Many thousands of people are prosecuted each year for drink and drug driving offences. The legislation favours the prosecution in a number of ways, for example, by requiring those under investigation to give evidence against themselves in the form of specimens of breath, blood or urine, but also affords certain safeguards to suspects. The conviction rate is exceptionally high, and the provisions have given rise to a wealth of case law. Drink and Drug Drive Case Notes comprises summaries of the many cases on drink driving, and the fewer cases on drug driving, which have come before the High Court, the Court of Appeal, the House of Lords and, in one instance, the Supreme Court. Over six hundred judgments are summarised. Each note is presented as a short statement of the facts of the case, the question(s) put to the appeal court and an extract from the judgment. The notes are intended to provide a broad outline of the trends in the case law and as starting points for readers seeking guidance on particular issues. This third edition includes notes of some seventy-five cases decided since the second edition was published. Themes running through the new cases include the interpretation of the provisions on reasonable cause to believe that the breath analysis device has not produced a reliable indication of the suspect’s breath alcohol level, and on the application of the Criminal Procedure Rules to proceedings for drink and drug driving. At the time of publication, the so-called “statutory option” has just been removed, and section 5A of the Road Traffic Act 1988, creating new offences of driving, attempting to drive, and in charge, with a concentration of a specified controlled drug above a specified limit, has come into force. The offences are framed in much the same terms of the excess alcohol offences, but testing will be by the analysis of blood or urine only. While much of the case law concerning drink-driving will be relevant, the new provisions will no doubt give rise to their own body of case law in due time. A strikingly attractive woman-child—a model and fashion photographer who always saw the world through the eyes of a girl—she was the author of nineteen children’s books that are still remembered fondly by a legion of fans. It is also a time capsule of a unique island culture just past the midpoint of the twentieth century. Encouraged by her mother, the artist Edith Stevenson Wright, Dare learned to sketch, paint, write, and sew. It took the catalyst of photography for Dare to later combine these talents into her Lonely Doll book series. Moving to New York in her twenties, Dare modeled for major magazines and had small parts in theatrical productions. A stunning beauty, Dare seemed a natural for show business, but she was never comfortable performing in a public venue. Competition, whether with other actresses for roles, or with her mother as a painter, was too distressing. Instead, Dare found her niche as a photographer, first in the fashion field, and then as a children's book author. In 1941, Dare and her brother Blaine met for the first time since they had been separated as children. Blaine was handsome, witty, and everything Dare could have wished for in a sibling. Blaine introduced Dare to his RAF friend, Philip Sandeman. The two became engaged, but the wedding never transpired. The 1957 success of Dare's first book, The Lonely Doll, brought her recognition as both an author and photographer. Illustrated with Dare's haunting black-and-white photographs, the seemingly simple text touched both children and their parents. Almost fifty years later, Dare's nineteen published books continue to delight a new generation of readers.

Anglo-India's regional literature was both a practical and imaginative response to a pivotal period in the early colonialism of South Asia.Awarded as Honorable Mention of the Louis Gottschalk Prize by the American Society for Eighteenth-Century Studies (ASECS). Shortlisted for the Kenshur Prize by the Center for Eighteenth-Century Studies, Indiana University, John Ben Snow Prize by the North American Conference on British Studies, Marilyn Gaull Book Award by the Wordsworth-Coleridge Association.During the later decades of the eighteenth century, a rapid influx of English-speaking Europeans arrived in India with an interest in expanding the creation and distribution of anglophone literature. At the same time, a series of military, political, and economic successes for the British in Asia created the first global crisis to shepherd in an international system of national ideologies. In this study of colonial literary production, James Mulholland proposes that the East India Company was a central actor in the institutionalization of anglophone literary culture in India. The EIC drew its employees from around the British Isles, bringing together people with a wide variety of ethnic and national origins. Its cultural infrastructure expanded from presses and newspapers to poetry collections, letters, paper-making and selling, circulating libraries, and amateur theaters. Recovering this rich archive of documents and activities, Mulholland shows how regional reading and writing reflected the knotty geopolitical situation and the comingling of Anglo and Indian cultures at a moment when the subcontinent's colonial future was not yet clear. He shows why Anglo-Indian literary publics cohered during this period, reexamining the relationship between writing in English and imperial power in a way that moves beyond the easy correspondence of literature as an instrument of empire. Taken over by the Union Army during the Civil War, it suffered extensive damage from Confederate attack but was rebuilt and operated by the U.S. Military Railroad for over two years. Returned to its owners in September 1865, it became the Nashville, Chattanooga & St. Louis Ry. in 1873, after absorbing the Nashville & Northwestern RR. During the next 25 years, it