The patrolman has the most difficult, complex, and least understood task in the police department. Much less is known of him than of his better publicized colleague, the detective. In this important and timely book, James Q. Wilson describes the patrolman and the problems he faces that arise out of constraints imposed by law, politics, public opinion, and the expectations of superiors.The study considers how the uniformed officer in eight communities deals with such common offenses as assault, theft, drunkenness, vice, traffic, and disorderly conduct. Six of the communities are in New York State: Albany, Amsterdam, Brighton, Nassau County, Newburgh, and Syracuse. The others are Highland Park, Illinois, and Oakland, California.Enforcing laws dealing with common offenses is especially difficult because it raises the question of administrative discretion. Murder, in the eyes of the police, is unambiguously wrong, and murderers are accordingly arrested; but in cases such as street-corner scuffles or speeding motorists, the patrolman must decide whether to intervene (should the scuffle be stopped? should the motorist be pulled over?) and, if he does, just how to intervene (by arrest? a warning? an interrogation?). In most large organizations, the lowest-ranking members perform the more routinized tasks and the means of accomplishing these tasks are decided by superiors, but in a police department the lowest-ranking officer—the patrolman—is almost solely responsible for enforcing those laws which are the least precise, the most ambiguous. Three ways or “styles” of policing—the watchman, the legalistic, and the service styles—are analyzed and their relation to local politics is explored.In the final chapter, Mr. Wilson discusses if and how the patrolman’s behavior can be changed and examines some current proposals for reorganizing police departments. He observes that the ability of the patrolman to do his job well may determine our success in managing social conflict and our prospects for maintaining a proper balance between liberty and order.

Muslim enclaves within non-Islamic polities are commonly believed to have been beleaguered communities undergoing relentless cultural and religious decline. Cut off from the Islamic world, these Muslim groups, it is assumed, passively yielded to political, social, and economic forces of assimilation and acculturation before finally accepting Christian dogma. Kathryn A. Miller radically reconceptualizes what she calls the exclave experience of medieval Muslim minorities. By focusing on the legal scholars (faqihs) of fifteenth-century Aragonese Muslim communities and translating little-known and newly discovered texts, she unearths a sustained effort to connect with Muslim coreligionaries and preserve practice and belief in the face of Christian influences. Devoted to securing and disseminating Islamic knowledge, these local authorities intervened in Christian courts on behalf of Muslims, provided Arabic translations, and taught and advised other Muslims. Miller follows the activities of the faqihs, their dialogue with Islamic authorities in nearby Muslim polities, their engagement with Islamic texts, and their pursuit of traditional ideals of faith. She demonstrates that these local scholars played a critical role as cultural mediators, creating scholarly networks and communal solidarity despite living in an environment dominated by Christianity.

Their powers were sweeping and draconian. When fully exercised against recalcitrant farmers, dispossession in part or whole could and did result. This book includes the most detailed analysis of these dispossessions including the tragic case of Ray Walden, the Hampshire farmer who was killed by police after refusing to leave hisfarmhouse in 1940. The committees were deemed successful by Whitehall as harbingers of modernity: mechanization, draining, artificial fertilizers, reclamation of heaths, marshes and woodlands. We now deplore some of these changes but Britain did not starve, in large part thanks to their efforts. If democracy implies the loss of an ultimate foundation for both ethics and political action, how can it be defended against its (ultra-nationalist, fundamentalist,...) critics. Are there reasons for being a 'democrat' and what does it mean to be so or to act 'democratically'. Does this merely imply strict obedience to certain procedures that we call 'democratic' or does a democratic society ask for a democratic attitude or ethos. If so, how can this ethos be defined and grounded. All contributions to this volume articulate answers to these questions or to problems intrinsically related to them (i.e. what is the status of the law when it loses ultimate foundation). They do so by reflecting on the work of some important contemporary French philosophers: Lefort, Lyotard, Derrida, Levinas, Lacan, etc.

The concept sensus communis—a term that means a great deal more than its English translation “common sense”—has served as a key principle in the theory of knowledge from the ancient Greeks through the Enlightenment philosophers. John D. Schaeffer shows how the seventeenth-century Italian philosopher Giambattista Vico synthesized Greek and Roman ideas of what sensus communis and what this synthesis implies for current discussions of rhetoric and hermeneutics. Arguments for ethical relativism emerge from divisions between sensus communis as an ethical judgment (a concept that Richard Rorty, Richard Bernstein, and others have tried to rescue) and as a linguistic consensus, a division against which Vico argued and which his own concept of sensus communis attempted to reconcile.In extended commentaries on Gadamer, the Gadamer/Habermas debate, and Derrida, Schaeffer shows that Vico offers the possibility of analyzing social phenomena and constellations of power from within the humanist rhetorical tradition. Vico’s achievements have powerful implications for relating ethics and hermeneutics to the world of concrete social practice, particularly in an age in which the electronic media have replaced print as the primary means of communication and in which a “secondary orality” (a cast of mind similar to that of nonliterate peoples) is appearing within our literate civilization.
