similar: galvanizing the opinion of the left or the right, mobilizing citizens around certain causes, and expressing a frustration with traditional news coverage while offering alternative sources of information and meaning. One key way in which they differ, however, concludes Young, is in their capacity to be exploited by special interests and political elites. Drawing on decades of research on political and media psychology and media effects, as well as historical accounts and interviews with comedians and comedy writers, Young unpacks satire's liberal "bias" and juxtaposes it with that of outrage's conservative "bias."