became known to the public first as the Tennessee Line, then as the Lookout Mountain Route. In 1890 it gained entrance into Atlanta as lessee of the state-owned Western & Atlantic RR. Paducah and Memphis were reached in 1896, when lines of the former Paducah, Tennessee & Alabama RR were leased from L&N. At its zenith in the 1920s, it operated approximately 1,259 miles of track, from the Mississippi and Ohio rivers through Kentucky, Tennessee, and Alabama, to Atlanta, Georgia. In 1880, to eliminate the threat of competition that was developing between the two companies, the Louisville & Nashville RR acquired control of the NC&StL Ry., much to the dismay of the citizens of Nashville, and for the next 77 years it operated as a prosperous subsidiary of the Old Reliable. It was actually absorbed by the L&N organization in 1957 to become part of the Nashville and W&A divisions. But it will always be remembered by the people of Tennessee and Georgia as the original Dixie Line—the route of such Chicago-Florida passenger trains as the Dixie Flyer, Dixie Limited, Dixie Express, Dixie Mail, Dixieland, Dixie Flagler, and Dixiana. Wrestling with the Angel is a meditation on contemporary political, legal, and social theory from a psychoanalytic perspective. It argues for the enabling function of formal and symbolic constraints in sustaining desire as a source of creativity, innovation, and social change. The book begins by calling for a richer understanding of the psychoanalytic concept of the symbolic and the resources it might offer for an examination of the social link and the political sphere. The symbolic is a crucial dimension of social coexistence but cannot be reduced to the social norms, rules, and practices with which it is so often collapsed. As a dimension of human life that is introduced by language-and thus inescapably "other" with respect to the laws of nature-the symbolic is an undeniable fact of human existence. Yet the same cannot be said of the forms and practices that represent and sustain it. In designating these laws, structures, and practices as "fictions," Jacques Lacan makes clear that the symbolic is a dimension of social life that has to be created and maintained and that can also be displaced, eradicated, or rendered dysfunctional. The symbolic fictions that structure and support the social tie are therefore historicizable, emerging at specific times and in particular contexts and losing their efficacy when circumstances change. They are also fragile and ephemeral, needing to be renewed and reinvented if they are not to become outmoded or ridiculous. Therefore the aim of this study is not to call for a return to traditional symbolic laws but to reflect on the relationship between the symbolic in its most elementary or structural form and the function of constraints and limits. McNulty analyzes examples of "experimental" (as opposed to "normative") articulations of the symbolic and their creative use of formal limits and constraints not as mere prohibitions or rules but as "enabling constraints" that favor the exercise of freedom. The first part examines practices that conceive of subjective freedom as enabled by the struggle with constraints or limits, from the transference that structures the "minimal social link" of psychoanalysis to constrained relationships between two or more people in the context of political and social movements. Examples discussed range from the spiritual practices and social legacies of Moses, Jesus, and Teresa of Avila to the political philosophy of Hannah Arendt and Jacques Ranciere. The second part is devoted to legal and political debates surrounding the function of the written law. It isolates the law's function as a symbolic limit or constraint as distinct from its content and representational character. The analysis draws on Mosaic law traditions, the political theology of Paul, and twentieth-century treatments of written law in the work of Carl Schmitt, Walter Benjamin, Sigmund Freud, Pierre Legendre, and Alain Badiou. In conclusion, the study considers the relationship between will and constraint in Kant's aesthetic philosophy and in the experimental literary works of the collective Oulipo.

Change is inevitable. This is the only constant in our lives. Yet, change is also something that we fear. We seek comfort in the familiar, in routines and in conventions. We are afraid of things that we don't know or we don’t understand. We fear change because we don’t know how change will affect us. Change, however, is necessary for progress. Sometimes, change happens naturally due to circumstances beyond our control, and sometimes we initiate change because we can or because we must. In 2020, we experienced the biggest change of our lifetimes. For a brief moment in history, the world came to a halt. Then, everything changed. Many things that we used to take for granted no longer applied. We experienced major disruptions to our daily lives. As if in some kind of perfect storm, so many things happened all at once – global pandemic, social inequalities, climate change, racial injustices, riots and unrests, gender struggles and rapid advances of new technologies. This book started to take shape in the midst of it all, and in a way, it is a time capsule of how we experienced the birth of what became known as the 'new normal'. Designers are the kind of people who thrive in times of change. In fact, it is their job to create change. The nature of their job is such that they have to take an existing situation and change it into a better, or a more preferred situation. Some do this by relying on their imagination and personal experiences, and some use evidence-based research to inform their work. Regardless of this, many share the belief that they can somehow make the world a better place – on a micro or a macro level. During this period of massive change, Gjoko Muratovski invited ten highly influential design figures – including iconic design leaders such as Carole Bilson, Karim Rashid, Bruce Mau, Steven Heller and Don Norman – to reflect on the state of things today. Ian Nyschens (pronounced "nations") shot as many elephants as Walter Bell did—well over 1,000—and under much more difficult circumstances. His book will rank or surpass the best elephant-ivory hunting books published in the twentieth century. Remarkably, his adventures took place much later than the likes of Bell, Sutherland, Neumann, and others. The stories of his hunts with his double rifle are sure to impress. Ian’s career as an elephant hunter began in 1947 in Southern Rhodesia when he found a companion—Faanie Joosten—and the pair of them started hunting for ivory for a living. They roamed far and wide, often outside of the law, as far north as southern Tanzania and as far east as the coast of Mozambique. But Ian's stronghold was the thick jess bush of the Zambezi Valley, a place he loved more than any other. There, visibility was so poor that sometimes a hunter could be close enough to touch an elephant with the barrel of his rifle before he could see it. Ian’s life was one fantastic epic adventure after another. He once faced a stampede of seventeen furious elephants in reeds over twelve feet tall and had to shoot a “wall” of elephants to prevent him and his companions from being overrun. On another occasion Ian and Faanie developed a method of hunting crocodiles for their skins that entailed walking chest-deep into the Zambezi River at night. They would stand next to an anchored hippo leg and "brain" the crocs. In the end that got a bit too much even for Ian, and he gave it up as being too hazardous. Ian was married for a time, but his lifestyle was not conducive to domestic bliss, and the marriage did not last. Once the Kariba Dam was completed in 1959, it flooded a great deal of his beloved Zambezi Valley, and Ian's world began to shrink. He continued to shoot elephant under the control scheme set by Rhodesian authorities, but his footloose days were at an end. He joined the wildlife department as a game ranger for a while, but his unsociable character made for a short career. He shot most of his elephants with a Rigby .450 3¼. He used the Rigby so much that the barrels separated from use (the solder disengaged), and he had to send it back to London to have it repaired. Not many people use a double rifle to that extent! Ian Nyschens was the most notorious elephant poacher in Rhodesia until the time he was finally appointed a warden to help protect the game. This is a highly entertaining story of an irascible loner whose violent adventures make Jesse James sound like a Sunday school teacher! Footnote: Sadly, Ian Nyschens died on 6 December 2006 in Harare, Zimbabwe. May he now tread in the eternal hunting grounds where all elephants carry tusks of a minimum of eighty pounds per side. This is the first scientific-educational work in English on this topic. The Caucasus Isthmus between the Black and Caspian Seas (38025' and 47015'N, 36030' and 50020'E) is a region in the Northern Hemisphere. It covers an area of approximately 441,000km2. Being a natural bridge between Europe and Asia, the Caucasus is an extraordinary crossroads in terms of its geopolitical status, cultural heritage, and biodiversity. The Caucasus is famous for having some of the richest biodiversity, making it one of the 34 most diverse and endangered biodiversity hotspots in the world. The region occurs from among the lush, broad-leaved forests along the Black Sea coastal area, to the well-expressed nival zone and the deserts of the eastern Caucasus. Flora within the Caucasus is diverse, with about 6,300 species of vascular plants, 1,600 of which are endemic and relict endemics (25.3 %). Biota of the Caucasus has always aroused the interest of scholars. Studies conducted by botanists and zoologists on the biodiversity of the Caucasus started in the beginning of the 18th century. Such research activities were relatively short-term, and based solely on either plant or animal investigations. Long-term, comprehensive (floristic, faunistic, biogeographical) studies of the wilderness of the Caucasus in all biomes and altitudinal zones, and in all vegetation seasons, were carried out by Dr G. Radde in the late 19th and early 20th centuries, and Dr A. M. Gegechkori in the second half of the 20th and early 21st centuries. In the framework of the Caucasus biota, the main target of research activity of Dr. Gegechkori (1962-2018) was psyllids (Insecta; Hemiptera: Psylloidea) - a highly indicative (bio-indicator) group for environmental research. This text aims to provide information for naturalists, concerning the biota of the Caucasus, through its biomes, amd refugial areas and habitats. The work is focused on supplying a datebase for the current presence and distribution of many speceis, with an emphasis on the keastone species, the existance and range of which face major challenges and threats today, caused primarily by human's direct and indirect activity, and global warming. The book incorporates the most recent taxonomic ranking of plants and animals species in the Caucasus, and the regularity and history of its biomes, among other topics. The monograph is also heavily illustrated with mostly original color photos, which reinforce the scientific quality of the text. This book will be of great interest to scholars of life and earth sciences and geographers. As an interdisciplinary work, the monograph provides students of all levels with valuable information on the environmental sciences, which may isnpire them to pursue this topic within natural science, stimulating their research and career choices. Finally, the purpose of the work is to strenghten the readers' awareness of the environmental challenges among the local people of the Caucasus, in light of on-going environmental changes, and the necessity of protection of this region's natural resources.
